RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CATHEDRAL CITY, CALIFORNIA, ACCEPTING THE OFFER OF DEDICATION OF LOTS “B” AND “C” AS SHOWN ON THE MAP OF TRACT NO. 24515, FOR PUBLIC STREET
AND PUBLIC UTILITY PURPOSES, AND CONDITIONALLY ACCEPTING THE OFFER OF DEDICATION OF LOTS “H” AND “J” OF TRACT NO. 24515 FOR STORM DRAIN AND FLOODWAY PURPOSES.
WHEREAS, in connection with the approval and recordation of the subdivision map for Tract No. 24515, located on the east side of Date Palm Drive, north of Interstate 10 freeway, in February, 1992, Lots “B” and “C” as shown on that map, adjoining Date Palm Drive, were offered for dedication for public street and public utility purposes, and Lots “H” and “J” as shown on said map, were offered for dedication for storm drain and floodway purposes, together with the right for the City to convey its interests in said Lots “H” and “J” as dedicated, to any appropriate flood control agency. Said Lots are, described as:
Lots “B’ and “C”, and Lots “H” and J” of Tract No. 24515, as shown by map on file in Book 237, at Pages 32 through 38, inclusive, of Maps, Records of Riverside County, California.
AND WHEREAS, said offer of dedication of Lots “B” and “C” and “H” and “J” was rejected by the City Council of the City of Cathedral City at the time the final map was approved; and
WHEREAS, the City of Cathedral City and this City Council have determined that it is now in the best public interest and is a necessary action for the orderly development of the surrounding area to rescind the past rejection of Lots “B” and “C”, and Lots “H” and “J” and to now accept the said offer of dedication of said lots.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cathedral City, as follows:
1. That pursuant to State Government Code Sec. 66477.2 (a), the previous
action rejecting the offer of Lots “B” and “C” of Tract No. 24515 is hereby rescinded, and the said offer of dedication for public street and public utility purposes as described above is now hereby accepted, and said Lots “B” and “C” are now hereby accepted into the City maintained street system pursuant to Section 1806 of the State Streets and Highways Code.
2. That pursuant to State Government Code Sec. 66477.2 (a), the previous
action rejecting the offer of Lots “H” and “J” of Tract No. 24515 is hereby rescinded, and the said offer of dedication for storm drain and floodway purposes, together with the right for the City to convey its interests in said Lots “H” and “J” as dedicated, to any appropriate flood control agency, is now hereby accepted, but only for the purpose of vesting title to the City and not for the purpose of accepting said Lots “H” and “J” for construction or maintenance purposes.
3. That the City Council reserves the right at any future date by Resolution to
accept said Lots “H” and “J” for construction and or maintenance purposes.
4. That the City Clerk is hereby directed to cause a certified copy of this
Resolution, attested by her under seal, to be recorded in the office of the County Recorder of Riverside County.
