ITEM 5: Consider Approval of the 2024 Clean Energy Alliance Legislative and Regulatory Policy Platform
RECOMMENDATION:
Approve 2024 Clean Energy Alliance Legislative and Regulatory Policy Platform.
BACKGROUND AND DISCUSSION:
Clean Energy Alliance’s (CEA) CEA Legislative and Regulatory Policy Platform (Platform) states that the Board shall review and update the Platform as appropriate each January. The Platform serves as a guide to the CEA Board and staff in their advocacy efforts related to policy matters of interest at the state legislature and California Public Utilities Commission (CPUC). It allows both Board Members and staff to pursue actions at the legislative and regulatory levels in a consistent manner and with the understanding that they are pursuing actions in the best interest of CEA and its mission, member agencies and customers. It provides guidance to the Chief Executive Officer to support or oppose positions that should be taken on legislative and regulatory matters that come before the California Community Choice Association (CalCCA) Board of Directors.
The adopted Platform was developed to be consistent with the CEA Joint Powers Authority (JPA) Agreement. Specifically, the JPA Agreement identifies the following purposes of CEA:
• Procuring/developing electrical energy for customers; • Addressing climate change by reducing energy-related greenhouse gas emissions; • Promoting electrical rate price stability and cost savings; • Fostering consumer choice;
• Local economic development, such as job creation, local energy programs, and local power development.
Four basic principles were developed to ensure CEA’s ability to achieve its purposes as stated above.
January 25, 2024
Legislative and Regulatory Policy
Platform
The Platform is centered around these four principles:
1. Protecting CEA’s local control for the purpose of preserving the ability to self-procure power resources, to self-determine rates and the energy programs offered to residents, businesses and the communities it serves, through the mechanisms of local governance.
2. Ensuring fair treatment of CEA customers by the California Public Utilities Commission (CPUC) and other state agencies.
3. Supporting recognition that electricity is an essential service and that CEA should have the ability to set electric rates that are affordable and competitive to the utilities.
4. Pursuing environmental initiatives that exceed minimum State mandates, promote the growth in renewable energy capacity at the local level, encourage clean energy adoption by CEA customers, and reduce fossil fuel dependency.
Considering CEA’s purpose and the principles as detailed above, the Platform establishes the following positions:
• CEA will support legislation and regulatory actions which enables, protects and enhances the development and expansion of Community Choice Aggregation (CCA) programs, and that supports CCA independence in procurement, program deployment, management and decision making.
• CEA will support legislation and regulatory actions which allows CEA to develop and procure local energy generation resources to meet the needs of its electric customers. • CEA will support legislation and regulatory actions which promote a neutral, fair and competitive energy market.
• CEA will oppose legislation and regulatory actions that jeopardize CEA’s independence to self-procure its power resources, determine its rates and the energy programs it provides to its customers in the present, or could restrict its independence to do so in the future.
CEA’s priorities and goals have not changed, and as a result there are no recommended changes to the 2024 Legislative and Regulatory Policy Platform as compared to the 2023 Platform.
FISCAL IMPACT
There is no fiscal impact as a result of this action.

Attachment – Draft 2024 Legislative and Policy Platform CEA-10
2024 Legislative and Regulatory Policy Platform
The Clean Energy Alliance (CEA) Board of Directors desires to establish the 2024 Legislative and Regulatory Policy Platform to guide the CEA Board and staff in their advocacy efforts and engagement on policy matters of interest to CEA. The Platform allows both Board Members and staff to pursue actions at the legislative and regulatory levels in a consistent manner and with the understanding that they are pursuing actions in the best interest of CEA and its mission, its member agencies and its customers. The Platform enables the organization to move swiftly to respond to legislative and regulatory events. The Platform also provides guidance to the Chief Executive Officer on the support or oppose positions that should be taken on legislative and regulatory matters that come before the California Community Choice Association (CalCCA) Board of Directors.
Unless otherwise approved by the Board, all CEA positions on individual bills will be presented to the Board for approval. For urgent legislative or regulatory matters where time is of the essence, the Chief Executive Officer, with Board Chair concurrence, will take a position, consistent with the Policy Platform and report the action to the full Board at the next Board meeting.
Policy Principles
CEA supports legislation and regulatory actions that enables, protects and enhances CEA’s priorities and ability to serve its customers as determined by the CEA Board of Directors.
The Legislative and Regulatory Policy Platform is centered around four basic principles:
CEA will support legislation and regulatory actions which enables, protects and enhances the development and expansion of Community Choice Aggregation (CCA) programs, and that Item 5 Attachment

