Levine Act Warning
Applicants and their agents before the City Council are subject to the campaign disclosure provisions detailed in Government Code Section 84308. No City Council Member may accept, solicit, or direct a contribution of more than $500 from any party for 12 months following the date a final decision is rendered by the City. No City Council Member may accept, solicit, or direct any contribution from an agent of the party during the same time frame. This prohibition commences when an item involving the entitlement has been placed on the City Council’s agenda for a public meeting, when the City Council Members knows the action is within the City Council’s jurisdiction and it is reasonably foreseeable that it will come before the City Council as a decisionmaker, or when the proceeding is before the City Council for its decision. A party to a City proceeding —which includes both applicants and agents—shall disclose on the record of the proceeding any contribution of more than $500 made to any Council Member by the applicant, or any donations made by the agent, during the preceding 12 months. No party to a City proceeding, or agent, shall make a contribution to a Council Member during the proceeding and for 12 months following the date a final decision is rendered by the City. Prior to rendering a decision on a City proceeding, any Council Member who received contribution of more than $500 within the preceding 12 months from any party, or who received any donations from an agent, to a proceeding shall disclose that fact on the record of the proceeding, and shall be disqualified from participating in the proceeding. However, if any Council Member receives a contribution that otherwise would require disqualification, and returns the contribution within 30 days of knowing about the contribution and the relevant proceeding, the Council Member shall be permitted to participate in the proceeding. If you believe that these provisions apply to you or a Council Member, please inform the City Clerk at the earliest possible opportunity. Failure to do so may affect the City’s ability to process your application.

UPDATES ON DEVELOPMENT APPLICATIONS
6380 Via Real Multifamily Residential Project Concept Submittal The Community Development Department recently received a conceptual review application and SB330 pre-application submittal for a proposed multifamily residential development to be located at 6380 Via Real (the former “Lagunitas” office park site). The proposal, submitted by City Ventures Homebuilding, LLC, contemplates a 93-unit townhome (condominium) development containing a mix of two- and three-story units in three- and four-bedroom configurations. The proposal seeks to utilize state Density Bonus Law to receive relief from certain local zoning requirements in exchange for setting aside 12 income-restricted units (10 units at “moderate-income” levels and 2 units at “abovemoderate” income levels). City staff is currently reviewing the initial pre-application submittal and will be working with the applicant team to set a date for a conceptual review hearing with City decision-makers. The conceptual plans and pre-application materials are on file with the Community Development Department and are available for public review upon request.

Carpinteria Head Start Parent Meeting Outreach
As part of the City’s ongoing efforts to support the community, Community Engagement Librarian Eric Castro recently participated in an outreach event with Carpinteria Head Start parents. He was invited to present updated information on immigration-related resources to a group of approximately 12 families, including 16 adults and their children, all of whom are immigrants living and working in Carpinteria.

The presentation was conducted in a conversational format, fostering an open and empathetic dialogue. Seated around a round table, parents engaged in discussion and asked questions as Eric guided them through a Resource Toolkit provided by the Immigrant Legal Resource Center (ILRC, November 2024). Topics covered included:
• The importance of establishing a child care plan, including instructions for completing a Caregiver’s Authorization Affidavit (CAA), as outlined in the California Family Code.
• Encouragement to consult with an immigration attorney to explore legal status options.
• Information on immigrants’ rights.
• A review of available legal resources in Santa Barbara County.

POLICY CONSISTENCY
The City is in compliance with the adopted Statement of Safekeeping and Investment of Public Funds.

FINANCIAL CONSIDERATIONS
Cash Statement: On January 31, 2025, the City held cash and cash investments as shown in Table 1 below.

Table 1
Investments:

Changes in the market value of treasury securities are inversely proportional to changes in interest rates demanded in the open market (i.e., when rates rise market values fall, when rates fall market values rise).
changes in market rates is a function of its days to maturity and coupon rate. Securities with longer maturities and/or lower coupon rates are more sensitive to changes in market interest rates. As security matures, changes in its value become less sensitive to market rate changes.

As of January 31, 2025, the portfolio 2.20 years, the
average coupon rate was 2.57%, the average yield to maturity was 4.27%, the par value was $9,500,000 and the Market Value was $9,307,773.30.

The City does not intend to sell or have any foreseeable need to sell any securities. The to hold all securities to maturity, and securities so held are redeemed at par value resulting in no net market gain or loss.

Attached for City Council review is listing all the investments and cash activity during the month.

The City of Carpinteria will be able to meet all expenditure obligations that might reasonably be anticipated for the next six-month period from February 1, 2025, to August 1, 2025.

ITEM FOR COUNCIL CONSIDERATION
Adoption of Resolution No. 6367, Approving an Appointment to Advisory Board.

STAFF RECOMMENDATION
Adopt Resolution No. 6367, approving an appointment to the Downtown T Business Advisory Board.

Sample Motion: I move to adopt Resolution No. 6367, as read by title only, approving the appointment of Kevin Murphy as an assessment-paying member to the Downtown T Business Advisory Board.

BACKGROUND
The Downtown "T" Business Advisory Board (formerly the Parking and Business Improvement Area Advisory Board or PBIAAB) was formed in 1990 (via Resolution No. 1882) in order to comply with a change in State law that required the appointment of an advisory board to make recommendations to the City Council on the use of Business Improvement District funds collected through assessments. The Carpinteria Parking and Business Improvement Area District was formed in 1986 and has operated continuously since that time.

Board was changed due to the dissolution of the Carpinteria First Committee via Resolution No. 5902 in June 2019.

