Amendment No. 3R1 Request August 4, 2026 Armando J. Garcia Baldizzone P.E., City Engineer City of Cathedral City, 68700 Avenida Lalo Guerrero, Cathedral City, CA 92234 Subject: Amendment No. 3R1 – Additional Construction Management, Inspection, Office Engineering, and Labor Compliance Services for Highway Safety Improvement Program (HSIP) Traffic Signal Improvements at 12 Intersections Project (Federal Project No. HSIP-5430(034) – City Project No. C08752) Dear Mr. Armando J. Garcia Baldizzone, Z&K Consultants, Inc. (Z&K) respectfully submits this Amendment No. 3R1 request to revise the contract budget for Construction Management Support Services associated with the Highway Safety Improvement Program (HSIP) Traffic Signal Improvements at 12 Intersections Project. The original construction contract established the first working day as December 8, 2025, and included 72 working days, resulting in a contract completion date of March 25, 2026. This amendment request is limited to the additional Construction Management, Inspection, Office Engineering, Labor Compliance, and Materials Testing services required during the extended construction period from March 26, 2026, through May 21, 2026, resulting from the approved contract time extensions and suspension of work. The requested funding is intended to compensate for the additional Construction Management effort associated with administering the extended construction period, including inspection, coordination, meetings, office engineering, RFI and change order processing, and related construction administration activities. Project closeout services are not included in this request, as those activities remain within the original contract budget. Construction Management Services Associated with Change Orders The original contract completion date was March 25, 2026. However, as shown in the table below, all project change orders were executed after the contract completion date. • Change Order No. 1 did not extend the contract duration, however, it required additional effort for preparation, review, coordination, and processing before being fully executed on July 16, 2026. • Change Order No. 2, which extended the contract by five (5) working days, was fully executed on March 26, 2026. • Change Order No. 3, which extended the contract by an additional nine (9) working days, was fully executed on April 14, 2026. • Change Order No. 4 did not extend the contract duration, however, it required additional effort for preparation, review, coordination, and processing before being fully executed on June 5, 2026. Since these change orders were processed and executed after the contract completion date, Z&K was required to provide additional Construction Management services beyond those originally anticipated, including preparation, review, coordination meetings with the City and Contractor, negotiation support, processing of contract modifications, administration and inspection of change order work, and associated project documentation necessary to complete the project. Change Order Amount WD Z&K Signed Belco Signed City Signed CO No. 1 $ 3,079.25 0 7/1/26 7/3/26 7/16/26 CO No. 2 $ (31,157.05) 5 3/17/26 3/19/26 3/26/26 CO No. 3 $ 21,287.12 9 3/31/26 4/9/26 4/14/26 CO No. 4 $ 3,800.00 0 4/16/26 4/21/26 6/5/26 Construction Management Services Associated with Suspension of Work & VDS Delay In addition to the Change Order work, the project experienced authorized non-working days that extended the overall duration of construction without increasing the contract working days. These included a suspension of work from March 20, 2026, through April 10, 2026, accounting for 16 non-working days. Although contractor working days were not charged during this period, Z&K continued providing Construction Management services, including engineering review, technical coordination, meetings, RFI administration, schedule management, documentation, contract administration, and coordination associated with the change orders discussed above, the VDS compatibility issues described below, and the resulting project delays. During the scheduled traffic signal turn-on at Gerald Ford Drive and Plumley Road on March 11, 2026, it was discovered that the approved rack-mounted Video Detection System (VDS) equipment was incompatible with the existing shelf-mounted ("P" style) traffic signal cabinet. This incompatibility prevented completion of the signal activation and required engineering review and direction prior to proceeding with the affected work. Belco submitted RFI No. 6 on March 20, 2026, requesting direction regarding the incompatibility. The Engineer and Z&K provided the formal response on March 27, 2026, directing the Contractor to coordinate with the equipment manufacturer and proceed with corrective action while restoring safe traffic operations as soon as possible. Following the RFI response, the project required extensive coordination between the City, Z&K, Belco, Advantec, CT West, Iteris, Econolite, and other stakeholders to evaluate the incompatibility, restore interim traffic operations, troubleshoot additional controller-related issues, obtain previous detector layouts, coordinate multiple site visits, and determine an acceptable installation method for the existing cabinet configuration. These activities required significant engineering review, technical meetings, field coordination, contractor coordination, contract administration, schedule management, and ongoing communication among multiple stakeholders before the affected work could proceed. Resolution of the VDS incompatibility required continued review, coordination, decision-making, and approval by multiple parties before implementation could proceed. Similarly, RFI No. 5 remained under City review for approximately 31 working days before final disposition. Although Z&K completed its technical review early in the process, Construction Management services continued throughout the review period, including