BACKGROUND:
The Ophelia Bringas Memorial Bridge Project, also known as the Cathedral Canyon Drive Bridge over Whitewater River Project (for federal funding consistency), is nearing completion and will be replacing the former low water crossing with a new 4-lane bridge providing a roadway section in conformance with the City’s General Plan. The cross- section will provide for four (4) roadway lanes, complete with bike lane, sidewalk, CV Link Path and a center raised median.
The formal construction of the bridge began on June 15, 2020 and is approximately 85% complete. The construction is expected to be completed by May 2022.
On July 24, 2019, a previous City Council action approved a Professional Construction Management Services Agreement with T.Y. Lin International in an amount of $2,339,347 to provide construction management, inspection, construction survey, and material testing services for the Ofelia Bringas Memorial Bridge Project (Project), agreement attached. The City subsequently awarded a construction contract to Ames Construction, Inc. in the amount of $19,176,882 on March 25, 2020, for the construction of the Project.
DISCUSSION:
The July 24, 2019, Professional Construction Management Services Agreement with T.Y. Lin International set an initial term of two years for their services, which expired on July 24, 2021. The Construction Management team for the Project had not contemplated any changes to the agreement; therefore, Staff only recently identified the oversight of not formally extending this professional service agreement when it expired back in July of 2021.
T.Y. Lin International has been and continues to be essential in the construction management and completion of the Project and has performed satisfactorily up to this time. It is in the City’s best interest to extend the Agreement. In addition, a formal extension is advisable in consideration of the Federal funding involved in the Project and potential subsequent audits.
Staff is requesting that the term of the contract be extended, retroactively, for an additional two (2) years, with an expiration date of July 24, 2023. Even though the Project is scheduled to be completed this upcoming May 2022, the additional time allows for, and not limited to, all the formal Project closeouts, “As Built” compilation, potential claims resolutions and formal after Project reporting that will be required during the Agreement extension timeframe. There are no additional funds requested for this Amendment as the original scope and fees are unmodified.
Staff is requesting that the City Council approve the no cost Amendment No. 1 to the Professional Construction Management Services Agreement with T.Y. Lin International for the Ofelia Bringas Memorial Bridge Project (aka Cathedral Canyon Drive Bridge over Whitewater River Project), CIP No. 8919, extending the agreement term and authorizing the City Manager to execute the Amendment.
FISCAL IMPACT:
There is no fiscal impact associated with this action. The original scope and fee are unmodified with this Amendment No. 1.
