Staff Report
City Council
Item No. 3.G
Meeting Date: June 14, 2023
From: John Corella, Director of Engineering/Public Works Title: Tract No. 38137: Approval of Final Map and Subdivision Agreement: Reflections at Cimarron, LLC: (James Shute):
Subdivider
City Council
RECOMMENDATION:
To approve the Final Map for Tract No. 38137; and, accept the dedications offered on the Final Map for public street and public utility easement purposes; and approve the Subdivision Agreement for Tract No. 36137 and authorize its execution by the Mayor and City Clerk.
BACKGROUND:
Tentative Tract No. 38137 was approved by the City Planning Commission on December 15, 2021, for a thirteen (13) lot single family dwelling subdivision on vacant land on the north side of McCallum Way, west of Landau Boulevard. A copy of the Tract Map 38137 is attached for location reference.
This vacant land has been entitled prior with an earlier Tentative Tract No. 36832 approved on the same property in 2014. This entitlement resulted in only the first phase of the map, Tract No. 36832-1, being recorded in 2015 consisting of four (4) lots created fronting Elizabeth Road. The balance of that tentative map expired without any development.
This new Tract No. 38137 will be served by a gated private street, Reflections Place.
Reflections Place will be maintained by a Homeowner’s Association (HOA).
Additionally, the entire development will drain into a retention basin, which will also be owned and maintained by the HOA.
DISCUSSION:
Staff has reviewed the proposed Covenants, Conditions and Restrictions (CC&Rs) for the HOA and is satisfied that this document adequately provides for the maintenance of the Tract’s infrastructure, roadway and its drainage facilities.

Reflections at Cimarron, LLC, (Subdivider), based in Irvine, California, has prepared a Final Map for the 13 residential lots, and has executed the attached Subdivision Agreement (Agreement), covering the obligations to complete the required public and private street, water and sewer improvements. The Subdivider has posted surety bonds guaranteeing faithful performance of the Agreement, in the amount of $324,000, and has posted a Cash Bond for placement of the required survey monuments and lot corners in the amount of $4,660.
In addition, the Subdivider has paid the required Quimby park fees per Chapter 9.106 of the Municipal Code, in the amount of $34,518.
This Tract has been annexed into the City Community Facilities District (CFD), and the individual lot buyers will be taxed annually for their proportionate share of the financial impact of the Tract for City services such as, Police, Fire, Paramedic, Park and General Maintenance.
All conditions of the Tentative Map have been met, and the Final Map meets the requirements of the State Subdivision Map Act and City codes.
ENVIRONMENTAL ANALYSIS:
When the Tentative Map was approved, the Planning Commission approved an Environmental Determination which justified a CEQA Class 32 (In-Fill Development) Categorical Exemption for this Project.
Staff therefore recommends that the City Council approve the Final Map for Tract No. 38137; and accept the dedications offered on the Final Map for public street and public utility easement purposes; and approve the Subdivision Agreement for Tract No. 36137 and authorize its execution by the Mayor and City Clerk.
FISCAL IMPACT:
Approval and recordation of the Final Map will allow construction of thirteen (13) new single-family residences. Ordinarily, the construction and occupancy of single-family units would cause minor additional fiscal constraints in the ability of the City of Cathedral City to meet expected demands for public services from the new residents within this development.
However, since the development has been annexed into the City-wide Community Facilities District (CFD) to offset the actual costs of services, such as, Police, Fire, Paramedic, Park and General Maintenance, it is expected the special tax generated by the CFD will assist in offsetting any financial impacts caused by these demands.
FIVE-YEAR STRATEGIC PLAN:
GOAL C: FISCAL STABILITY AND SUSTAINABILITY
Objective: Cathedral City has economically prospered by facilitating the investment of private dollars in high quality development which benefits the community. We remain financially solvent by instituting prudent fiscal policies and transparent financial practices.
