Staff Report
City Council
Item No. 3.E
Meeting Date: March 22, 2023
From: John Corella, Director of Engineering/Public Works Title: Notice of Completion for Via De Anza Street Improvements, Phase I (CIP 8834)
City Council
RECOMMENDATION:

To accept and approve the Via De Anza Street Improvements, Phase I Project (CIP 8834) as complete; and authorize the City Manager to execute and file a Notice of Completion with the Riverside County Recorder's office; and authorize the release of retention funds to Granite Construction, Inc. upon expiration of the Notice of Completion.

BACKGROUND:

On June 8, 2022, City Council awarded a construction contract to Granite Construction, Inc. in the amount of $470,073.20 with a 18% contingency of $84,613.18, thereby making the total construction budget $554,686.38, to complete the construction of the Via De Anza Street Improvements, Phase I Project (CIP 8834).

The Project consists of the construction of street improvements including sidewalk, curb, gutter, curb ramps, driveway aprons, and placing new asphalt on the west half of the Via De Anza Street between Dinah Shore Drive and Olancha Road, with infill portions on both Olancha Road and Via Altamira Street. In addition, the Project included the removal and reconstruction of private improvements encroaching into the City right of way (e.g., garden walls, mailboxes, steel fencing and driveway improvements).

DISCUSSION:

Construction started on July 18, 2022, and was completed on February 21, 2023.

City Staff reviewed and inspected the improvements and found the Project was built in accordance with all contract requirements, and therefore recommends City Council’s acceptance of the Project as substantially complete.

City Council acceptance is required to approve the Project’s final contract amount and release retention funds. Retention funds are monies earned by the Contractor withheld

from progress payments pending satisfactory completion and final acceptance of the Project. The Project was built according to the contract terms.

City Council acceptance of the Project requires that a Notice of Completion (NOC) be filed with the Riverside County Recorder’s office. The NOC is a written notice issued by the owner of a project, or their agent, to notify concerned parties that all work on the project has been completed. This notice also sets the period, which is 30 days from the date the NOC is filed, within which, concerned parties may exercise their lien rights against one another. Once the thirty-day period has expired, and provided no claims or liens are received, the City can release retention funds.

Staff recommends City Council accept and approve the Via De Anza Street Improvements, Phase I Project (CIP 8834) as complete; and authorize the City Manager to execute and file a Notice of Completion with the Riverside County Recorder's office on behalf of the City Council; authorize the release of retention funds to Granite Construction, Inc. upon expiration of the Notice of Completion.
