Staff Report

City Council

Item No. 9.D

Meeting Date: April 27, 2022
From: George Crum, Police Chief
Title: PACT Team Staffing

City Council

RECOMMENDATION:

Staff recommends City Council authorize two additional sworn full -time positions for the Police Department using funding allocated through the PACT Team Memorandum of Understanding (MOU).

BACKGROUND:

The implementation of AB 109 in 2011 , resulted in specified convicted felons and parolees, who were previously monitored and supervised by State Parole, to be supervised by the Riverside County Probation Department. On August 30, 2011, the Community Corrections Partnership Executive Committee (CCPEC) of Riverside County voted unanimously on the need for a county -wide law enforcement component to this supervision. Each participating law enforcement agency in Riverside County , formed the infrastructure for this critical enforcement component and created three Post-release Accountability and Compliance Team s (PACT). Currently three PACT teams exist in Riverside County with the East PACT team being housed at the Cathedral City Police Department. These three teams are a county -wide, multi - jurisdictional team comprised of members from each participating organization.

DISCUSSION:

The implementation of AB 109, The Public Safety Realignment Act of 2011, resulted in specified convicted felons and parolees, who were previously monitored by State Parole, to be supervised by the Riverside County Probation Department. On August 30, 2011, the Community Correct ions Partnership Executive Committee (CCPEC) of Riverside County voted unanimously on the need for a county -wide law enforcement component to this supervision. The Riverside County Sheriff’s Department, Riverside County District Attorney’s Office, Riversi de County Probation and the twelve municipal law enforcement agencies in Riverside County, including the Cathedral City Police Department, have built the infrastructure for this critical enforcement component. The Post-release Accountability and Complianc e Team (PACT) is a county -wide, multi - jurisdictional team comprised of members from each of these organizations.

Under the guidance of the Association of Riverside County Chiefs of Police and Sheriff (ARCCOPS), Riverside County formed three (3) separate “r egional” teams to address

the impacts of the “realignment” of the state’s corrections system through a partnership with the Riverside County Probation Department. The regional teams are identified as WEST-PACT, CENTRAL -PACT and EAST -PACT. Funding to reim burse the cost for participating agencies placing employees on a team comes from the CCPEC funds distributed by Probation.

The Coachella Valley is serviced by the EAST -PACT Team. The EAST -PACT team is comprised of the following agencies: Cathedral City PD, Desert Hot Springs PD, Indio PD, Palm Springs PD, Riverside County Sheriff’s Dept, Riverside County District Attorney’s Office, and Riverside County Probation.

The Cathedral City Police Department has been a member of the Post -release Accountability and Compliance Team (PACT) since its inception in 2011. The East PACT team is currently supervised by a Palm Springs Police Department sergeant who is being transferred out of East PACT in May. Historically, for most of the time East PACT has existed, the team has been supervised by a Cathedral City sergeant who works with Probation to focus on realignment offenders that pose the most risk to public safety. The MOU with Riverside County Probation allows for the reimbursement of supplies, equipment, a vehicle and salary up to a specified limit.

The EAST -PACT Team is housed and operated out of the Cathedral City Police Department, providing Cathedral City with a force -multiplier for our community and the Coachella Valley. Once the Palm Springs sergeant rotat es out of PACT in May, the team will be without a supervisor. As of May, the East PACT Team will consist of officers from Indio PD, Desert Hot Springs PD, Cathedral City PD, Riverside County Probation and Riverside County Sheriff’s Department.

The East PA CT team has proven to be a vital resource for Cathedral City and surrounding jurisdictions. In 2020, East PACT conducted 626 searches of people on probation or parole and made 238 total arrests (188 felony and 50 misdemeanor). The PACT team seized 39 firea rms and recovered 5 stolen vehicles. In 2021, East PACT conducted 845 searches of people on probation or parole and made 185 total arrests (159 felony and 26 misdemeanors). The PACT team seized 14 firearms and recovered 5 stolen vehicles.

On March 31, 2022 , Chief Crum spoke at the ARCCOPS meeting regarding Palm Springs Police Department transferring their sergeant out of PACT and the East PACT team’s need for a supervisor. ARCCOPS unanimously approved funding for Cathedral City placing a sergeant back on th e team and keeping our current approved police officer position on the team allowing a funding source for both positions with approval from City Council. The approved positions on all PACT teams have been funded since 2011 and future funding will likely be available a minimum of three to five years in the future.

FISCAL IMPACT:

If both positions are approved, the sworn staffing for the police department will increase from 50 to 52 employees. The PACT MOU authorizes the reimbursement up to $270,000 for the sergeant and $216,500 for the officer, which would cover the direct costs of both positions, for a total annual reimbursement not to exceed $486,500.
