A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, APPROVING REVISED ADMINISTERING AGENCY-STATE AGREEMENT FOR STATE-FUNDED PROJECTS NO. 08-5430S21 AND
AUTHORIZING DESIGNATED CITY STAFF TO ACCEPT, EXECUTE AND ENDORSE ALL PROGRAM
SUPPLEMENTAL AGREEMENTS, FUND EXCHANGE AGREEMENTS, AND/OR FUND TRANSFER
AGREEMENTS TO THE MASTER AGREEMENT ADMINISTERING AGENCY -STATE AGREEMENT FOR STATE- FUNDED PROJECTS NO. 08-5430S21 BETWEEN THE CITY OF CATHEDRAL CITY AND THE STATE OF
CALIFORNIA, ACTING THROUGH THE DEPARTMENT OF TRANSPORTATION, FOR THE PURPOSE OF ADMINISTERING AND DISBURSEMENT OF STATE TRANSPORTATION FUNDS FOR PROJECTS.
WHEREAS, The City of Cathedral City entered into an Administering Agency-State Agreement for State- Funded Projects (Master Agreement) on May 5, 2010; and
WHEREAS, The California Department of Transportation has requested that the City execute a revised Master Agreement that incorporates numerous changes in regulations and policies that have been enacted since the original Master Agreement was signed; and WHEREAS, The City of Cathedral City is eligible to receive Federal and/or State funding for certain Transportation Projects, through the California Department of Transportation; and WHEREAS, Master Agreements, Program Supplemental Agreements, Fund Exchange Agreements and/or Fund Transfer Agreements need to be executed with the California Department of Transportation before such funds could be claimed; and
WHEREAS, the City wishes to delegate authorization to execute these agreements and any amendments thereto to the City Manager or the Director of Engineering/Public Works;
NOW, THEREFORE, BE IT RESOLVED, DETERMINED, AND ORDERED BY THE CITY COUNCIL FOR THE CITY OF CATHEDRAL CITY, AS FOLLOWS:
SECTION 1.
The City of Cathedral City approves the Revised Administering Agency-State Agreement for State-Funded Projects No. 5430S21 (Master Agreement) subject to and in accordance with the terms and conditions set forth therein.
SECTION 2.
Authorize the City Manager to sign Revised Administering Agency-State Agreement for State-Funded Projects No. 5430S21 (Master Agreement).
Authorize the City Manager or Director of Engineering/Public Works to accept, execute, and endorse all Program Supplement Agreements, Fund Exchange Agreements and/or Fund Transfer Agreements and any amendments thereto to the Administering Agency-State Agreement for State-Funded Projects No. 08-5430S21 between the City of Cathedral City and the State of California, acting through the Department of Transportation for the purpose of Administering and Disbursing of State Grant funds on projects.
SECTION 2. CERTIFICATION
That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which Resolution is passed and adopted.
EFFECTIVE DATE
This Resolution shall take effect upon its adoption.
