AMENDMENT NO. 1
TO THE
AGREEMENT FOR
PROFESSIONAL CONSTRUCTION MANAGEMENT SERVICES
BETWEEN
THE CITY OF CATHEDRAL CITY, CALIFORNIA
AND
T.Y. LIN INTERNATIONAL
In accordance with the “Agreement for Professional Construction Management Services” dated July 24, 2019 (the “Agreement”), by and between the City of Cathedral City, a municipal corporation (“City”) and T.Y. Lin International, a California Corporation (“Consultant”), and in accordance with Section 37 of the Agreement, entitled, “Amendment”, this Amendment Number One (1) to the Agreement is made and entered into this 9th day of March 2022.
RECITALS
A. Consultant currently provides the City with professional construction management services associated with the Cathedral Canyon Drive Bridge at Whitewater River Project (CIP 8919) pursuant to the Agreement dated July 24, 2019.
B. City desires to amend the Agreement to extend the Term of Agreement.
C. Consultant is qualified and agrees to provide the work pursuant to the terms of this Amendment No. 1 to the Agreement and City agrees to the amendments contained herein.
NOW, THEREFORE, for good and valuable consideration, the parties agree as follows:
Section 1.The Term of Agreement shall be extended for 2 years. The total term of the Agreement shall be for 4 years commencing on the effective date of the Agreement.
Section 2. Except as specifically amended by this Amendment No. 1, the remaining terms of the Agreement shall remain in full force and effect. In the event of a conflict between the provisions of this Amendment No. 1 and the provisions of the Agreement, the provisions of this Amendment No. 1 shall control.
SUMMARY:
Amendment No. 1 amends the Term of Agreement only. No additional scope of work or compensation is considered with the extended term.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement No. 1 to be executed as of the date first written above.
