BACKGROUND:

A series of discussions with the Cannabis Task Force and the City Council over the past year have resulted in a comprehensive review of the ordinances regulating cannabis business in Cathedral City. The resulting ordinance amendments also provided the opportunity to remove fine provisions from the code and instead adopt them through a resolution as has been recent practice in all code updates.

DISCUSSION:

This resolution is a companion measure amending Chapter 5.88 of the Municipal Code.

The ordinance removes the specific fine amounts from the Code. This resolution will adopt the same fines as currently exist in the Code so that the fines will still be effective once the amended ordinance takes effect.

ESTABLISHMENT OF CIVIL FINES
Pursuant to Section 5.88.120 of the Cathedral City Municipal Code, any person convicted of an infraction or misdemeanor violation shall, for each separate violation of this chapter, be subject to the following civil fines in addition to any infraction or misdemeanor penalties:

A. A fine in an amount not to exceed two hundred fifty dollars for a first conviction of an offense;
B. A fine in an amount not to exceed five hundred dollars for a second conviction of the same offense within a twelve-month period of the date of the first offense; C. A fine in an amount not to exceed seven hundred fifty dollars for a third conviction of the same offense within a twelve-month period of the date of the first offense; and
D. A fine of one thousand dollars for the fourth and subsequent convictions of the same offense within a twelve-month period of the date of the first offense.

FISCAL IMPACT:

None. The adopted fines are identical to the amounts currently in effect.
