BACKGROUND:

The Ophelia Bringas Memorial Bridge Project (Project), also known as the Cathedral Canyon Drive Bridge over Whitewater River Project, replaced the low water crossing with a 4-lane bridge providing a roadway section that conforms to the City’s General Plan. The bridge's cross section provides four (4) roadway lanes with a bike lane, sidewalk, CV Link path, and a center raised median. Construction started on June 15, 2020, and the bridge was substantially completed on September 23, 2022. However, in February 2023, as Staff prepared to complete the closeout of the Project, concrete cracks were found on the bridge's abutments, requiring the Contractor (Ames Construction Inc.) to return to the Project site to complete the repairs. The Contractor completed the repair work on May 22, 2023. At the June 28, 2023, Council Meeting, the City Council accepted the bridge as complete, and the Notice of Completion was recorded on July 07, 2023.

T.Y. Lin International
On July 24, 2019, the City Council approved a Professional Construction Management Services Agreement with T.Y. Lin International (TYLin) in the amount of $2,339,347.00 to provide construction management, inspection, construction survey, and material testing services for the Project.

On March 9, 2022, the City Council approved Amendment No. 1, which extended the term of the Agreement an additional two (2) years. This extension expired on July 24, 2023.

DISCUSSION:

TYLin substantially closed out the Project at the end of 2022 and expended the dedicated working hours for this portion of the Project. Between December 2022 and February 2023, during the close-out phase of the Project, the unforeseen repairs of an irrigation waterline break and the concrete cracks on the bridge abutments required additional administrative and inspection services from TYLin. These services caused additional expenses and work for the Project’s close-out phase.

TYLin is requesting the amount of $9,968.20 for the actual cost associated with the inspection services provided for the repairs above-mentioned (Change Order No. 19), and an additional $5,013.33 to complete the Project close-out phase and the Caltrans audit. Thus, TYLin’ s total request for additional services is in the amount not to exceed $14,981.53.

TYLin has been and continues to be essential in the construction management and completion of the Project and has performed satisfactorily up to this time. It is in the City’s best interest to amend the term of the agreement to a one (1) year extension to complete the Project close-out phase and to support Staff for the Cal Trans final audit.

Engineering Staff has reviewed the T.Y. Lin International request, prepared Amendment No. 2 (attached to this report), and recommends its approval for execution and payment. The current T.Y. Lin International contract amount is $2,339,346.68, and Amendment No. 2 in the amount of $14,981.53 represents a 0.64% increase in the overall engineering costs for the Project, bringing the total amount to $2,354,328.41.

This increase does not require Federal (Caltrans) or Coachella Valley Association of Governments (CVAG) approval as it is within the contingencies of the overall project budget. The contract term will be extended retroactively, for an additional one (1) year, with an expiration date of July 24, 2024.

Engineering Staff recommends that the City Council approve Amendment No. 2 to the Professional Construction Management Services Agreement with T.Y. Lin International for the Ofelia Bringas Memorial Bridge Project (aka Cathedral Canyon Drive Bridge over Whitewater River Project) extending the term of the agreement to one (1) additional year and increasing the compensation of the agreement in the amount not to exceed $14,981.53 due to an increase in the scope of work; and authorize the City Manager to execute Amendment No. 2.

FISCAL IMPACT:

T.Y. Lin International is requesting an increase in contract costs in the amount of $14,981.53 to be included in Amendment No 2. This amount will be funded with HBP Federal (Caltrans) 88.53%, and a local match of 11.47%. CVAG funds 75% of the local match and the City’s Measure A funding will fund the remaining 25%.

Funds are available from the Project’s construction contingency budget as follows:

Fund Name/Source Full Account No. Amount
Federal HBP. BR-NBIL (304) 331-100-150-156-8200-8231 $ 13,263.15 CVAG 331-100-150-156-8800-8802 $ 1,288.79
City Measure A 331-100-150-156-8800-8802 $ 429.60
FIVE-YEAR STRATEGIC PLAN:

GOAL B: COMMUNITY INVESTMENT
Objective: Cathedral City roads, gateways, public spaces, and other city infrastructure are well planned, designed, constructed, and maintained.
