Item No. 3.G
Meeting Date: May 27, 2026
From: John A. Corella - Director of Public Works
Title: Adoption of Resolution accepting an Offer of Dedication for Lots B and C in Tract 24515 for Public Street Purposes, and Lots H and J in Tract 24515 for Drainage and Floodway Purposes.
RECOMMENDATION:
City Council adopt the Resolution rescinding the prior rejection by the City Council of the offers of dedication for Lots B, C, H and J in Tract 24515, and to now accept the said offers of dedication of Lots B and C for street and public utility purposes, and of Lots H and J for drainage and floodway purposes, as described in the Resolution.
BACKGROUND:
Tract No. 24515 is located on the east side of Date Palm Drive, between Interstate 10 and Varner Road. The final tract map was approved by the City Council in 1992 and subsequently recorded in February 1992 (Vicinity Map attached).
Lots B and C, as shown on the attached tract map, are located adjacent to the east side of Date Palm Drive and were offered for dedication for public street and public utility purposes to accommodate the future widening of Date Palm Drive along its east side.
Lots H and J, as shown on the attached tract map, were offered for dedication to the city for drainage and floodway purposes, including the future construction of a 400-foot-wide drainage channel. At the time of final map approval, the City Council rejected the offers of dedication for these four lots.
Pursuant to the Subdivision Map Act (Government Code Section 66477.2(a)) (excerpt attached), an offer of dedication made on a subdivision map may be accepted or rejected by the legislative body. If rejected, the offer remains open and may subsequently be accepted at any later date by resolution of the legislative body. Upon acceptance, the resolution accepting and opening the street, alley, path, or right-of-way for public use must be recorded with the County Recorder.
DISCUSSION:
In this instance, it is recommended City Council accept the offers of dedication for Lots B and C on Tract No. 24515 for public street purposes. Staff has determined the additional right-of-way will be required for Date Palm Drive as part of the Date Palm Drive I-10 to Varner Road Widening Project, which is currently in the design phase.
All land within Tract No. 24515 remained vacant and undeveloped since recordation of the tract map. In recent years, the property has experienced increased development interest, and city staff has met with multiple developers and consultants to discuss potential development opportunities within the area. A primary topic during these discussions has been the management of stormwater runoff that traverses the site between Date Palm Drive and the future extension of DaVall Drive, originating from Willow Hole Wash.
Due to the regional significance of controlling this runoff and the currently undetermined stormwater infrastructure requirements, acceptance of the offers of dedication for Lots H and J for drainage and floodway purposes is now considered necessary and in the best public interest to support the orderly development of the area. Although no active development is occurring at this time, acceptance of the dedications is recommended in order to preserve and protect the alignment needed for future stormwater conveyance.
The attached Resolution provides for acceptance of the dedications solely for the purpose of vesting title to Lots H and J in the city. The Resolution does not constitute acceptance for city construction, operation, or maintenance responsibilities at this time. Any future acceptance of such responsibilities may be considered separately by the City Council through a subsequent resolution.
In addition, the original offers of dedication for Lots H and J, as shown on the tract map, included the city’s right to convey its interest in the properties to an appropriate flood control agency, if necessary. The attached Resolution also incorporates this provision.
Accordingly, the attached Resolution has been prepared to accept Lots B, C, H, and J of Tract 24515 in the manner described above.
Upon adoption of the Resolution, the City Clerk will be directed to record the Resolution with the County Recorder.
FISCAL IMPACT:
There is no direct fiscal impact.
