Analysis and Context
The California State Legislature passed Senate Bill (SB) 1305 in 1997, establishing the Power Source Disclosure Program (PSDR) to provide retail electricity consumers “accurate, reliable, and simple to understand information on the sources of energy that are used to provide electric services.” Assembly Bill (AB) 162, passed in 2009, modified the reporting requirements of SB 1305 by requiring all retail suppliers of electricity in California to disclose the sources of the electricity they sell to customers using reporting formats developed by the California Energy Commission (CEC). In 2016, AB 1110 further modified the PSDR reporting requirements, requiring retail sellers to disclose the greenhouse gas (GHG) emissions factor associated with each electricity portfolio. The CEC updated the regulations implementing SB 1305, AB 162, and AB 1100 effective in May 2020. In 2022, SB 1158 was passed which requires the reporting of hourly data starting in 2028 and became effective in June 2025.
Each year, Ava Community Energy (Ava) must 1) submit an Annual Report (the PSDR) to the CEC, detailing its actual resource mix for the previous calendar year, and 2) provide an annual Consent Item 6
Power Content Label (PCL) to customers, showing the percentage breakdown by resource type.
The CEC requires that private retail electricity suppliers engage an auditor to verify the accuracy and completeness of data submitted to the CEC in their PSDR, but allows public agencies the option to instead provide a self-attestation . In May 2024, at its Executive Committee meeting, the Ava Board requested that Ava fulfill its PSDR reporting obligation through engagement with an auditor.
For the 2025 PSDR filing, Ava engaged a consultant to perform an audit of the Bright Choice and Renewable 100 product annual reports. The audit procedure involved validation of facility information, retail sales, generation and retirement data, invoicing and contractual verification, and overall accuracy within the report. Ava’s 2025 PSDR audit was completed on August 31st, 2026, and provided to the CEC with no exceptions found to the filing.
Power Source Disclosure Report and Power Content Label
Each year, Ava reports electricity purchases and retail sales to the CEC through the PSDR, which contains a breakdown of energy purchases over a calendar year for each retail plan, and uses each resource’s GHG emissions factor to calculate the plan’s GHG emissions intensity.
The CEC uses this data from each electricity retail seller serving load in CA to generate a total CA system power mix by source. Additionally, Ava discloses the power mix and GHG emissions intensity for each retail plan, alongside the CA power mix on the PCL, which allows customers to compare their power content to the total California power mix. Ava provides the PCL to customers through a mailer and on the Ava website. The GHG emissions intensity may only be reported through the PCL and not on any other platform.

Methodology
In preparing the PSDR, staff populates the template with electricity purchases from generation that occurred during the calendar year. Delivered renewable energy credits (RECs) are tracked using the Western Renewable Energy Generation Information System (WREGIS) and carbon free purchases, including electricity from Large Hydroelectric generation, are tracked using either meter data or E-tags. The E-tags trace the generation from the source to the delivery location. All the purchased generation is compared against invoices for accuracy, and retail sales are counted using the settlement quality meter data from our accounting service, which is Ava’s system of record for sales. Staff then internally reviews the complete PSDR to ensure accuracy in reporting prior to submission to the CEC.
