Authorize the General Manager of the San Francisco Public Utilities Commission (SFPUC) to execute a Memorandum of Understanding with the San Francisco Recreation and Park Department (SFRPD) setting forth each agency’s respective responsibilities for the
construction, operation, and maintenance of green infrastructure in McLaren Park , as part of the construction by the Wastewater Enterprise Capital Improvement Progr am Upper Yosemite Creek Daylighting Early Implementation Project (EIP).

Background: The purpose of the Upper Yosemite Creek Daylighting EIP (“Project”) is to install green infrastructure in McLaren Park from Yosemite Mar sh to Louis Sutter Playground to provide stormwater runoff and drainage management for 106 acres of SFRPD park land and surrounding areas, thereby protecting and enhancing the use of park property and improving the SFPUC stormwater system . This project is the last of eight stormwater management projects that are being constructed as part of the Sewer System Improvement Program (SSIP) to demonstrate innovative stormwater m anagement practices and reduce combined sew er discharge volume reaching the San Francisco Bay or the Pacific Ocean.

The Project includes:
• Daylighting approximately 1,700 linear feet of Yosemite Creek between Yosemite Marsh and the corner of Wayland
and University Streets;
• Installing a 400-foot section of storm pipe within the public right of way of a one block section of Wayland Street;
• Constructing t hree inline bioretention basins within Louis Sutter Playground to infiltrate stormwater;
Agreement: Authorize MOU between SFRPD and SFPUC for the Upper Yosemite Creek Daylighting Project Commission Meeting Date: January 11, 2022

Secretary, Public Utilities Commission
1 MEMORANDUM OF UNDERSTANDING

THIS MEMORANDUM OF UNDERSTANDING (“MOU”), dated _______ for reference purposes only, is entered into by the San Francisco Recreation and Park Department (“SFRPD”), and the San Francisco Public Utilities Commission (“SFPUC”) regarding the SFPUC’s Upper Yosemite Creek Daylighting Early Implementation Project (“Project”), to be constructed on SFRPD property in McLaren Park.

RECITALS

A. The SFRPD is responsible for managing the parks, playgrounds, recreation facilities, and open spaces under its jurisdiction, under San Francisco Charter Section 4.113. This jurisdiction includes the property known as McLaren Park, which includes areas known as Yosemite Marsh, Louis Sutter Playground, and McNab Lake, located adjacent to Oxford and Wayland Streets as shown in Exhibit A, Project Area.

B. The SFPUC has exclusive charge of the construction, maintenance and operation of infrastructure serving San Francisco’s stormwater and wastewater collection and treatment systems under San Francisco Charter Sections 8B.120, 8B.121, and 8B.122. The SFPUC has adopted a goal of managing stormwater by integrating traditional grey infrastructure with green infrastructure. Green infrastructure consists of a suite of stormwater management tools that use natural processes to manage stormwater and create healthier urban environments.

C. On August 28, 2012, by Resolution No. Resolution 12-0156, the SFPUC authorized SFPUC staff to proceed with planning and development of the Sewer System Improvement Program (SSIP), including eight green infrastructure Early Implementation Projects (EIPs) as part of Phase I of SSIP. The SFPUC’s subsequent planning process identified the Project as a possible EIP project in the Yosemite Watershed that could provide the opportunity to showcase green infrastructure in a cost-effective manner while meeting stormwater management needs and providing socio-economic benefits to the community.

D. On August 15, 2017, the Planning Department determined that the Project is categorically exempt from the California Environmental Quality Act (CEQA) and the CEQA Guidelines under Section 15301 (Existing Facilities, Class 1). The SFPUC then completed a Conceptual Engineering Report for the Project and prepared 35% design drawings in September 2018, which were reviewed by RPD staff in December 2019. The Project is shown in the conceptual plan attached hereto as Exhibit B–1, Site Plan Reach 1, and Exhibit B-2, Site Plan Reach 2.

