COMMITTEE CHAIR UPDATES
Director Hicks, Chair of the Legislative & Regulatory Committee, reported that at its June meeting, the Committee directed staff to send a letter to the CPUC requesting that CPA customers be eligible for the Self-Generation Incentive Program, regardless of enrollment status in a qualified demand response program. Staff is in communication with the CPUC to resolve the matter favorably. Director Hicks also reported that despite strong opposition, language in AB 306 passed in a separate bill (AB130), making reach codes more challenging to implement. Ted Bardacke, Chief Executive Officer, explained that approximately 12 CPA member agencies are working with staff and outside consultants to adopt reach codes before the October 1, 2025, deadline.
Director Santangelo, Chair of the Finance Committee, reported that the Committee reviewed and approved the proposed minimum hedge percentage related to the amendments to the Energy Risk Management Policy (ERMP).
Director Parkhurst, Chair of the Energy Planning & Resources Committee, reported that the Committee approved negotiations with the SunZia project for an additional 125 MW of power. The Committee also recommended that the Board approve suggested amendments to the ERMP.
MANAGEMENT REPORT
Mr. Bardacke discussed the effects of the 2025 Federal Tax and Spending Bill on clean energy and CPA, including PPAs and ESAs, customer programs, and federal and state direct customer incentives. Mr. Bardacke stated that all of CPA’s current utility-scale wind and solar plus storage projects are operational or have started construction and therefore are substantially derisked. Half of CPA’s current utility-scale unbuilt stand-alone storage projects could meet July 3, 2026, construction start date deadlines, while others are in earlier stages of development. Tariff impacts, separate from the tax bill, will remain unpredictable.
Regarding impacts to customer programs, Mr. Bardacke discussed the Power Ready, Power Share, and Solar and Battery Access programs. Workforce Development program funding could be reduced over the medium term if fewer PPAs were signed. Many direct federal customer incentives will rapidly sunset. CPA’s Sun Storage, Building Electrification, and EV Programs could face reduced demand next year due to higher consumer costs.
Director Belden asked whether CPA would have trouble attracting new customers because of the stress on the green energy industry, and staff responded by stating the agency is well-resourced for the next several years. Director Barrett asked about future energy purchases and other CPA responses to the federal actions. Mr. Bardacke provided information about active RFOs, risk reduction, and adjustments to the pricing and bidding structure.
Staff clarified for Director Gold the storage projects may face challenges in the future due to Foreign Entity of Concern (FEOC) restrictions or other development issues. Director Gold also asked how rebuilding after the January wildfires would be affected by the new federal changes, and staff said incentives and funding, rather than regulation, would help a green rebuild. Mr. Bardacke added that CPA is focusing on restructuring the Power Ready Program that may make it more nimble to address government buildings and schools in the fire impacted areas, as well as across CPA’s service territory.
BOARD MEMBER COMMENTS
Director Rhodes complimented Matt Langer, Chief Operating Officer, for his ability to explain complex technical issues related to CPA’s operations and power contracts.
REPORT FROM THE CHAIR
