City Council

Item No. 6.B

Meeting Date: January 24, 2024
From: John Corella, Director of Engineering/Public Works Title: Cooperative Agreement between Coachella Valley Association of Governments (CVAG) and the City of Cathedral City for the Construction of CV Link Community Connector Project with the Dream Homes Park Project.

City Council

RECOMMENDATION:

To authorize the Mayor and the City Manager to execute the Cooperative Agreement between the Coachella Valley Association of Governments (CVAG) and the City of Cathedral City for the construction of CV Link Community Connector Project with the Dream Homes Park in the amount not to exceed of $534,404.51.

BACKGROUND:

The Coachella Valley Link (CV Link) is a 40 -plus-mile bicycle, pedestrian, and low - speed (up to 25 mph) neighborhood electric vehicle (NEV) pathway being built largely along the Whitewater River, extending from Palm Springs to Coachella. Within the City of Cathedral City, the CV Link pathway is located to the west of the Whitewater River Channel and to the east of the Dream Homes Neighborhood providing one (1) community connector between the pathway and the neighborhood.

In March 2022, CVAG secured f unding from the Clean California Local Grant Program (CCLGP) for the design and construction costs for community connections to CV Link.

City Staff in collaboration with CVAG Staff determined that a connector to the upcoming Dream Homes Park (Park) will provide better access for cyclists and pedestrians between the Park/Neighborhood and the CV Link pathway. The proposed CV Link Community Connector will be located at the central plaza of the upcoming Dream Homes Park.

City and CVAG Staff explored the opportunity to have both Projects, the Dream Homes Park and CVAG’s C V Link Community Connector, constructed at the same time, avoiding the possibility of two (2) prime contractors working within the same area. City Staff and CVAG Staff determined it would be in the best interest of both agencies that the City (the agency with the larger overall project) would manage the construction of

both Projects, and CVAG would reimburse 100% of eligible cost s pertaining to the CV Link Community Connector Project.

CVAG prepared plans, specifications, and estimates (PS&E) for the proposed CV Link Community Connector Project to the Dream Homes Neighborhood in compliance with CV Link design standards. These design standards for the Community Connector were incorporated into the Dream Homes Park Project as an additive alternate bid item.

City Staff received the bid for the Park Project on October 18, 2023. At that time , City Staff performed the bid analysis of the base bid and CVAG Staff reviewed and approved the construction cost bid portion for the CV Link Community Connector Project.

At the November 8, 2023, City Council Meeting, the City Council awarded a contract to Urban Habitat in the not to exceed amount of $6,899,029.97 for the construction of Dream Homes Park Project (C07021) . This approval also included the construction of the CV Link Community Connector Project and the allocation of funds in the amount $534,404.51 from the City’s Capital Improvement Project (CIP) Plan to fund the CV Link Community Connector Project to be reimbursed by CVAG.

DISCUSSION:

On December 4, 2023, the Cooperative Agreement between the City of Cathedral City and CVAG was approved at the CVAG Joint Meeting of the Executive and Transportation Committees.

The Cooperative Agreement establishes that the City will manage the construction of the CV Link Community Connector Project and CVAG will reimburse the City 100% of the construction cost related to the construction of the CV Link Community Connector Project in the amount of $464,699.57. The Cooperative Agreement also includes a 15% contingency in the amount of $69,704.94 for any unforeseeable construction costs resulting from the CV Link Community Connector Project. Thus, the total amount for the Agreement is in the amount of $534,404.51.

Staff recommends the City Council authorize the Mayor and the City Manager to execute the Cooperative Agreement between the Coachella Valley Association of Governments (CVAG) and the City of Cathedral City for the Construction of the CV Link Community Connector Project with the Dream Homes Park Project in the amount not to exceed $534,404.51.