Item 8 Attachment
Overview
It has been a while (since September); so there is a lot to cover. ● CEA’s Petition for Modification in the Integrated Resource Planning proceeding ● Obtaining RA capacity from Diablo Canyon for CEA
● The 2024 ERRA Forecast case and resulting PCIA rates
● Quick hits:
○ Commission sticks with RA-related limitations on CCA expansions ○ Status of SDG&E rate cases (Phase I and Phase II)
○ Amount and timing of income-graduated fixed charges
2 Integrated Resource Planning
3 ● Issue: SDG&E purchased 49 MW of Resource Adequacy (RA) capacity just before significant CCA departures, including 86,000 departures in Escondido and San Marcos ○ SDG&E required to convey capacity to CEA to cover anticipated departures ○ SDG&E refused to provide enough capacity to account for Escondido and San Marcos ○ CEA and SDCP filed petition to avoid $100-$200M in costs over the next 12 years ○ Original Proposed Decision (in August) denied CEA’s request ● Outcome: Final decision in December reversed coursed; SDG&E now required to convey RA Diablo Canyon Nuclear Power Plant
4 ● Background: Sweetheart deal to keep Diablo Canyon open through 2030 ● Issue: Over $2 billion in capacity value at stake
○ If CEA customers will pay for Diablo Canyon to remain open (they will), its customers should benefit from the plant’s attributes ○ PG&E strongly opposed conveying any RA capacity or GHG-free attributes to CEA and others; CalCCA fought back
● Outcome: December decision agrees with CalCCA’s position SDG&E ERRA Forecast Case
5 ● Background: The Energy Resource Recovery Account (ERRA) case sets the Power Charge Indifference Adjustment (PCIA) rates for CEA customers as well as the generation rate for SDG&E customers
● Issues:
○ SDG&E under-forecasted the RA capacity it would sell in 2024, thereby increasing the PCIA rate for CEA’s customers.
○ A temporary large decrease in bundled customer rates. ● Outcome: Commission adopted CEA’s position on sold RA and the forecasted bundled customer rates
Quick Hits
● RA and CCA Explansion:
○ A June decision established a 1% deficiency threshold for system RA capacity that would will “pause” a CCA’s ability to expand ○ Commission denied CalCCA Application for Rehearing of decision; massive jurisdictional overreach?
● Demand Flexibility: Income-graduated fixed charges
○ SDG&E proposed charges of $34/mo (CARE) and $73/mo (non-CARE) ○ Currently targeting implementation in Q3 of 2025
○ Proposed Decision anticipated in Q1
6 Quick Hits (cont’d)
● SDG&E General Rate Cases:
○ Phase I:
■ Key Issue: No ”forever PCIA” assets
■ Awaiting Proposed Decision
○ Phase II:
■ Key Issue: Rate and tariff design and unfair bill presentation ■ Awaiting SDG&E’s rebuttal testimony

EXECUTIVE SUMMARY
REPORT OF THE CLEAN ENERGY ALLIANCE COMMUNITY ADVISORY COMMITTEE’S
SUBCOMMITTEE ON ADDRESSING UNDERSERVED COMMUNITIES AND POPULATIONS Introduction. The CEA CAC Subcommittee on Underserved Communities and Populations (the “subcommittee”) met for the better part of a year during 2023. The subcommittee prepared a report on its work, its finding, and its recommendations which is attached. This is an executive summary that can be used as a form of expanded table of contents. Each topic is addressed in more detail in the full report.
Goals:
Identify communities and populations in need of extra assistance to achieve CEA’s 100% clean energy goals
Identify funding and programs to meet these needs
Assure equitable distribution of resources throughout CEA’s member cities in rough proportion to their electrical load as required by the CEA Joint Powers Agreement Identifying Communities and Populations in need:
As a starting point use the California Healthy Places Index to identify underserved communities and populations in each CEA member city
Other strategies that may help to identify target communities and populations in CEA member cities may include identifying areas and populations with:
o Low income status
o Senior populations on fixed incomes
o Geographic challenges limiting access to solar
o Housing challenges including multi-unit rental projects, mobile home parks, and tribal communities, especially where there is the challenge of addressing the “split-incentives” 1 between tenants and landlords
o Business communities with special needs or challenges o Non-profit organizations with special needs or challenges o CARE and FERA participants
Opportunities for Addressing the Needs of the Identified Communities and Populations Direct financial aid
Federal and state grant programs
Public Private partnerships
Financing
Club memberships with perks for upgrading to 100% clean energy Clean Energy Champion recognition for homeowners, tenants, landlords, and businesses School outreach programs
Assistance to enroll in regional or statewide clean energy programs not administered by CEA Copying successful programs from other CCAs (The full report gives examples) 1 “Split incentives” occur when capital improvements result in one party paying for improvements while the other party receives the benefits of reduced utility costs and/or cleaner energy sources.

