Attachment: Angel Herrera- PACE Application (3630 : Ratify Nomination and Appoint Antonio Baciu and Angel Herrera to PACE) Cathedral City Officials ,
My name is Angel Herrera , I have been a resident of Cathedral City for 1 year and 6 months. I would like to apply and be considered to serve on the Public and Community Events Commission for Cathedral City. I believe my experience in the public sector working for the City of Riverside and the Coachella Valley Water District, has provided me with insight on how to track the progress of large projects and an understanding on project constraints .
As a young child I was taught the importance of giving back to your community . As early as 12 years old I used to volunteer my time with various community outreaches . I am thankful for the support my community gave me as I was growing up and I try to "pay it forward " as often as I can. I grew up in an era where the parks and play areas in my community were vital to my up bringing. As an adult and a parent, I value the parks that allowed my children to play sports such as basketball , kick ball, and soccer.
I have been working in the public sector for over seven years as an Electrical Maintenance Scheduler and an Electrical Supervisor . I understand the process for seeing projects through to fruition . Over the past seven years I have been the Project Manager for projects that exceed 2 million dollars and span over 12 months. I have experience with identifying a need and conceptualizing a solution . I have worked alongside design and engineering firms , contractor companies , and public utilities such as SEC and 11D. I have an understand of supply chain issues, zoning requirements , environmental impact reports, and operating within a budget.
Thank you for your consideration in this position. It would be an honor to serve on the Public and Community Events Commission for Cathedral City.

RE: Application for Commissioner Parks and Community Events Please accept the enclosed application for Commissioner Parks and Community Events.
I have lived in Cathedral City for the last 15-years and truly love living here! I have volunteered for many community events that help make our city great.
About two years ago, I had an idea that the new city Amphitheater would be an ideal spot to host a community yoga class, like they do at Sunnylands. I made a formal proposal to the Parks and Community Events commission and it was accepted and budgeted, not only last year but this year. I tirelessly marketed the Yoga at the Amphitheater program last year to great success. This year we have added an additional Gentle Yoga class with the hope for even greater success, all for the residents of the Cathedral City community. I have greatly appreciated the unanimous support of all of the current City Council members for the Yoga at the Amphitheater program. I have tried to become the face of the Yoga program, not only by tirelessly marketing the program but also by selecting the top yoga teachers in the valley to conduct the classes. I show up for every class to make sure the all of the logistics are working properly and to meet and greet every class participant, hand out yoga mats and blocks and troubleshoot any glitches.
Additionally , I am very proud of the many community events that are produced annually by Cathedral City and have happily volunteered my time to help to make each of these events successful and fun for the community . You may have seen me as the Easter Bunny at the easter event. I have also volunteered for the Balloon Fest, Jalisco, Christmas, LGBT Days and many others . Those in charge know that they can rely on me for both support and enthusiasm.
In closing, if appointed Commissioner of Parks and Community Events, I promise that I will take this job very seriously. I know that I can continue to make a difference in our community and to help make Cathedral City a great place to live!
Sincerely,
~ ~

Title: Accept a gift in the amount of $50,000 from Grizzly Entertainment for a drone light show from Grizzly
Entertainment fo r a drone light show at Cathedral City LGBT Days.
RECOMMENDATION:
To accept a gift in the amount of $50,000 from Grizzly Entertainment for a drone light show at Cathedral City LGBT Days.
BACKGROUND:
In spring 2022, Communications & Events was contact ed by Grizzly Entertainment to offer a drone show in exchange for the city receiving the show as a gift valued at $50,000. The 200-drone unit light show took place at the Cathedral City Hot Air Balloon Festival on Friday, Nov. 18, 2022. They have offered t he same for Cathedral City LGBT Days on Friday, March 3, 2023. The purpose of the donation would be for the benefit of the public’s entertainment and to enhance the quality of programming for one of the City’s signature events.
DISCUSSION:
As California’s first Pride event of the year, the 7th annual Cathedral City LGBT Days brings together numerous LGBTQ + celebrities, artists, media, community leaders, Coachella Valley residents, and visitors for an unforgettable weekend of live entertainment, community engagement, and fun activities from March 3 – 5, 2023.
The drone show would be located above the 13.5 acres across from the Agua Caliente Casino in Cathedral City. This is the location where the city has shot off fireworks in the past for previous events. We will need to use either citizens on patrol or police officers from getting into the area during rehearsal (March 1 -2), as well as the actual show on Friday, March 3, 2023. The drones have minimal noise, especially in comparison to fireworks, and Grizzl y Entertainment will list the city and SoundSkilz, our third -party contractor, as an additional insured entities for coverage during the show.
The show lasts 10 minutes and has been a popular addition at many events around the

