Title: Update from the Cannabis Task Force
City Council
RECOMMENDATION:
This item is presented for information, discussion and direction only.
BACKGROUND:
Chapter 2.32 of the Cathedral City Municipal Code establishes the Cannabis Task Force. In accordance with the code, the task force consists of the City Manager, three resident members and three members who are owners or managers of canna bis businesses. The task force is appointed by the City Manager. Meetings are conducted in accordance with the Brown Act – Open Meeting Law and are open to the public. The task force normally meets two times per year.
The purpose of the task force is t o provide advice to the City Council on issues related to the operation of cannabis businesses in Cathedral City. The task force most recently met on Monday April 3, 2023.
DISCUSSION:
The task force agenda for April 3 included three items:
1. Update on Co uncil Actions – Staff provided an update on the council discussions since the last task force meeting in October 2022 and on the resolution ultimately adopted which modified the tax rates on cannabis businesses. The effective dates of the new tax rates we re reviewed along with the requirement for businesses to take advantage of the reduced tax rates they must be current on taxes due to the City. There were no recommendations resulting from this discussion.
2. Expiration of Inactive Retail Licenses – Staff r eported that during the discussions on cannabis taxes in January and February of this year, City Council expressed some interest in measures that would have the effect of reducing the number of retail licenses over time by limiting the renewal of inactive licenses. It

was further reported the municipal code currently includes a provision that licenses that have been inactive for a period of at least one year may not be renewed (discretionary) and the City Attorney’s concern that non-discretionary language would be advisable if the desire is stop renewing inactive licenses.
After discussion, it was the consensus of the task force that licenses inactive for over a year should not be renewed and that non -discretionary language should be adopted. They also in dicated that prior to implementing the non -renewal practice existing inactive license holders should be surveyed regarding their intent and there should be a well -advertised start date in the future so existing inactive license holders aren’t caught off-guard by the change.
3. Fire Code Regulations and Carbon Dioxide Storage – Chief Contreras attended the meeting and updated the task force on an issue the fire department is having with some businesses, primarily cultivators, violating the fire code regarding their storage of carbon dioxide. After an in -depth discussion, it was the consensus of the task force that the code provisions should be uniformly enforced even to the point of making non-compliant businesses cease operations until the violations are corre cted. In order to comply, o wners of compliant businesses noted they had to make costly upgrades and it is not fair to allow others to ignore the code requirements. All agreed there is a safety issue involved and the code must be uniformly applied.
A pub lic comment period was provided but no comments were received, and the meeting was adjourned.
FISCAL IMPACT:
None

Title: Annual Rate Increase Request for Solid Waste and Recycling Collection for Residential, Commercial and Roll Off Services.
City Council
RECOMMENDATION:
The annual rate increase request for the solid waste and recycling collection for residential, commercial and roll-off services is presented to the City Council for discussion, comments and direction in anticipation of being presented for Public Hearing and City Council approval at the June 28, 2023, City Council Meeting.
BACKGROUND:
In March 2023, Burrtec Waste and Recycling LLC. (Burrtec) requested an annual rate increase for residential, commercial, and roll-off services, in accordance with Article 6 of the Municipal Franchise Agreement (FA). Pursuant to the FA, Burrtec is eligible to request a rate increase each year based on applicable increases in the Consumer Price Index (CPI) for the Riverside-San Bernardino-Ontario Area. The change in the CPI from January 2022 to January 2023 was 4.97%.
The Riverside County disposal fee at the Edom Hill Transfer Station will also increase from $55.75 to $59.70 per ton , effective July 1, 2023, in accordanc e with The Edom Hill Master Lease Agreement between Riverside County and Burrtec.
Burrtec is requesting a rate increase incorporating the following elements:
• The CPI increase in accordance with the Franchise Agreement.
• The County of Riverside’s dec ision to increase the cost per ton of disposal at County landfills.
• The annual net recycling adjustment is adjusted based on several components associated with recycling, such as processing, transportation, and recycling commodity prices.

DISCUSSION:
The following identifies how the commercial, residential, roll -off and multifamily customers would be impacted.
RESIDENTIAL CUSTOMER:
The current residential rate for calendar year, January – December 2023, is $25.69 a month for the weekly curbside service of 1 -96-gallon Trash, Recycle and Greenwaste containers. The $25.69 rate consists of a blended rate where half the year (2023) is without the SB 1383 cart colors and the other half is with the SB 1383 cart colors.
If approved, the residential tax roll rate for calendar year, January – December 2024, would see an increase of $2.62 per month or $31.44 annually. The 2024 monthly rate would be $28.31. The rate increase would be effective for the assessment on the 2023/2024 tax rolls.
Residential Rate Comparison with other jurisdictions with similar programs . These rates reflect current rates, not the proposed rates that will be effective July 1, 2023.
City of Coachella $31.44
City of Indio $26.13
Riverside County $27.32
City of Palm Springs $25.93
COMMERCIAL CUSTOMERS:
The total monthly commercial fee is composed of several elements with varying increases depending on the size of containers and the level of service. A three-yard container serviced once a week is the average ser vice level for most Cathedral City commercial customers.
If approved, the commercial rate increase for a 3 -yard container serviced 1x per week (most common service bin option) would be $10.88 per month effective July 1, 2024.
Commercial customers receive direct bills from Burrtec for the services provided.