E. The Project is intended to provide stormwater runoff and drainage management for 106 acres of SFRPD park land and surrounding areas, improving the SFPUC storm and wastewater systems and protecting and enhancing the use of park property. By re-using stormwater for irrigation, the Project may reduce SFRPD’s potable water use by approximately 930,000 gallons per year and could prevent three million gallons of stormwater from entering the combined sewer system (CSS) each year during a typical rainfall year. In addition, the Project could reduce flooding during the five-year three-hour storm by 72,000 gallons per event by detaining water below the Louis Sutter Soccer Field.

Upper Yosemite Creek Daylighting Project at McLaren Park MOU

2 F. The Project includes two main components, the “Yosemite Creek Daylighting Project” and the “Soccer Field Pilot Project.” The Yosemite Creek Daylighting Project will restore the Yosemite Creek’s flow from subsurface pipes to an open water channel, and daylight approximately 1,700 feet of Yosemite Creek between Bacon/Oxford Streets (Yosemite Marsh) and Wayland/University Streets to convey stormwater adjacent to, or within, the right-of-way (ROW) and through McLaren Park before returning to the CSS. An additional 400-foot section of storm drainpipe will convey flow underground through one residential block of Wayland Street, resulting in a total length of the new creek run at 2,100 linear feet. Bioretention basins along the stream channel will allow stormwater to infiltrate into the soil, reducing the volume of stormwater that flows into the combined sewer system. As a pilot, SFPUC will install a high- efficiency irrigation/stormwater re-use system below the Louis Sutter Playground soccer field to irrigate the improved soccer field, thereby reducing SFRPD’s potable water use and improving the soccer field drainage. Also, SFPUC will create a gathering space called the Yosemite Creek Station along the creek near the Wayland and Princeton Streets intersection to provide a public amenity, increase public awareness about San Francisco’s urban watersheds, and deliver education opportunities.

G. The Soccer Field Pilot Project will involve conducting a five-year pilot project to test the high-efficiency irrigation/stormwater reuse system at the Louis Sutter Playground soccer field.

H. The SFPUC has conducted comprehensive public outreach and interagency communication during the planning phase of the Project. Public outreach efforts included community workshops, meetings with community residents and stakeholders, coordination with the District’s Supervisor, and a community presentation at which the outreach findings were discussed and the conceptual design was presented. The SFPUC also coordinated and will continue to coordinate with the San Francisco Municipal Transportation Agency, the Planning Department, Public Works, and the Fire Department.

I. The purpose of this MOU is to memorialize the parties’ rights and obligations with respect to the design, construction and maintenance of the Project, which is intended to provide stormwater management benefits while also making improvements that will enhance the recreational and other benefits provided to the community by McLaren Park.

Any time after ten years after the effective date of this MOU, the Recreation and Park Commission may, by a vote at a publicly noticed hearing, terminate this MOU upon a finding that either of the following conditions has occurred:

i. The Project is causing or has caused damage to the park, or the Project is interfering with park usage. Upon termination, the SFPUC shall remove Upper Yosemite Creek Daylighting Project at McLaren Park MOU

11 the portions of the Project that are problematic and restore the identified portions of the Project Area to its prior condition at its sole expense or provide SFRPD with funds to conduct such removal and restoration itself.

ii. The Project facilities need to be removed in order to accommodate an alternative park use. Upon termination, the SFRPD shall remove the Project at its sole expense.

d. If the SFPUC takes action to terminate the MOU, then the SFPUC shall be responsible for funding and removing the Project improvements that are problematic and restoring the SFRPD’s property to the prior conditions.

11. Dispute Resolution. If a party determines that the other has failed to fulfill its obligations under this MOU, that party shall provide the other with written notice detailing the alleged breach, and within ten days of receipt of such notice, the General Managers (or their designees) of SFRPD and SFPUC shall meet and confer to resolve any such breach.

