Title: Notice of Completion for ATP Cycle 5: Cathedral Canyon Drive Sidewalk and Multiuse Trail (C08505) and Date Palm Drive Expansion (C08508)
RECOMMENDATION:

To accept and approve the ATP Cycle 5: Cathedral Canyon Drive Sidewalks and Multiuse Trail project (C08505), and Date Palm Drive Expansion project (C08508), as complete; authorize the City Manager to execute and file a notice of completion with the Riverside County Recorder’s Office; and authorize the release of retention funds to Riverside Construction Company, upon expiration of the notice of completion.

BACKGROUND:

On November 8, 2023, the City Council approved an agreement with Falcon Engineering Services, Inc. (Falcon) to provide construction engineering (CE) services for the Active Transportation Program (ATP) Cycle 5: Cathedral Canyon Drive Sidewalks and Multiuse Trail project (C08505) and the Date Palm Drive Expansion project (C08508). During the same meeting, the Council also approved a construction contract with Riverside Construction Company (RCC) for the construction of the ATP Cycle 5 projects.

Cathedral Canyon Drive Sidewalk and Multiuse Trail Project (C08505) The project was constructed on Cathedral Canyon Drive from Canyon Shores Drive to Dinah Shore Drive. The project installed a 6-foot-wide bicycle lane along the west side of Cathedral Canyon Drive, a multiuse trail on the east side and new signage and striping. This project also included the construction of a sidewalk (west side), curbs, gutters, ADA curb ramps, and the installation of a high-intensity activated crosswalk (HAWK) signal at the intersection of Cathedral Canyon Drive and Calle Trujillo.

Date Palm Drive Expansion Project (C08508)
The project was constructed on Date Palm Drive extending from East Palm Canyon Drive to Perez Road. It included the installation installed a 6-foot-wide bicycle lane along the east side of Date Palm Drive, as well as a sidewalk along the same side, which required the widening of the North Cathedral City Stormwater Channel Bridge. Additionally, the project included the construction of curbs, gutters, ADA curbs ramps, driveway approaches, and ancillary infrastructure on the east side of Date Palm Drive.

DISCUSSION:

Construction started on March 4, 2024, and was completed on April 24, 2025.

Falcon and city staff reviewed and inspected the improvements and found the project was built in accordance with all contract requirements and therefore recommend the City Council accept the project as complete.

City Council acceptance is required to approve the project’s final contract amount and release retention funds. Retention funds are monies earned by the contractor withheld from progress payments pending satisfactory completion and final acceptance of the project.

Additionally, the City Council acceptance of the project requires an NOC be filed with the Riverside County Recorder’s Office. The NOC is a written notice issued by the owner of the project, or their agent, to notify concerned parties that all work on the project has been completed. This notice also sets a period of thirty-five (35) days from the date the NOC is filed, within which concerned parties may exercise their lien rights against one another. Once the thirty-five-day period has expired, and provided no claims or liens are received, the city can release retention funds to the contractor.

City staff recommends the City Council to accept and approve the ATP Cycle 5: Cathedral Canyon Drive Sidewalks and Multiuse Trail project (C08505), and Date Palm Drive Expansion project (C08508), as complete; authorize the City Manager to execute and file a notice of completion with the Riverside County Recorder’s Office; and authorize the release of retention funds to Riverside Construction Company, upon expiration of the NOC.

FISCAL IMPACT:

The project was successfully completed using only the funds allocated from the ATP Cycle 5 and SB-821 grants. As a result, no local funds from Measure A that were allocated to the project needed to be used, making them available for future programmed projects within the City's 5-Year CIP.

The fiscal impact of the ATP Cycle 5 Cathedral Canyon Drive Sidewalks and Multiuse Trail project (C08505), and the Date Palm Drive Expansion project (C08508), is as follows:
