Staff Report

City Council

Item No. 4.D

Meeting Date: September 13, 2023
From: John Corella, Director of Engineering/Public Works Title: Rejection of Proposals for Professional Labor Compliance Monitoring and Enforcement Services for the Dream Homes Park Project

City Council

RECOMMENDATION:

To reject the one (1) proposal received for Professional Labor Compliance Monitoring and Enforcement Services for the Dream Homes Park Project; and, authorize the City Engineer to re -advertise the Request for Qualifications/Proposals for the before mentioned services.

BACKGROUND:

In December 2021, California State Parks (State) awarded the City of Cathedral City $8,498,000 of Statewide Park Program (SPP) Round 4 grant funds for the Dream Homes Park Project (Project). Following the notice of award in February 2022, the City received authorization from California State Parks to proceed with the Project's design, bid, and construction.

Under the State requirements, the City is required to perform labor compliance monitoring and enforcement services to ensure the selected Contractor and subcontractors adhere to the State Labor Code for the construction of the Project.

In the past, City Staff has relied on outside professional firms and consultants to perform the labor monitoring and enforcement services. The City must follow State and grant guidelines to be reimbursed when contracting professional services. A notice inviting Request of Qualifications/Proposals (RFQ/P) seeking qualified firms and consultants to provide professional services is required to be issued to ensure compliance with the above cited guidelines.

DISCUSSION:

On August 3, 2023, and August 10, 2023, the Engineering Department advertised a Request for Qualifications/Proposal ( RFQ/P) for Professional Labor Compliance

Monitoring and Enforcement Services for the Dream Homes Park Project in the Desert Sun and on the City Website. The deadline to submit a proposal was August 24, 2023.

At the time of the deadline for the submission, the City received one (1) proposal from Hill International Company (Irvine, CA).

Upon reviewing the State's Contracting requirements, the City must make efforts to secure at least three (3) competitive proposals for any contractual service to be provided on a State funded project. Since three (3) competitive proposals were not submitted to the City at the time of the deadline, Staff recommends City Council reject the single proposal received and re-advertise the RFQ/P to comply with the minimum number of competitive proposals required to be received.

City Staff will re -advertise the RFQ/P in the Desert Sun, on the City Website, and circulate the RFQ/P to all firms/consultants who may be interested in providing the labor compliance monitoring and enforcement services for this Project.

As part of this process, Hill International Company ’s proposal is recommended to be rejected and returned to the consultant. Hill International will be notified of the formal rejection of their proposal due to lack of the number of proposals received. Staff will then re-advertise the RFQ/P for the same services and encourage Hill International Company to resubmit a responsive proposal.

Staff recommends City Council reject the one (1) proposal received for Professional Labor Compliance Monitoring and Enforcement Services for the Dream Homes Park Project and authorize the City Engineer to re -advertise the Request for Qualifications/Proposals for the Professional Labor Compliance Monitoring and Enforcement Services for the Dream Homes Park Project.

FISCAL IMPACT:

This recommended action has no financial impact other than the cost of re -noticing and readvertising for the RFQ/P.

Once the RFQ/P process is completed and a qualified consultant is selected, Staff will return to the City Council for the award of the contract for Professional Labor Compliance Monitoring and Enforcement Services for the Dream Homes Park Project.
