9 CITY COUNCIL RESOLUTION NO. 25-___
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY,
CALIFORNIA APPROVING A DETERMINATION OF PUBLIC CONVENIENCE OR
NECESSITY FOR EAGLE CATHEDRAL CITY LIMITED FOR THE SALE OF BEER, WINE, AND DISTILLED SPIRITS (TYPE 48 ON-SITE GENERAL) LOCATED AT 67625 E PALM CANYON DRIVE, BUILDING 2, SUITE C7 (ASSESSOR PARCEL NUMBER 687-510-022)
WHEREAS, Eagle Cathedral City Limited (The Eagle), has filed an application with Department of Alcohol and Beverage Control (ABC) requesting a liquor license for the authorization of the sale of beer, wine, and distilled spirits for consumption off the premises where sold (ABC Type 48 License) within a proposed nightclub located within the City of Cathedral City at 67625 E Palm Canyon Drive, Building 2, Suite 7 (Accessor Parcel Number 687-510-022); and
WHEREAS, the Department of Alcohol and Beverage Control (ABC), a state agency, regulates the distribution of liquor licenses in the State of California; and WHEREAS, it has been determined by the Alcohol and Beverage Control (ABC) staff that there is an “undue concentration” in relation to the number of alcohol related licenses that currently exist in that area of the City (Census Tract 9410.01). As a result of the undue concentration, California Code Section 23958.4 requires that “the local governing body of the area in which the applicant premises are located, or its designated subordinate officer or body, determines within 90 days of notification of a completed application that public convenience or necessity would be served by the issuance; and WHEREAS, the State Business and Professions Code Section 23958.4 defines “undue concentration” of liquor licenses and establishes a procedure for the local agency to determine if the Public Convenience or Necessity will be served by the issuance of a license notwithstanding a determination that there is an undue concentration of licenses; and
WHEREAS, on October 22, 2025, at a duly noticed public meeting, the Council has considered evidence with respect to this item.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CATHEDRAL
CITY, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE, AND ORDER AS FOLLOWS:
Section 1. The project is located within Census Tract 9410.01, which currently contains ten (10) on-sale retail licenses within this census tract. Before issuing a license, ABC requires a Public Convenience or Necessity (PCN) finding from the local jurisdiction for alcohol sales establishments that are located within a census tract that 6 1
9 is over concentrated with similar alcohol related uses.
Section 2. The City has found that the applicant premises provides a public convenience and is a necessity for the community. This determination is based on the following:
1. The proposed bar/nightclub is consistent with the City’s General Plan, CG land use designation and PCC zoning designation.
2. Census Tract 9410.01 is an area of undue concentration; however, this is reasonable given the multiple restaurants, amusement center, and bars within the tract. The authorization of a Type 48 On-Sale General – Public Places Liquor License for Eagle Cathedral City Limited would support the establishment of a viable entertainment venue in the city.
3. There are currently only two (2) active Type 48 On-Sale General – Public Places Liquor Licenses within Tract 9410.01.
Section 3. Based upon the evidence presented, and the above findings, the Council hereby makes findings of Public Convenience or Necessity (PCN) for the sale of beer, wine, and distilled spirits for consumption on the premises where sold (Type 48 On-Sale General) at 67625 E Palm Canyon Drive, Building 2, Suite C7 (APN: 687- 510-022) and authorize the City Manager or their designee to issue the letter of Public Convenience or Necessity.
Section 4. This Resolution shall take effect immediately upon its adoption THE FOREGOING RESOLUTION WAS APPROVED AND ADOPTED on this 22nd day of October 2025, by the following vote:
