BACKGROUND:

The Political Reform Act of 1974 (Government Code Section 8100, et. seq.) requires state and local government agencies to adopt a Conflict-of-interest Code. The Code must be reviewed and renewed by the City Council in even-numbered years.

Designated City officials and employees are required to complete a Statement of Economic Interest Form 700 when assuming office, leaving office, and on an annual basis while holding office. Positions that are included are those making or participation in making governmental decisions which may have material effect on any financial interest. The original Form 700 for these filers is filed in the City Clerk’s Office.

In addition, pursuant to Government Code Section 87200, the following positions shall also file a Statement of Economic Interest Form: Council Members, City Manager, Planning Commissioners, City Attorney and City Treasurer. These filers file their forms electronically with the Fair Political Practices Commission. These positions are not included in the proposed resolution.

DISCUSSION:

The City’s Conflict-of-interest Code was last updated in October 2020. The following changes are recommended and are reflected in Appendix “A” of the proposed Resolution:

Program Administrator
Senior Engineer
Added:

Assistant City Manager

Model Disclosure Categories have been used as provided by the Fair Political Practices Commission. A primary purpose of the code is to require disclosure of those types of investments, interests in real property, sources of income and business positions that designated positions may affect in their decision making. These disclosure categories are included in Appendix “B” of the attached Resolution.

FISCAL IMPACT:

There is no fiscal impact associated with Council taking action on this item.
