RECOMMENDATION:

To adopt a Resolution declaring th e results of the November 8, 2022, election as certified by the Riverside County Registrar of Voters and adopt a Resolution declaring the results of the Special Election for the City of Cathedral City Community Facilities District No. 2022 -1 (Cathedral cit y Park & Recreation Services) and directing further actions .

BACKGROUND:

A general municipal election was held on November 8, 2022, in the City of Cathedral City. The purpose of this election was to do the following:

Elect three (3) Council Seats by District (District 3, District 4 and District 5) each with a four-year term and to elect one City Treasurer at large for a four-year term.

The propositions of the levy of the special tax within the City of Cathedral City Community Facilities District No. 2022-1 (Cathedral City Park & Recreation Services) (the “CFD”), the establishment of the appropriations limit for the CFD and the incurring of the bonded indebtedness for the CFD were submitted to the qualified electors of the CFD on November 8, 2022, as “Measure K”.

DISCUSSION:

The Elections Code requires the City Council to adopt a Resolution reciting the fact of the election and declare the result no later than the next regularly scheduled meeting following the presentation of the canvass of the retu rns, or at a special meeting called for this purpose.

The following are the certified results of the November 8, 2022, Election declared by the Riverside County Registrar of Voters:

Attached for your consideration are the following:

• A Resolution satisfying the requirements to declare the results of the election and authorize the swearing-in of the elected officials.

• A Resolution approving the results of the Special Election “Measure K”, the Abandonment of Further Proceedings for the CFD and directing the City Clerk to certify the adoption of the Resolution and cause it to be filed in the Office of the Assessor-County Clerk-Recorder of the County of Riverside within 15 days of the date of adoption.

RESOLUTION NO. 2022-

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY,

CALIFORNIA, RECITING THE FACT OF THE REGULAR MUNICIPAL
ELECTION HELD IN SAID CITY ON NOVEMBER 8, 2022, DECLARING THE

RESULT THEREOF AND SUCH OTHER MATTERS AS PROVIDED BY LAW

WHEREAS, a Regular Election was held and conducted in the City of Cathedral City, California, on Tuesday, November 8, 2022; and

WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, re ceived and canvassed and the returns made and declared in time, form and manner as required b y the provisions of the Elections Code of the State of California for the holding of election s in general law cities; and

WHEREAS, pursuant to Resolution 20 22-30, adopted June 22, 20 22, the Riverside County Registrar of Voters canvassed the returns of the election and has certified the results to this City Council, said results are received, attached and made a part hereof as “Exhibit A.”

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY,

CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:

SECTION 1. Per Election Code 10264, The City Clerk shall enter on the records of the City Council of the City, a statement of the result of the election showing: (1) The whole number of ballots cast in the City; (2) The names of the persons voted for; (3) the measure voted for; (4) For what office each person was voted for; (5) The number of votes given at each precinct to each person, and for and against the measure; (6) The total number of votes given to each person, and for and against each measure.

SECTION 2. That said Regular Election was held for the purpose of electing the following officials of said City:

Three (3) Members of the City Council Elected by District (District 3, District 4 and District 5) and a City Treasurer elected at large, each for a full term of four (4) years

The names of the persons voted for at said election are as follows:

SECTION 3. That said Regular Election was also held for the purpose of a Special Election for the City of Cathedral City Community Facilities District No.202 2-1 (Cathedral City Park & Recreation Services) - The propositions of the levy of the special tax within the CFD, the establishment of the appropriations limit for the CFD and the incurring of the bonded indebtedness for the CFD, subject to 2/3 affirmative city-wide voter approval “Measure K”.

SECTION 4. That the whole number of ballots cast in the precincts in Cathedral City for the District 3 seat was 2,452, that the whole number of ballots cast in the precincts in Cathedral City for the District 4 seat was 2,366, that the whole number of ballots cast in the precincts in Cathedral City for District 5 seat was 2,904, that the whole number of ballots cast in the precincts in Cathedral City for City Treasurer (at large) was 13,370 and that the who number of ballots cast in the precincts for Measure K was 13,370 (Yes 6980/No 5808).