12. Reserved Rights with Respect to Project Area. The SFRPD reserves the right to use the Project Area for all purposes which are not inconsistent with SFPUC's rights under this MOU; provided, however, that the SFRPD shall not use the Project Area, or permit the same to be used, for any purpose or in any manner which will interfere with the stormwater function of the Project for at least ten years from final completion of Project construction. If, during the aforementioned ten-year period, SFRPD determines that the Project is causing damage to the park or is interfering with park usage SFRPD shall notify SFPUC and the Parties shall use the Dispute Resolution procedure set forth in Section 11 of this MOU to resolve the problem.

2. (PM) Typical / Preventative
Maintenance
PM is a set of maintenance activities performed on
Green Infrastructure at predetermined intervals or
according to prescribed criteria before the
occurrence of a failure. These activities are intended
to protect the installation, reduce the probability of
failure and prevent or eliminate the degradation of
the functions of the installation.

3. (RM) Remedial Maintenance
RM is performed as required, on a scheduled or
unscheduled basis in order to keep the installation in
proper operating condition. This maintenance
consists of a set of activities that are performed to
eliminate an identified source of potential failure
before that failure occurs.

Replace Dead Plants Gravel Mulch
Annually Re‐Mulch HDPE Drain Lines

1. (CM) Corrective Maintenance
CM can be defined as the maintenance which is
required when a portion or component of an
installation begins to fail or has failed. Corrective
maintenance keeps the installation in working order,
or corrects a failure of a component of the
installation that has occurred or is in the process of
occurring. This activity may consist of repair,
restoration or replacement of individual components
of the installation, not the entire installation. A type of corrective maintenance is Emergency
Maintenance
‐ corrective maintenance carried out as
fast as possible in order to bring failed components
of an installation back to a safe and operationally
efficient condition.

2. (R&R) Replacement and Rehabilitation
R&R is the reconstruction and replacement action
performed on an installation after the occurrence of
a failure of the entire installation. The goal of R&R is to rebuild the installation to its original condition
and reestablish the designed performance levels of
the installation. A type of R&R is breakdown
maintenance, which is maintenance performed after
the occurrence of an advanced catastrophic failure
of the entire installation. R&R is different from
Corrective Maintenance in that its activities affect
the entire installation, not just components of the
installation.

The new channel will traverse downslope south along Oxford Street to the corner of Oxford and Wayland Streets, with a base-flow channel designed to contain the LOS-storm, 1 foot wide and a bank-full channel 5.5 feet wide (Figure 3.4). The channel is designed to contain at least the 100-year design flow of 5.5 cubic feet per second (cfs) with a depth of 9 inches.

Before making the turn from Oxford to Wayland Street, the chann el will go under a new foot bridge that connects to the existing pedestrian path. Past this crossing, the channel will widen to 8 feet to slow flows and prevent bend scour along the right bank, which will be armored as an added precaution.

The channel then turns east, conveying flows along a relatively steep block of Wayland Street. A low retaining wall made from reclaimed granite curbs will run along the edge of the hillside/creek from Oxford to Cambridge Street. Periodic dr op structures, currently conceptualized as Corten steel, will provide grade control and dissipate energy (Figure

3.5). This section of the creek channel, which will be terraced and cascade down the edge of Wayland Street for one block, will have a higher conveyance capacity of 10 cfs, based on allowing 10 inches of flow depth over the crest of each weir . (The depth in the intermittent pools within each terrace may be up to 2 feet to s low water and dissipate energy.

Construction of this segment will require digging into the hill side up to approximately 20 feet and removing 12 trees. See Figure 3.8 for a cross-section of the creek channel in this area. For more information, including a map of trees propo sed for removal or transplant, see Appendix P, Tree Inventory Report.

The 100-year peak flow rate discharging from the Reach 1 pipe i nto Bioretention 1 is

8.9 cfs. Flow attenuation in the bioretention facility results in a decreased 100-year peak flow rate of 7.6 cfs in the portion of the creek on the south side of the soccer field.