CEA EV Subcommittee meeting, 10/30/23 2pm (Google meet)
Present: Jennifer Kerschbaum, Don Mosier, Roger Davenport, Kevin Norris, Tracy Reed • Review of EV page on CEA website
o Benefits of EV’s section - recommend adding another bullet point which highlights the fact that there is little to no maintenance for EVs relative to gas vehicles. (No oil changes, etc.)
o Overall cost to operate is lower - highlight this on the website as well. Tracy did an analysis on the alternative fuels data calculator - there seemed to be some discrepancies in actuals versus calculator values.
o Vehicle to grid benefit for overall grid - keep this in mind to add to website later as more vehicles are equipped with bi-directional charging and infrastructure becomes more readily available.
o Governor’s mandate that all vehicles sold in CA must be EV by 2035 - There was some disagreement in the group about whether to add this information on the website since it is a divisive topic and potentially off-putting to some website users. The group decided to leave this information off the website for now. o Tracy mentioned that many of the federal tax incentives will go through the EV dealers starting in 2024 - keep this in mind to review website content in Jan as it relates to tax incentives for purchasing EVs.
• EV infrastructure
o Follow up with larger Community Advisory group on coordination effort with member cities Planning and Sustainability Department. We would like to get recommendations from member cities about ideal locations for EV chargers. § Prioritize 20 DC fast charging stations for “travel” consumers - close to freeways and large thoroughfare streets.
§ Next priority is fast charging stations for “regional” consumers - high traffic commercial areas (eg. Walmart, Target)
§ Coordination with Electrify America
• EV subcommittee formal recommendations to the Board of Directors for 2024 o Improve EV section of website -
§ Add information regarding lower cost of maintenance for EVs. § Review link to Alternative Fuels Data Center calculator - is this the best reference for CEA customers? How accurate is it?
o Coordinate with member cities to get ideal locations for 20DC fast charging stations. Research grant opportunities to fund installation of fast chargers in member cities.
Potential Grant opportunities for member cities:
• Communities in charge -
o Funded by California Energy Commission’s Clean Transportation Program o Provides logistical and financial support for installation of level 2 EV charging stations in areas where “communities gather.”
o Charging times are 6-8 hrs for level 2 charging stations. o Applicant is property owner
o Priority to disadvantaged or low income areas
o Incentive amounts will be approx. $3500 per station
• CA CVRP California Clean Vehicle Rebate Project
o These are rebates available to individual consumers of EVs.

ITEM 10: Provide Direction Related to Changes in Community Advisory Committee Structure, Consider Approval of 2024 Community Advisory Committee Meeting Schedule and Workplan, and Appoint Community Advisory Committee Chair
RECOMMENDATION
1) Provide direction related to changes in the Community Advisory Committee structure. 2) Approve 2024 Community Advisory Committee Meeting Schedule and Workplan. 3) Appoint Community Advisory Committee 2024 Chair.
BACKGROUND AND DISCUSSION
Community Advisory Committee Structure
Pursuant to the Clean Energy Alliance (CEA) Community Advisory Committee (CAC) Policy, the CAC is comprised of two (2) appointees from each member agency and a Board Alternate serves as Chair for a total 15 CAC members representing 7 member agencies.
At its January 26, 2023 Regular Board meeting, the Board requested that the following topics be brought to the Board at its January 2024 Board meeting for consideration:
• Should the make-up of the CAC change from 15 active members? • Should the Board adopt a policy that the Chair of the CAC be from a different member agency than the Chair of the Board?
Should the make-up of the CAC change from 14 active member? For the past year, the CAC has been comprised of 15 active members, 2 appointees from each member agency and a Board Alternate that serves as Chair. During the past year, staff did not experience any challenges in administering a CAC of this size. The current CAC is comprised of appointees that are active, motivated and committed to CEA’s goals and success.
January 25, 2024
CAC Workplan
The larger CAC membership provided the ability for the CAC to establish Ad-Hoc subcommittees to research and address issues for recommendations to the Board for consideration. If the CAC membership is reduced, the ability to have subcommittees of a meaningful size would be impacted.
The CAC discussed the current structure and size of the CAC, and the consensus was that they request the Board consider keeping the current structure of 2 appointees from each member agency with a Board Alternate appointed as Chair. Specific input from the CAC included:
• Continue with 2 appointees from each member agency + Board Alternate; • Postpone any change to CAC structure until CEA has been in existence longer and has more experience in the communities;
• Subcommittee work is important & wouldn’t be effective with a smaller CAC make-up • 1 active CAC member from each agency would not be sufficient to gather information from their community.
Staff supports the recommendation from the CAC.
Should the Board adopt a policy that the Chair of the CAC be from a different member agency than the Chair of the Board?
CEA’s Community Advisory Committee Policy establishes that the Board shall appoint a Board Alternate to serve as the Chair of the CAC. At the time the CAC Policy was adopted, the CEA Board consisted of only three cities. Since that time, CEA has grown to now a 7-member organization. There are two questions staff is seeking Board direction on:
• Should the Policy be updated to reflect the CAC Chair can be either a Board Member or Alternate (current Policy states the CAC Chair is an Alternate)? • Should the Policy be updated to reflect the CAC Chair is from a different City than the Board chair?
In the event the Board gives direction to change the Policy, the revised Policy will be brought to the Board at its next regular Board meeting.
2024 Community Advisory Committee Schedule and Workplan Pursuant to the Clean Energy Alliance (CEA) Community Advisory Committee (CAC) Policy, the CEA Board sets the CAC workplan and meeting schedule annually.
