BACKGROUND:
Prior to SB-1, cities and counties across the state delayed and even cancelled road improvement projects due to lack of funding; neglecting basic maintenance and repairs to their local streets. The 2016 California Statewide Local Streets and Roads Needs Assessment found the condition of these local streets, on average, were “at risk” or degraded to failing infrastructure.
On April 28, 2017, Governor Brown signed SB-1, known as the Road Repair and Accountability Act of 2017, to address basic road maintenance, rehabilitation, and critical needs for both state highways and local streets and roads known as the Local Streets and Roads Program (LSRP). SB-1 generates funds through increased per gallon fuel excise taxes, diesel fuel sales taxes, vehicle registration fees and provides for inflationary adjustments on future tax rates.
Various portions of the funds generated are deposited into the Road Maintenance and Rehabilitation Account (RMRA) fund. A percentage of the RMRA funding is apportioned to Cathedral City by formula for road maintenance, rehabilitation, and critical safety projects.
The RMRA requires all RMRA-funded projects to be included in the City Capital Improvement Project (CIP) Plan. Initiating RMRA, on September 13, 2017, the City Council approved Resolution No. 2017-43 adding the proposed RMRA projects to the five-year CIP Plan.
At the City Council Study Session Meeting held on May 24, 2023, the remaining and newly proposed RMRA/SB-1 Projects were introduced to the City Council, who reviewed and discussed the Projects.
DISCUSSION:
In FY 2022-2023, the City used RMRA/SB-1 funding to initiate and/or complete the following projects from Resolution No. 2022-16:
Landau Boulevard and McCallum Way Intersection Traffic Signal Construction The scope of this Project is to reconstruct and improve the intersection at Landau Blvd. and McCallum Way adjacent to Mt. San Jacinto High School located at the northeast corner of this intersection. The Project design was completed in May 2023, and the award of construction contract is scheduled for the June 28, 2023, City Council Meeting.
This Project was listed as Project 1 in Resolution No. 2022-16.
Century Park Neighborhood Street Pavement Rehabilitation This Project included a combination of street reconstruction on specified streets and the application of Rubberized Emulsion Aggregate Slurry (REAS) on other streets within the internal street system of the Century Park area. This Project was successfully completed with the Notice of Completion dated October 27, 2022. This Project was listed as Project 2 in Resolution No. 2022-16.
La Pasada Neighborhood Street Pavement Rehabilitation
This Project included the application of REAS on all streets within the La Pasada Neighborhood area. This Project was successfully completed on May 24, 2023, with the acceptance of the Notice of Completion scheduled to be presented at tonight’s City Council Meeting. This Project was listed as Project 3 in Resolution No. 2022-16.
FY 2023-2024
City Staff is proposing the following projects to be funded with RMRA funds and to be completed in FY 2023-2024:
Landau Blvd. and McCallum Way Intersection Traffic Signal Construction (Project 1) In FY 2023-2024, the City proposes to complete the construction of Landau Boulevard and McCallum Way Intersection Traffic Signal Project. The scope of this Project is to reconstruct and improve the intersection at Landau Blvd. and McCallum Way adjacent to Mt. San Jacinto High School located at the northeast corner of this intersection.
The FY 2023-2024 CIP Budget shows an estimated cost for the construction of this Project in the amount of $715,000. The Bid Opening for this Project was held on June 1, 2023, with an apparent lowest bid in the amount of $1,038,888.50. This represents a
45.3% increase above the current CIP Budget.
The budget required for the construction of this Project will include the bid amount and a 15% contingency for a total amount of $1,194,721.78 as shown below.
DBX (Contractor with lowest bid) $ 1,038,888.50
15% Contingency $ 155,833.28
Construction Total $ 1,194,721.78
In order to fund Project 1, Staff is proposing to use savings from the FY2022-2023 RMRA/SB1 Funded La Pasada Neighborhood REAS Project, which was recently completed, in the amount of $230,000. These funds would be allocated towards the Landau Boulevard and McCallum Way Intersection Traffic Signal Construction Project 1 to reduce the difference between the FY 2023-2024 CIP Budget and the lowest bid.
City Staff proposes to complete this Project within FY 2023-2024 with RMRA/SB-1 funds in the amount of $1,200,000 and the RMRA/SB-1 Resolution will change/reflect this amount. Even with this additional cost, this will not delay the commencement of other projects funded with these funds as the City receives future RMRA/SB1 installments. This Project is included as Project 1 in the attached RMRA FY 2023-2024 Resolution.
Please note: The award of a construction agreement for the Landau Blvd. and McCallum Way Intersection Traffic Signal Construction is scheduled for the June 28, 2023, City Council Meeting. City Staff will present to the City Council the contract award and the budget amendment required to fund this Project.

Summary
All the Proposed Projects are included in the City’s FY 2023-2024 and FY 2024-2025 CIP Plan adopted at the Regular City Council Meeting on May 24, 2023. In addition, the City Council must approve a Resolution every year that lists the Proposed Projects the City will be completing within that fiscal year. Once the Resolution is approved, the City will submit an approved copy of this Resolution to the CTC as required by the LSRP.
City Staff recommends the City Council approve a resolution adopting the City’s FY 2023-24 Capital Improvement Program Projects funded by Senate Bill 1: The Road Repair and Accountability Act of 2017.
FISCAL IMPACT:
The recommended action will have no immediate fiscal impact for confirming the proposed projects described in the attached Resolution, as each project will be brought separately to the City Council for SB-1 CIP funding approval.
Note: The City is required to maintain its existing commitment of local funds for Capital Improvements to remain eligible for RMRA funding apportionment. To be eligible in the SB-1 program, the City needs to spend no less than the annual average of its General Fund expenditures, as determined during the 2009-2010, 2010-2011, and 2011-2012 fiscal years for streets, road and highway purposes from the City’s General Fund (or Maintenance of Effort (MOE) amount) of approximately $900,000 annually. If the City meets its MOE commitment, the City will receive approximately $900,000 annually in RMRA/SB-1 funding. The required MOE funding is included in the City’s proposed FY 2023–2024 and FY 2024–2025 Biennial CIP Budget.