coordination with the City and Contractor, schedule monitoring, follow-up technical reviews, documentation, and contract administration until the issue was fully resolved. These extended review and approval periods significantly increased the overall Construction Management effort required for the project. Certified payroll records further indicate that no project field work occurred during the suspension period, documenting an interruption in field construction while the VDS compatibility issue was being evaluated and resolved. Although field activities resumed on other portions of the project thereafter, the specialized equipment required to properly install the VDS within the existing P-style cabinet did not become available until April 28, 2026. Upon receipt of the compatible equipment, the Contractor installed the components and completed the affected work at Gerald Ford Drive and Plumley Road, allowing the VDS installation to proceed. Accordingly, the Engineer administratively suspended the assessment of 16 contract working days between March 20 and April 10, 2026, while the VDS compatibility issue, engineering review, manufacturer coordination, technical troubleshooting, City review, and contract administration necessary to resolve the incompatibility were underway. This administrative suspension of contract working days was separate from actual field construction activities and provided the necessary time to complete engineering evaluation, obtain the required approvals, and implement a compatible installation solution. Following the suspension period, an additional 10 working days were required for VDS rescheduling, remobilization, procurement of the compatible installation components, completion of the remaining signal activation work, and restoration of normal project sequencing. These activities collectively form the basis for extending the required contract completion date to May 21, 2026. The circumstances surrounding the VDS incompatibility required substantial additional Construction Management services beyond those originally anticipated, including engineering review, RFI management, contractor coordination, field inspections, technical meetings, schedule monitoring, documentation of delay impacts, and coordination among multiple agencies, specialty vendors, equipment manufacturers, and City staff.
The overall Construction Management effort was further increased by extended review and approval periods, including City actions that remained pending for approximately 31 working days before final disposition, requiring Z&K to continue administering unresolved issues well beyond the completion of its initial engineering reviews. Throughout these periods, Z&K remained actively engaged in facilitating technical resolution, maintaining communication among all project stakeholders, documenting contract impacts, and minimizing schedule delays. It is also important to recognize that the cumulative project impacts, including extended review and approval periods, unresolved RFIs, design incompatibilities, change order processing, manufacturer coordination, and ongoing engineering review, represented more than 90 working days of cumulative schedule impacts requiring ongoing Construction Management services over the course of the project. Without continuous Construction Management and coordination, these cumulative impacts would have significantly extended the project schedule beyond the revised contract completion date. Through proactive Construction Management, continuous coordination with the City, Contractor, Engineer, manufacturers, and specialty consultants, expedited technical reviews, and active management of critical-path activities, Z&K successfully mitigated these impacts and compressed the overall schedule. As a result, despite the cumulative delays encountered during the project, Substantial Completion was successfully achieved on May 21, 2026. Contract Time Summary The contract time is summarized below: Contract Time Summary Days/Date First Working Day December 8, 2025 Original Contract Working Days 72 Working Days Original Anticipated Completion Date March 25, 2026 Additional Working Days Approved Through Change Orders 14 Working Days Total Authorized Contract Working Days 86 Working Days Revised Completion Date April 15, 2026 Suspension of Work March 20–April 10, 2026 Suspension Non-Working Weekdays 16 Working Days Revised Completion Date May 7, 2026 VDS Additional Work 10 Working Days Revised Completion Date May 21, 2026 The requested amendment is intended to provide the additional Construction Management budget necessary for Z&K to complete the services required under its scope through construction completion. The additional hours represent Construction Management effort beyond the level originally budgeted and are associated with services necessary to administer and complete the project rather than solely with the elapsed calendar completion of construction. Subject: Change order proposal for repotholing
Belco PCO No. 14-1084-2.00
Dear Ms. Duhn,
Please consider this as Elecnor Belco Electric’s request for a change order related to the re-potholing of pole "A", which was necessary due to a conflict at the original location. The new proposed location is approximately 4 feet from the existing pole and 7.5 feet from the curb, compared to the previous location which was 8.5 feet from the curb and 12 feet from the center of the existing pole.
This proposal includes the cost for potholing at the new proposed location. Should a conflict exist at the the newly proposed location, an additional pothole will be required and a separate price proposal will be provided.
Our price to for this proposal is of $3,079.25.
If this change is acceptable, please provide a change order or written direction to proceed. Should you have any questions or concerns, please do not hesitate to contact me at (909) 536-5436 or via email [email protected].
Sincerely,
Elecnor Belco Electric, Inc.

