Staff Report
City Council
Item No. 3.K
Meeting Date: June 10, 2026
From: John A. Corella - Director of Public Works
Title: Approval of Improvement Agreement for Design Review 23-003 (DR 23- 003) and Specific Plan 99-58A (SP 99-58A) for the Developer Date Palm and Rosemount Realty, LLC.

RECOMMENDATION:

City Council approve the Improvement Agreement with Date Palm and Rosemount Realty, LLC, for the construction of public improvements on Date Palm Drive, and authorize the Mayor and City Clerk, respectively, to execute the Agreement.

BACKGROUND:

Design Review DR 23-003 and Specific Plan Amendment DR 99-58A were approved by the City Council on September 11, 2024, for the development of a two-phased commercial development by Date Palm and Rosemount Realty, LLC (Developer). The proposed project is located on Assessor Parcels 670-110-053, 056, 057 and 058, on the east side of Date Palm Drive, between McCallum Way and Rosemount Avenue (Vicinity Map attached).

The conditions of approval for Phase I require the widening of approximately 400 feet of the east side of Date Palm along the project’s frontage, the construction of sidewalk and parkway improvements, installation of a roadway streetlight, reconstruction of an existing entrance driveway, and other related improvements.

DISCUSSION:

At this time, the Developer is proceeding with the construction of the first phase of the project.

These improvements include onsite private and offsite public infrastructure.

The construction of these Phase I offsite public improvements are required to be guaranteed by the Developer’s execution of a secured Improvement Agreement (attached), prior to the city’s issuance of an encroachment permit to start the improvements.

Respectively, the Developer has executed an Improvement Agreement and has secured his performance by the posting of sufficient surety bonds for faithful performance and for payment of labor and materials. The Developer is continuing to comply with other conditions of approval in working with city staff on completing covenants for water quality management practices, site maintenance, and for mutual access and parking between the parcels within in the development.

ENVIRONMENTAL ANALYSIS:

An Initial Study/Mitigated Negative Declaration (IS/MND) was prepared for the Developer’s project in conformance with Section 15063 and other applicable sections of the California Environmental Quality Act (CEQA) Guidelines. The City Council determined the proposed project would not have a significant effect on the environment and adopted the Mitigated Negative Declaration and Mitigation Measure Reporting Plan prepared for the project.

At this time, staff is requesting City Council approve the Improvement Agreement with Date Palm and Rosemount Realty, LLC, for the construction of public improvements on Date Palm Drive, and authorize the Mayor and City Clerk, respectively, to execute the Agreement.

FISCAL IMPACT:

Upon successful completion and city acceptance of the improvements made by the Developer along the Date Palm Drive frontage there will be a minimal fiscal impact to the city’s roadway maintenance program which will be absorbed within the the current respective Public Works Maintenance operation’s budget.

FIVE-YEAR STRATEGIC PLAN:

Goal B - COMMUNITY INVESTMENT
Objective: Cathedral City roads, gateways, public spaces, and other infrastructure are well planned, designed, constructed and maintained.