On February 3, 2025, at a special City Council meeting, the Council made biennial . After the
meeting, the City received the attached application (Attachment A) from a business owner in Parking and Business Improvement Area District No. 4 for the Downtown "T" Business Advisory Board (DTBAB). Since all DTBAB appointments have not been filled, the Council may still appoint the final member.

The purpose of this agenda item is for the Council to consider appointing the remaining member to the DTBAB.

Appoint a City Representative to the Community Media Access Center (TV Santa Barbara) Board of Directors.

STAFF RECOMMENDATION
Appoint a City Representative to the Community Media Access Center (TV Santa Barbara) Board of Directors.

Sample Motion: I move to appoint a City Representative to the Community Media Access Center (TV Santa Barbara) Board of Directors.

BACKGROUND/DISCUSSION

continued in 1985 with the establishment of the Public Access Advisory Committee (PAAC).

During this time and through 2003, Public and Educational Access programming was managed by Cox Communications.

In 2001, Santa Barbara County staff recommended that Public and Educational Access television would be best served by a non-profit organization. After much discussion and planning by the PAAC members, the Community Media Access Center (now known as TV Santa Barbara) was officially established on January 1, 2003. TV Santa Barbara is responsible for the operation of both Public Access (Channel 17) and Educational Access (Channel 71) in the cable franchise areas served by Cox Communications. In addition to programming, TV Santa Barbara provides Carpinteria residents with access to equipment and studio space that can be used for community-based programming. The Board of Directors of TV Santa Barbara includes a City of Carpinteria Representative which the Council appoints for a two-year term.

On November 12, 2024, the City Council adopted Resolution No. 6346, adopting a process to appoint public members to City Council Advisory Groups and to appoint City Council representatives to outside agencies and committees and to City Council subcommittees. In addition, the Council approved a City Council Advisory Group Handbook. Under Resolution CMAC Appointment

STAFF RECOMMENDATION
Adopt Resolution No. 6368 updating the operational hours of the Skate Park and rescind Resolution No. 6256.

Sample Motion: I move to adopt Resolution No. 6368 as read by title only.

BACKGROUND
On March 13, 20231, the Carpinteria City Council adopted Ordinance No. 763, establishing Skate Park Rules and Regulations as a part of Carpinteria Municipal Code (CMC) Chapter 12.24, including that Skate Park hours shall be established by City Council Resolution, CMC 12.24.101(C)(20).

Due to equipment issues, the Skate Park has been lit throughout the night since it opened.

City staff and others, including the Police Chief and deputies, have witnessed consistent and positive use of the park into the late-night hours. The City recently received the equipment necessary to properly control the lighting schedule; however, given the usage level of the park after sunset, lack of issues or complaints, and overall positive feedback from stakeholders, staff is proposing a potential change to Skate Park hours.

The City Council has the authority to define the open hours of the Skate Park and may revisit this matter as needed to ensure that the facility is managed in a way that best serves the community. Currently, Resolution No. 6256 states Skate Park hours are 30 minutes before sunrise until 30 minutes after sunset every day of each week. Extended hours, up to 10PM, are allowed with City Manager approval, when posted at the Skate Park by the City in writing, and only when the Skate Park lights are illuminated. Based on observed usage and discussions with the Carpinteria Skate Foundation and our local , City staff proposes the following changes to the
Skate Park hours:

From 30 minutes before sunrise to 10PM, Sunday thru; and From 30 minutes before sunrise to 11PM, Friday and Saturday The proposed changes would establish fixed extended hours without requiring special approval or postings; however, the City Manager or their designee would still retain the authority to adjust hours as needed for safety, maintenance, or special circumstances.

Examples would include closing for graffiti removal or weather, or extended hours past 11 PM with an approved City permit.

Expanding the weekend hours could provide several benefits to the community. The Skate Park has proven to be a well-used and valued recreational amenity, drawing participants of all ages, including youth, teens, and adults. Extending Friday and Saturday hours would allow park users more time to enjoy the facility in a well-lit, controlled, and safe environment rather than seeking alternative, potentially unsafe spaces after hours.

Additionally, weekend events, including those hosted by the Carpinteria Skate Foundation, often conclude around 10 PM, and an additional hour would provide a more structured timeframe for event breakdown and cleanup.

Lastly, operational hours that reflect community usage serve to reduce the need for enforcement, and park activation, in general, serves to deter other improper uses in or around the park. If approved, proper signage will be posted at the facility to reflect the new hours, and City staff will continue to monitor usage patterns and address any concerns as they arise.

OF THE CARPINTERIA SKATE PARK
AND RESCINDING RESOLUTION NO. 6256
WHEREAS, on March 13, 2023, the City Council adopted Ordinance No. 763 which established Skate Park Rules and Regulations as a part of Carpinteria Municipal Code Chapter 12.24, including that Skate Park hours shall be established by resolution; and
WHEREAS, on July 10, 2023, the City Council adopted Resolution No. 6256 which established the Skate Park operating hours when the Carpinteria Skate Park is open to the public; and
WHEREAS, staff is proposing an extension of the operating hours until 11 PM on Friday and
programming, while maintaining a 10 PM closure on all other days; and WHEREAS, expanding weekend hours would allow park users more time to enjoy the facility in a well-lit, controlled, and safe environment; and weekend events often conclude around 10 PM and an additional hour would provide a more structured timeframe for event breakdown and cleanup; and
WHEREAS, the Skate Park is equipped with lights designed to illuminate the skateable areas allowing the park to be used after sunset when the lights illuminate; and WHEREAS, if adopted, the extended new hours will be implemented immediately and staff will review the effectiveness of the new hours of operation.