Subject: PCO 3 R1 – Dinah Shore & Cathedral Canyon Crossings
Dear Bridget Duhn:
Please consider this as Elecnor Belco Electric’s price proposal the installation of (2) 4 in. crossings and (1) 3 in. lateral. Crossings will be conducted across the south side of Cathedral Canyon Road and the east side of Dinah Shore via directional bore. Proposal includes the lateral conduit on the southeast corner. Lateral conduit is to be installed by impact moling to prevent affecting the ramp surface. Per city direction, existing pull boxes will remain. Note that all boxes that interact with this work are no. 5 pull boxes and are currently overfilled with conductors. Belco suggests to upgrade the existing no. 5 pull boxes to no. 6 pull boxes.
As agreed per our Zoom meeting today, Belco is to track 4 pothole restorations measuring 36 in. by 36in. in the roadway on time and material. Total conduit to be installed shall be billed at bid item no. 35’s unit price of $130.00 per linear foot. A total of 190 linear feet of conduit is to be installed.
Our cost is on a lump sum price of $24,700.00. If this change is acceptable, please provide a change order or written direction to proceed. Should you have any questions or concerns, please do not hesitate to contact me at (951)807-9189 or via email at [email protected]

Sal, had measured with the wheel and the total run was 190' going around the ramp with the lateral. In which case this will take us to $ $24,700, noted that the pricing to include potholing, (2) 4 inch crossings, (1) 2 in lateral, flat work restoration will need to be joint to joint.
During a field meeting with Sal it was discussed the street segments can be reduced to 36"X36" (Andrew please advise if this is not the case)
Abraham, please provide the revised pricing as we will work with Belco on the street restoration.

Project Manager Engineer / DesignerAgency / Owner Prime Contractor HSIP CYCLE 9A: TRAFFIC SIGNAL IMPROVEMENTS Cathedral City Regarding Ramon Road at Desert Vista Road / Ave Del Yermo Avenue:
Per the plans regarding pole F, there is no pull box indicated to be within 5 feet of pole F, which is required per standard specifications. A #6 pull box is recommended to be installed at this location to meet standard specifications.
Regarding pole D at the southeast corner, there is no existing #6 pull box. There is an existing # 3 1/2 pull box in place. The existing #3 1/2 pull box will not meet currents standards and will need to be upgraded to a # 6 pull box to meet adequate capacity to meet standard specifications.
Regarding pole C at the southeast corner, an existing pull box resides within the ramp flare. This conflicts with ADA requirements. The pull box is to be removed or relocated to comply with ADA requirements and avoid future conflicts in accordance to ramp construction.
1. Proceed to install the #6 Pull Boxes for both pole F and Pole D and track under bid unit price. 2 EA No. 6 per Bid Item 33 at a total of $ 2586.00
2. Proceed to relocate the No. 6 Pull Box for Pole C outside of the ramp flare South (Final Location will be deteremined by Inspector in the field) and track under Bid unit price to include extending the lines from the existing pole C and Pole B.

