Staff Report
City Council
Item No. 6.D
Meeting Date: June 28, 2023
From: John Corella, Director of Engineering/Public Works Title: Approval of a License Agreement with Palm Springs Unified School District (PSUSD) for Construction Staging for the PSUSD Landau Elementary School Modernization Project
City Council
RECOMMENDATION:

To approve a four-year License Agreement with Palm Springs Unified School District (PSUSD) for Temporary Construction Access and Construction Staging on City-owned property for the PSUSD Landau Elementary School Modernization Project with an annual license fee of $46,040 for a total amount of $184,160; and authorize the City Manager to execute the Agreement.

BACKGROUND:

On January 6, 2023, the Palm Springs Unified School District (PSUSD) Department of Facilities, Planning and Development informed City Staff of the upcoming three-year modernization project at Landau Elementary School located on the southeast corner of Landau Blvd. and 30th Avenue. PSUSD Staff also requested to explore different options to utilize the City-owned property during the construction phase of the project located directly south and abutting Landau Elementary School (APN 678-030-065 through 678- 030-069 inclusive) located on the north side of Vega Road approximately 400 feet east of Landau Boulevard (abutting and east of the Salvation Army). A location map is attached to this Staff Report for reference.

The Landau Elementary School Modernization Project (Project) involves the demolition of the administration building and four (4) classroom buildings that will be replaced with a new administration building, four (4) new single-story classroom buildings, an additional two-story classroom building, and associated site work between buildings, play fields and existing parking lot and multipurpose building.

According to the attached letter from PSUSD Facilities, Planning and Development Executive Director, the Project is anticipated to start in the early Summer of 2023 and completion is anticipated by the Summer of 2026.

PSUSD and City Staff met at the City property on April 6, 2023, to address different aspects of the Landau Elementary School Project including the use of the vacant City owned lot for a construction staging yard, aspects of an agreement between the two (2) agencies, a new driveway approach on Landau Boulevard at the southwest corner of the school property, and the implementation of the new City safety crosswalk on 30th Avenue and Avenida La Paz as a result of the HSIP 11 grant award.

DISCUSSION:

The City-owned property consists of five (5) vacant lots (APNs 678-030-061, 063, 065, 067 and 069) with portions to be used by PSUSD employees, contractor, and subcontractors for the purpose of accessing the construction site and for the use as a construction staging area. This also includes the installation of temporary trailers for offices and restrooms, delivery of construction materials, storage and laydown area, and contractor’s employee parking.

Following the site meeting on April 6, 2023, City Staff researched the typical rates per square foot to lease undeveloped (vacant) land to be used for a short-term construction staging area. The price per square foot ranges were $0.045 to $0.10 per square foot per month. In evaluation, Staff agreed that $0.045 per square foot per month for the portion of the site the PSUSD will use is a fair price for the cost basis and a License Agreement (Agreement) is the correct document to use for this purpose.

The City Attorney and Staff prepared a License Agreement for Temporary Construction Access and Staging (attached), which was submitted to PSUSD for their review.

PSUSD provided minor comments which were incorporated into the Agreement.

The Agreement grants PSUSD employees, contractor and subcontractors, access and use for a portion of the City-owned property consisting of approximately 85,260 square feet.

An exhibit showing the area for construction access and staging is attached to the Agreement.

After subsequent discussions PSUSD asked for the term of the Agreement to be forty- eight (48) months concluding when the restorations to the City-owned property and infrastructure adjacent to the Project have been accepted by the City, as defined in the Agreement.

Staff is requesting City Council approve a four (4) year License Agreement with PSUSD for Temporary Construction Access and Construction Staging on City-owned property for the PSUSD Landau Elementary School Modernization Project with an annual license fee of $46,040 for a total amount of $184,160; and authorize the City Manager to execute the Agreement.

FISCAL IMPACT:

The term of the agreement is for forty-eight (48) months concluding when restorations have been accepted by the City.

The annual license fee is $46,040 calculated at a monthly rate of $0.045 per square foot Cathedral City Page 3 of 3 Printed on 6/22/2023
for a total amount of $184,160 at the end of the term of the License Agreement. Upon termination of the Agreement, the City shall refund the District any unused, prorated portion of the Annual License Fee, if applicable.