Meeting Date: February 22, 2023
From: Robert Rodriguez, Director of Planning/Building
Title: Resolution Establishing Historic Preservation Ordinance Application Fees
City Council
RECOMMENDATION:
To approve a resolution establishing the Historic Preservation Ordinance application fees.
BACKGROUND:
The Historic Preservation Ordinance, Chapter 8.62 of the Cathedral City Municipal Code, was approved by the City Council on November 30, 2022 . The Ordinance establishes three application processes; 1) to obtain historic designation, 2) certificate of appropriateness, and 3) removal or downgrading of historic designation.
The Planning Department , who will administer the application and review process and serve as the staff liaison to the Historic Preservation Committee and the City Council in the review of these applications , conducted an analysis of the costs associated with processing each application (see Discussion section) and the analysis was presented to the City Council during a study session on January 25, 2023.
The City Council directed staff to prepare a resolution establishing the application fees as follows:
• Obtain historic designation = $100
• Certificate of appropriateness = $1,691.50
• Removal of downgrading of historic designation = $2,619.00
In addition, the City Council requested that a hardship waiver provision be established for the certificate of appropriateness application, which is included in the resolution.
DISCUSSION:
The Planning Depa rtment completed an analysis of the costs incurred by each application type (see attachment) , excluding additional costs that may be incurred for
6.B
Packet Pg. 78
Cathedral City Page 2 of 3 Printed on 2/16/2023
City provided surveys, studies, or investigations:
• Obtain historic designation = $3,096.50
• Certificate of appropriateness = $1,691.50
• Removal of downgrading of historic designation = $2,619.00
The policy of the City Council is that in normal circumstances fees should be charged to recover the fully burdened costs incurred by the City in providing services to app licants.
However, where there is determined to be a substantial public benefit, the City Council may consider not recovering the costs.
Staff also researched the processes laid out in the ordinances in neighboring cities and the fees charged by cities wit h comparable processes . The fee for historic designatio n is:
• Palm Springs = no fee
• Rancho Mirage = $500
• Palm Desert = no fee
• Redlands = no fee
The cities analyzed did not have a process or fee for removal or downgrading of the historic designation after approval and only the cities of Palm Springs and Redlands charged for the certificate of appropriateness:
• Palm Desert – Minor alteration = $561, Major alteration = $1,956, Demolition = $2,952
• Redlands – Minor alteration = $356, Major alteration = $615
The application and fee analysis were presented to the Historic Preservation Committee on January 17, 2023. After deliberation, the Committee approved a recommendation to the City Council that no fee be charged to obtain the historic designation and the fees for the certificate of appropriateness and removal or downgrading of historic designation be adopted as presented . The Committee also recommended a fee be charged for the issuance of the markers for approved sites that would help offset staff costs associated with obtaining the historic designation.
FISCAL IMPACT:
The potential fiscal impact for an application to obtain historic designation is $2,996.50 per application , $1,691.50 for each applicant granted a hardship waiver for the certificate of approp riateness, and any additional costs that may be incurred for conducting application -specific surveys, studies, or investigations . However, the reduced fee and granting of the hardship waiver would likely encourage applicants to seek the historic designation.