SECTION 5. That the number of votes given at each precinct and the number of votes given in the Ci ty to each of the persons named above for office for which s aid persons were candidates for, are listed in the attached Exhibit “A”.

SECTION 6. That the number of votes given at each precinct and the number of votes given in the City to Measure K, are listed in the attached Exhibit “A”.

SECTION 7. The City Council declares and determines the following:

(a) That the voters have elected Mark Carnevale Councilmember of District 3 of said City for the full term of four (4) years;

(b) That the voters have elected Ernesto Gutierrez as Councilmember of District 4 of said City for the full term of four (4) years;

(c) That the voters have elected Raymond Gregory as Councilmember of District 5 of said City for the full term of four (4) years;

(d) That the voters have elected Greg Jackson as City Treasurer of said City for the full term of four (4) years;

(e) That there was not a 2/3 affirmative voter approval for Measure K;

SECTION 7. Per Election Code 10265, the City Clerk shall immediately make and deliver to each of the person so elected a Certificate of election signed by the City Clerk and authenticated; that the City Clerk shall also administer to each person elected the Oath of Office prescribed in the Constitution of the State of California and shall have them subscribe to it and file it on the office of the City Clerk. Each and all of the persons so elected shall then be inducted into the respective office to which they were elected.

SECTION 8. That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions of said City; and shall make a minute of passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is passed and adopted.

RESOLUTION DECLARING RESULTS OF SPECIAL ELECTION FOR

THE CITY OF CATHEDRAL CITY COMMUNITY FACILITIES DISTRICT NO. 2022-1 (CATHEDRAL CITY PARK & RECREATION SERVICES )

AND DIRECTING FURTHER ACTIONS

WHEREAS, pursuant to the Mello-Roos Community Facilities Act of 1982, Chapter

2.5 of Part 1 of Division 2 of Title 5, commencing with Section 53311, of the California Government Code (the “Act”), the City Council (the “Council”) of the City of Cathedral City (the “City”) adopted a resolution entitled “Resolution to Form the City of Cathedral City Community Facilities District No. 2022-1 (Cathedral City Park & Recreation Services) and Levy a Special Tax within the CFD to Fund Public Services and Finance the Development of Certain Public Facilities” (the “Resolution of Formation”), ordering the formation of the City of Cathedral City Community Facilities District No. 2022-1 (Cathedral City Park & Recreation Services) (the “CFD”), authorizing the levy of a special tax on property within the CFD and preliminarily establishing an appropriations limit for the CFD, subject to 2/3 affirmative voter approval; and

WHEREAS, pursuant to the Act, the propositions of the levy o f the special tax within the CFD, the establishment of the appropriations limit for the CFD and the incurring of the bonded indebtedness for the CFD were submitted to the qualified electors of the CFD on November 8, 2022, as “Measure K”; and

WHEREAS, the results of the election have been certified to the City by the County.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY DOES HEREBY RESOLVE AS FOLLOWS:

1. Results of Election. The results of the election on Measure K provided to the City by the County are on file with the City Clerk and are hereby approved. The election was not successful.

2. Abandonment of Further Proceedings for CFD. Given the unsuccessful election results, the CFD proceedings are hereby abandoned and terminated, and no further proceedings in connection with the CFD will be taken.

3. CFD Map; Further Recording . The boundaries of the CFD, are set forth in the map of the CFD have heretofore been recorded in the Office of the Assessor - County Clerk-Recorder of the County of Riverside on July 7, 2022 in Book 89 at Page 22 of Maps of Assessment and Community Facilities Districts. The Council directs the City Clerk to certify the adoption of this resolution and cause it to be filed in the Office of the Assessor-County Clerk-Recorder of the County of Riverside within 15 days of the date of adoption of this resolution, which certification shall include a reference to the date of the this resolution of abandonment, the date of the original resolution of intention , and the
