BACKGROUND:

On June 28, 2023, City Council awarded a construction contract to Granite Construction Company (Granite) in the amount of $970,221.00 and approved a ten percent (10%) contingency in the amount of $97,022.10 thereby making the total construction budget $1,067,243.10 to complete the construction of the City-Wide Repaving Projects (Projects).

The City-Wide Repaving Projects include East Palm Canyon Drive Pavement Rehabilitation Project (C08669), Da Vall Street Improvements (C08665), San Eljay Pavement Rehabilitation (C08667), and the Public Alley Reconstruction Project (C08670).

The following is a summary of the four (4) CIP Projects completed:

1.East Palm Canyon Pavement Rehabilitation (C08669)
This Project rehabilitated the pavement and pavement striping along East Palm Canyon Drive from Perez Road to Auto Park Drive.

2.Da Vall Street Improvements (C08665)
This Project reconstructed the pavement on Da Vall Drive from Ramon Road to approximately 1,500 feet south of the intersection and three curb ramps, to be compliant with the American Disabilities Act (ADA). This Project installed new pavement striping and signage on Da Vall Drive.

3.San Eljay Pavement Rehabilitation (C08667)
This Project reconstructed the pavement on San Eljay Avenue from McCallum Way to Ramon Road and rehabilitated the pavement striping on San Eljay Avenue.

4.Public Alley Reconstruction (C08670, Additive Alternate) This Project reconstructed the public alleyway bounded by Ramon Road to the north, Cathedral Canyon Drive to the east, and Roundup Road to the west and south.

Due to Tropical Storm Hilary, the original construction start date of August 28, 2023, was delayed. The construction of the City-Wide Repaving Projects started on September 18, 2023.

DISCUSSION:

During the construction of the Projects the tasks of construction administration, engineering, and inspections were performed in-house by City Staff. Granite completed the construction on December 6, 2023.

City Staff determined that the Projects were built in accordance with all contract requirements and is recommending the City Council to accept the Projects as complete.

City Council acceptance is required to approve the Projects’ final contract amount and to release the funds retained during construction. Retention funds are monies earned by the Contractor withheld from progress payments pending satisfactory completion and final acceptance of the Projects.

City Council acceptance of the Project requires a Notice of Completion (NOC) be filed with the Riverside County Recorder’s office. The NOC is a written notice issued by the owner of a project, or their agent, to notify concerned parties that all work on the project has been completed. This notice also sets the period, which is thirty (30) days from the date the NOC is filed, within which concerned parties may exercise their lien rights against one another. Once the thirty-day period has expired, and provided no claims or liens are received, the City can release retention funds.

City Staff recommends the City Council accept and approve the City-Wide Repaving Projects: East Palm Canyon Pavement Rehabilitation (C08669), Da Vall Street Improvements (C08665), San Eljay Pavement Rehabilitation (C08667), and Public Alley Reconstruction (C08670), as final; and, authorize the City Manager to execute and City Engineer to file a Notice of Completion with the Riverside County Recorder's office, respectively; and authorize the release of retention funds to Granite Construction Company (Granite) upon expiration of the Notice of Completion.