Item No. 6.C
Meeting Date: February 22, 2023
From: Kevin Biersack, Deputy Finance Director
Title: Approve a General Fund budget amendment in the amount of $172,000 for FY 2022/2023 to complete the approved contract with MAAS Companies for the completion of Phase I of the Facilities Services & Master Plan.
City Council
RECOMMENDATION:
To approve a General Fund budget amendment in the amount of $172,000 for FY 2022/2023 to complete the previously approved contract with M AAS Companies to complete Phase I of the Facilities Services & Master Plan.
BACKGROUND:
On January 22, 2022, the City Council held a Planning and Goal Setting Workshop to establish the City’s 2022 priorities. On February 16, 2022, the City Council adopt ed Resolution 2022-09, to memorialize the priorities discussed in the goal setting session.
As described in the resolution, many of the goals identified by the City Council can be achieved with existing resources, however, in those cases where additional r esources are required, staff present s City Council with options via the budget amendment process. As it relates to the Facilities Department, the priority was to develop and adopt a Facilities Master Plan.
On October 12, 2022, the City Council approved a contract with MAAS Companies to complete Phase I of the Facilities Master Plan.
DISCUSSION:
Not only identified as part of the goal setting but an element to the city’s 5 -year strategic plan, to move forward with the development of a Facilities Master Plan, several steps need to be accomplished:
• Facilities Condition Assessment (FCA) – Inspect all facilities and building systems to establish a complete inventory and condition assessment to determine deficiencies, replacement costs and risk of failure.
6.C
Packet Pg. 88
Cathedral City Page 2 of 4 Printed on 2/16/2023
• Based on the FCA , develop a comprehensive Deferred Maintenance program to identify asset replacements and system renewals and associated costs. • Facilities Management Plan to develop strategies for maintaining facilities through preventative maintenance, im plementing deferred maintenance projects to eliminate the risk of failure, and establishing benchmarks for performance improvement.
Due to a variety of factors related to available resources associated with COVID 19, the original completion schedule of Pha se I was 14 -16 months thus it was anticipated only $75,000 would be needed for FY 2022/2023 and the remaining amount of $172,000 would occur in FY 2023/2024. The good news is the completion schedule has moved along with better than expected progress and we are now scheduled to complete Phase I by the end of this Fiscal Year . Subsequently, we anticipate presenting a report to City Council in the first quarter of FY 2023/2024.
Upon the completion of Phase I and the presentation to City Council, we will subsequently present for consideration the plans for Phase II of the project.
At the October 12, 2022, Council meeting, we outlined two phases of the project:
Phase I
Develop a comprehensive overview for all City -owned buildings and systems. Plan will include preventative maintenance; asset management; long -term life cycle planning; capital improvements; and estimated associated costs.
Initially, complete the FCA – Inspect all facilities and building systems to establish a complete inventory and conditi on assessment to determine deficiencies, replacement costs and risk of failure.
MAAS will use the data provided from the FCA to develop a comprehensive plan to include:
• Preventative Maintenance (PM)
o Identify current practices and schedule of PM activities o Evaluate current practices and identify gaps or additional work required o Create annual schedules for performing PM work to prevent unexpected equipment failure
o Identify current staff or vendors to perform PM work
• Deferred Maintenance : Based on the FCA develop a comprehensive Deferred Maintenance program to identify asset replacements and system renewals and the associated costs.
• Current Management Practices Assessment : Document detailed data for each City-owned facility and current best practices.
PHASE II
6.C
Packet Pg. 89
Cathedral City Page 3 of 4 Printed on 2/16/2023
Present to Council for consideration after Phase I completion with plans for MAAS to complete their work on a time and material basis.
Policies and Procedures
Coordinate with City Administration to develop policies and procedures for City -owned facilities. Proposed policies may include:
• Facilities Space Modification Requests – Develop a comprehensive process for submitting requests, project feasibility, cost estimates for improvements, code compliance, architectural review, and approval process. • Facilities Policy on Performing Work – Develop a policy to clearly define the requirements for performing work on city -owned facilities to ensure work is done by experienced or licensed professionals to perform work. Also, ensure work is contracted in accordance with City policies, State of California requirements and registered with the Department of Industrial Relations. • Facilities Services Responsibilities – Develop a policy statement to clearly define the role of Facilities to educate end users. Policy to include typical work performed, work order submissions, replacement cycle for interiors, etc.
Automation Projects
MAAS will develop an RFP to include a scope of work and qualifications for potential vendors for automation projects. Qualified vendors will be screened and provided to the City for their consideration and final approval. MAAS will coordinate with the successful vendor for installation, testing and training for new systems. As requested, this work will be performed on a time and material basis.
• Systems automation to be evaluated for cooling towers, generators, Fountain of Life, and other facilities systems as identified by the City. • Facilities Work Order System to assist with work order management, processing, and data archiving.
Managing Project Bidding and Award Process
Manage the bidding and awarding process to include advertising projects , conducting pre-bid conference, job walks and bid openings , and award contracts to successful bidder.

