BACKGROUND:

The Zoppe Family Circus has requested to use two parcels of City owned land located east of W Buddy Rodgers Avenue, south of Grove Street and North of “B” Street (APN maps shown on attached Exhibit A). These lots are directly south of the lot that the Jurassic Wonders display is set up on. This Family Circus is proposing to use the land for 10 days during the month of December from December 2 through 12, 2022.

The Zoppe Family Circus welcomes guests into an intimate, 500 seat venue for a one- ring circus that honors the history of their old-world Italian circus tradition (shown on attached Site Plan). Starring Nino, the clown, the circus is propelled by a central story that features acrobatic feats, equestrian showmanship, canine capers, clowning and plenty of audience participation.

DISCUSSION:

City Departments have met to discuss potential risks involved in this type of activity. The Engineering Department has determined that the tent structure must meet wind load factors of 130 m.p.h. and must be signed off by a licensed engineer (Veneto Blueprints attached). Public Works and Engineering Departments have made additional conditions for approval including having the event organizer clear the vacant land of debris where cars will maneuver and/or park, provide lighting in areas where people will walk, securing the perimeter of the event space with barriers and private security, watering down the parking areas when needed to maintain dust control.

The Zoppe Family Circus must also do the following:
•City Business licenses will need to be secured and in place for the Circus and all subcontractors providing additional services.
•Keep music levels below 89 decibels from escaping its perimeter and must cut all elevated music and/or sound by 10 pm.
•Secure all permits from appropriate agencies including Cathedral City Fire Department (Veneto Flame Certification attached) and Riverside County Health Department.
•Provide enough security to properly patrol the area and maintain traffic control to prevent a back-up on East Palm Canyon Drive, W Buddy Rodgers Avenue and the local streets within the area.
•The License Agreement for the use of the properties and appropriate insurance binders will need to be filled out and executed prior to the set-up date of the event.

The event organizer may not begin setting up the tent structure until November 30, 2022 and must have the property cleaned and moved out by the close of business on December 14, 2022.

FISCAL IMPACT:

The promoter is required to pay for all City expenses including the Special Use Permit Fee, fire inspection fees and any services provided by the Cathedral City Police Department. The promoter is responsible to pay for all other costs including but not limited to rental fees, permits, land improvements, clean-up, security, trash removal, proper lighting and proper insurance to cover city exposure at no less than $1 million in general liability coverage.
