BACKGROUND:
Conditional Use Permit (CUP) No. CUP 20-020 and 20-021 for the development of cannabis businesses, at 68625 Perez Road, were approved by the Planning Commission in March and April of 2021.
The Conditions of Approval for these CUPs required the improvement of the Perez Road frontage with new sidewalk, modified driveways, access ramps, a streetlight, relocation of interfering utilities and landscaping, and the slurry sealing and restriping of parking lots.
DISCUSSION:
The developer, PCC Cathedral City, LLC (Mr. Edlin Kim) has done most of the building modifications and renovations necessary to open for business. In order to obtain a Temporary Certificate of Occupancy, the conditions of approval allowed the deferral of the Perez Road frontage improvements provided the developer guaranteed completion of those improvements by an Improvement Agreement, secured by sufficient bonds or other securities. The Perez Road frontage improvements include demolition of existing signs, curb and gutter, sidewalks, trees, grass and driveways and the construction of new sidewalks, ADA compliant driveways, curb and gutter and related signage. All the improvements to be made are on Fiero’s Cost Estimate attached to this report.
Such an Agreement is to be executed by the developer, and cash on deposit will be posted to guarantee faithful performance of the work. The on-site and off-site improvements are to be completed within two (2) years of the date of City Council approval of this agreement.
A copy of the Improvement Agreement is attached for reference, along with a vicinity map showing the location of the project.
Environmental Summary:
The Planning Commission found that both CUP 20-020 and 20-021 were categorically exempt from the requirement for an Environmental Impact Report, under Section 15301, Class 1 (existing facilities) of the State CEQA Guidelines.
FISCAL IMPACT:
There is no fiscal impact with this Improvement Agreement.