Subject: PCO 5 R1 Significant Change and Request for Equitable Adjustment – Bid Item 42
Dear Mr. Faqih:
We are in receipt of the City’s independent cost analysis regarding the deletion of a portion of Bid Item 42 (Signal Rewire).
Elecnor Belco Electric, Inc. agrees with the City’s proposal to adjust the basis for the remaining six intersections to 504 labor hours and a direct labor cost of $50,326.00.
Accordingly, we have updated our itemized breakdown in Exhibit A to reflect this labor baseline while applying the markups and general administrative support fees mandated by the Contract Documents. The revised total for the remaining work under Item 42 is $157,913.22, resulting in a new unit price of $26,318.87 per intersection.
The calculations in Exhibit A strictly adhere to the following contractual requirements:
• Standard Markups: Pursuant to Section 8.2 (a), a 25% markup is applied to labor, and a 15% markup is applied to materials and equipment.
• G&A Support Fee: Per Section 6.4.3.2, a daily rate of $354.53 is included to recover general administrative costs (calculated as $850,888.00 / 72 days x 0.03). • Bond & Insurance: An additional 2% is applied to the final subtotal as allowed for project modifications under Section 8.2 (d).
We agree this adjustment reflects a fair and equitable cost impact attributable to the quantity reduction. We look forward to your prompt approval of this revised proposal so we may move forward with the work.

Re: Cathedral City_Traffic Signal Improvements Change Order ` Zack Faqih <[email protected]> Wed, Mar 4, 2026 at 10:19 PM To: [email protected]
Cc: [email protected], Andrew Lee <[email protected]>, Sal Orozco <[email protected]>, Bridget Duhn <[email protected]>, Anthony Flores <[email protected]> Good evening team
I apologize for any confusion, but based on the pricing we utilized for the 504 hours, the extended labor amount calculates to approximately $50,326 prior to markup. This differs from the $58,799.40 labor value shown in Exhibit A, which was based on 520 hours.
At this time, we do not believe the reduction in hours fully equates to the dollar amount currently reflected in the revised unit cost, and based on the adjusted labor quantity we were expecting a larger reduction that more reasonably reflects the revised scope of work.
Additionally, for documentation and audit purposes, please let us know if Belco has a detailed breakdown supporting the equipment and G&A costs included in Exhibit A and if this can be included in the revised package for said auditing purposes.
Once we receive the supporting information, we can complete our review and proceed with finalizing the change order.

Subject: Additional Working Days Request – Misc. Delays
Dear Mr. Faqih:
Please accept this as Belco’s formal request to extend working days due to a variety of delays throughout the project. These i nstances include incorrect submittal approvals, delayed RFI responses, delays in responding to change order cost proposals, and inconsistencies found between construction plans versus actual existing field conditions.
Incorrect Submittal Approved
Submitted on 6/2/25
Rejection received on 7/18/25 (35 working days)
VDS approved 7/30/25 (8 working days)
This approved submittal also resulted in further delays due to the system that was approved not being entirely compatible with the type of cabinet in the field. The VDS system that was approved is intended for a rack mount cabinet, the cabinet in the field is a shelf “P” style cabinet. This mistake affects Gerald Ford and Plumley. A turn on was scheduled for March 11 th, 2026 when it was identified that this material was incorrect.
Belco has gone above and beyond in trying to assist Cathedral City in rectifying these issues. We attempted to use material that was for another project and re -scheduled Iteris to prevent further delays. Unfortunately, the gear was not compatible. We suggested purchasing the correct material, which would still have had a lead time (5-6 weeks). Another suggestion was to RMA the existing system that would have a 6 -8 week lead time and come with re -stocking fees. Both suggestions were declined, despite our recommendations Belco was instructed to make the rack mount system work in the shelf mount cabinet.
On April 8 th Iteris confirmed that no bracket exists to properly install the system. They did acknowledge that the system would function as intended however, we would have to find a way to secure the system in place. This is the guidance that Belco has been give n. Since then, 24 working days have lapsed.

Note that had the city taken our suggestion we would be nearly to the end of the estimated lead time. In no way should Belco be liable for the time that has lapsed in trying to find an alternate solution. Please also note the time frame that it took for Belco to receive approved submittals.
Most submittals took over a month to receive responses to after Belco had submitted them. Keep in mind that Belco has no control over submittal/material lead times.

COST PROPOSALS
With the exception of the T&M work conducted at the beginning of the project, change orders have not been approved quickly often taking days or weeks to process. This has affected how the change order work is scheduled . Keep in mind that change order work is not guaranteed to get scheduled right away.

