RECOMMENDATION
Accept the CEO’s report on contracts that Ava Community Energy has entered into, as required by the Administrative Procurement Policy, from March 13, 2024 to April 10, 2024;
C-2024-017 Energy & Environmental Economics (E3) First Amendment to Master Services Consulting Agreement, amends all EBCE references to Ava Community Energy ("Ava"), Ava office location, project end date to March 31, 2024, and the budget for services.
C-2024-018 Celery Design Collaborative Sixth Amendment to the Consulting Services Agreement, increases the not-to-exceed amount by $925,000 for a total amount not to exceed of $2,670,000 for the remainder of the term.
C-2024-019 Omni Government Relations, LLC Consulting Services Agreement, (Sacramento, CA) provides state legislative advocacy services, effective January 15, 2024 through December 31, 2024, for a maximum compensation of $115,000.
C-2024-020 Arup North America Second Amendment to Consulting Services Agreement, adds additional compensation, increasing the not-to exceed by $300,000, for a total amount not to exceed of $880,000, and additional services to scope of services CEC GFO 23-606 EV Charging Infrastructure Application Support.
C-2024-021 Ascend Analytics Amendment A to the Software Agreement, amends Exhibit A (Statement of Services, Support, and Service Level Agreement) to provide a SmartBidder Premium bid optimization Software license to Ava, for a two-year term, effective March 21, 2024, for $4,500 per month.

C-2024-022 Sacramento Municipal Utility District (SMUD) Amendment 26 to Exhibit A, Task Order 2, amends Scope of Work for the hard launch of the Ava brand, removing all references to East Bay Community Energy (EBCE) from all customer-facing content so that all webforms, emails, IVR, chat and bill in-line messaging solely reflect Ava.
C-2024-023 J. Tedesco & Associates Consulting Services Agreement, (San Diego, CA) provides CEO recruitment services to Ava, effective March 25, 2024 through August 15, 2024, with maximum compensation of $87,000, payable in 3 equal amounts of $29,000.
C-2024-024 Bay Area Air Quality Management District Amendment No. 3 to 2103- 17497, amends Project Sponsor, replacing all references to East Bay Community Energy with Ava Community Energy Authority, and Section IV, Paragraph 9, by deleting and replacing 9. Indemnification.
C-2024-025 Abbott, Stringham & Lynch Consulting Services Agreement, (Campbell, CA) provides data and security audit services to Ava, effective March 22, 2024 through June 30, 2024, with a max compensation of $10,000.
C-2024-026 Yurgosky Consulting Limited, Inc. Consulting Services Agreement, provides three (3) hours of virtual support for the Salesforce application Loom implementation for a total compensation of $750, with commencement date of April 8, 2024 and completion date of April 12, 2024.
C-2024-027 AT&T Managed Dedicated Internet Service Contract, pricing term is for 36 months effective August 10, 2023, with one-time $1500 fee for Managed Router NRC and $760 per month for 1000 Megabits per second (Mbps) of service.
C-2024-028 DocuSign Order Form, eSignature Business Pro Edition Subscription from April 18, 2024 to April 17, 2026, including Premier Support, cost of $15,525.00.
C-2024-029 DeSpain & Associates Order Form, 12-month IBM Environmental Intelligence Suite subscription at a cost of $5,700, for 200,000 requests per month, with an overage fee of $59.38 fee for additional requests.