Item No. 6.D
Meeting Date: February 22, 2023
From: Stone James, Economic Development Director
Title: Cannabis Industry Analysis and Taxation Modification
City Council
RECOMMENDATION:
To adopt a resolution reducing the cannabis dispensary tax rate to 5% of gross proceeds, the cultivation rate to $10.00 per square foot, and the manufacturing per piece tax rate to $0.05 cents.
BACKGROUND:
This agenda item is the result of collaborative discussions between Cathedral City cannabis business owners, Cathedral City’s Cannabis Taskforce, and the City Council dating back to September 8, 2021. A total of ten meetings took place surrounding the issue of taxes on September 8, 2021, November 29, 2021, January 19, 2022, April 11, 2022, April 20, 2022, May 11, 2022, June 8, 2022, August 10, 2022, September 14, 2022, and November 30, 2022.
During the January 25, 2023, City Council study session, staff presented an analysis based on the culmination of these meetings, a police and fir e calls-for-service analysis, and the results from a mixed -methods analysis of Cathedral City cannabis businesses.
As a result of the meetings, feedback, and research over this 17 -month span, the Council directed Staff to (i) bring forward a resolution ame nding current tax rates to reflect a dispensary tax rate of 5%, cultivation tax rate of $10.00 per square foot, and a manufacturing per-piece tax rate of $0.05 cents per piece, and (ii) ensure the City has the ability to reduce the number of outstanding and unused licenses.
DISCUSSION:
Since the January 25, 2023, Cathedral City study session, the City of Palm Desert Economic Development subcommittee concluded their own research. During the February 16, 2023, Palm Desert City Council meeting, the subcommit tee plans on recommending the adoption of a 5% dispensary tax rate and a $10.00 per square foot cultivation tax rate. This new rate has been updated in the below table.

Staff reviewed cannabis taxes in the cities of Palm Springs, Palm Desert, Desert Hot Springs, and Coachella. Currently, La Quinta, Indian Wells and Rancho Mirage do not allow cannabis businesses. On July 20, 2022, the city of Indio authorized the opening of no more than five dispensaries within city limits. A dispensary tax rate has not been determined however, given other Valley cities’ 10% retail tax rate and City of Coachella’s 6% retail tax rate, the Indio City Council is discussing a retail fee approximating a tax rate of 5% or 6%. Dispensaries are the only type of cannabis business the Indio City Council has authorized.

Note:
*: Given current wholesale price of approximately $1.50 per item on pre-rolls, the .40 cent per item tax represents an effective tax rate of 27%.
**: On February 16, 2023, the Palm Desert Economic Development subcommittee will recommend to the Palm Desert City Council that they reduce the dispensary and cultivation taxes to 5% and $10.00 per square foot, respectively.
***: For cannabis products produced within Cathedral City, there is zero tax on distribution.
As it relates to the City’s ability to reduce the number of outstanding but unused licenses, CCMC Section 5.8.055.D. currently states,
“The local licensing authority shall renew a local license if the licensee has submitted a complete application and pa id the application processing fee, unless the local licensing authority finds that good cause exists to deny the license renewal. Notwithstanding the foregoing, the local licensing authority in its

discretion may elect not to renew any local license if it determines that the licensed premises has not been used for a cannabis business, without reasonable cause as determined by the local licensing authority, for a period of at least one year.”
Staff believes this current provision addresses Council’s interes t in having the ability to reduce the number of renewed -but-unused licenses. City staff will be more proactive in addressing non-active licenses as they come up for renewal.
Recommendations:
Reduce the:
1) Dispensary or retail tax rate to 5% of gross proceeds; 2) Cultivation tax rate to $10 per square foot; and
3) Manufacturing-per-piece tax rate to $0.05 cents.
Additionally, the proposed resolution requires that businesses must be current on taxes due to the City to take advantage of the reduced rates.
FISCAL IMPACT:
In calendar year 2021, total cannabis taxes paid to Cathedral City were $4,971,001. In calendar year 2022, total cannabis taxes paid to Cathedral City were $3,693,000 (est.).
Based on 2022 collections, each 1% reduction in the retail t ax should result in a revenue loss of $125,000/year.
A reduction in the cultivation tax rate to from $15 to $10/square foot would result in a revenue loss of $710,000. The reduction assumes current cultivation activity remains constant and no Cathedral C ity businesses leave Cathedral City and relocate to lower - tax jurisdictions. Alternatively, a lowering of the tax rate may attract new businesses into Cathedral City and therefore increase total potential tax revenue.
A reduction in the per gram or per it em manufacturing tax would have a negligible cost impact as there are very few manufacturers left in the City. If manufacturers returned to Cathedral City to resume manufacturing operations, a reduction in manufacturing taxes could then result in additional tax revenue.