Elecnor Belco Electric, Inc. Attn: Jason Kison, Project Manager Project: Highway Safety Improvement Program (HSIP) Traffic Signal Improvements at 12 Intersections Federal Project No. HSIP-5430(034) City Project No. C08752 Subject: Final Determination of Contractor's Request for Additional Contract Working Days Dear Mr. Kison, Z&K Consultants has completed its review of Elecnor Belco Electric, Inc.'s request for additional contract working days submitted by correspondence dated April 14, 2026. Following completion of the project, our team has evaluated the request using the complete project record, including the executed contract modifications, Requests for Information (RFIs), certified payroll records, daily inspection reports, meeting minutes, project correspondence, contractor schedules, and other documentation generated during construction. The purpose of this determination is to establish the amount of additional contract time supported by the Contract Documents and to document the basis for the final required contract completion date. The Contractor's request identified several events that were asserted to have affected contract performance, including review of RFIs, processing of change orders, utility coordination, procurement activities, and the Video Detection System (VDS) cabinet compatibility issue encountered during construction. Each item was evaluated independently to determine whether it affected completion of the controlling operations of the Work and whether additional contract time was warranted under the Contract Documents. Where multiple activities occurred concurrently or where previously approved contract adjustments already addressed the impacts, duplicate consideration was not applied. It was also reviewed the timing of approved contract modifications, field progress, and the sequence in which the remaining work was completed to verify the actual effect of each event on contract completion. The original Contract established seventy-two (72) working days beginning December 8, 2025, resulting in an original completion date of March 25, 2026. Approved Change Orders No. 2 and No. 3 increased the Contract by a total of fourteen (14) working days, revising the required completion date to April 15, 2026.
During construction, an incompatibility was identified between the approved Video Detection System equipment and the existing traffic signal cabinet at Gerald Ford Drive and Plumley Road. Resolution of this issue required additional engineering review, evaluation of available installation alternatives, coordination with the equipment manufacturer, and subsequent implementation of an acceptable technical solution. Project records demonstrate that completion of the affected work could not reasonably proceed until those activities had been completed. Accordingly, contract working days associated with the affected operations were not assessed while engineering direction remained pending. Once the technical issue had been resolved, additional contract time was allowed to complete procurement, remobilization, scheduling, and final installation activities necessary to place the signal improvements into service. Based upon review of the complete project record, the following findings were made: 1. Change Orders No. 2 and No. 3 increased the Contract by fourteen (14) working days. 2. The VDS cabinet compatibility issue justified suspension of contract working day assessment while engineering review and technical resolution were underway. 3. Contract working days were administratively suspended between March 20, 2026, and April 10, 2026, representing sixteen (16) contract working days. 4. Following completion of the engineering review, ten (10) additional contract working days were appropriate to accommodate procurement, remobilization, scheduling, and completion of the remaining VDS work. 5. The approved contract adjustments established a final required contract completion date of May 21, 2026. 6. Several events identified within the Contractor's request occurred concurrently, were previously addressed through executed contract modifications, or did not independently delay completion of the controlling work. Accordingly, those activities do not support additional contract time beyond that approved herein. After consideration of the Contractor's request and review of the complete project record, determines that the Contractor is entitled to additional contract working days through May 21, 2026. This determination includes: • Fourteen (14) working days previously incorporated through executed Change Orders No. 2 and No. 3; • Sixteen (16) contract working days administratively suspended while the VDS compatibility issue was under engineering evaluation; and • Ten (10) additional contract working days associated with completion of the remaining VDS activities following resolution of that issue. These adjustments establish May 21, 2026, as the final required contract completion date.
It has determined that the project documentation does not substantiate additional contract time beyond May 21, 2026. Therefore, the remaining portion of the Contractor's request for additional contract working days is denied. This determination is limited to contract time and is based upon the documentation contained within the project record. It shall not be interpreted as a determination regarding monetary entitlement or as a waiver of any rights or remedies available under the Contract Documents. Should additional information become available that materially affects the findings contained herein, the City reserves the right to supplement or modify this determination in accordance with the Contract. Respectfully, Zack Faqih Z&K Consultants, Inc. Construction Manager
