Authorize Cost Recovery Agreements with Bureau of Land Management: Consent Calendar Project Manager: Margaret Hannaford

Authorize Cost Recovery Agreement s Not to Exceed the Total Sum of $100,000 between the San Francisco Public Utilities Commission and the United States Department of the Interior, Bureau of Land Management (BLM), to reimburse the BLM for costs incurred to correct the mapped boundary of the Canyon Tunnel and Aqueduct Right of Way Grant within Yosemite National Park.

Summary of
Proposed
Commission Action:

Authorize the General Manager of the Sa n Francisco Public Utilities Commission to execute a Cost Recovery Agreement with the United States Bureau of Land Management (BLM) to reimburse the BLM for costs of $22,106.74 to correct the mapped boundary of a right-of-w ay grant for the Canyon Power Tunnel and Aqueduct; and authorize the General Manager to amend the Cost Recovery Agreement, or enter into a new Cost Recovery A greement, to re imburse the BLM for additional reimbursable expenses of up to $77,893.26 if the BLM incurs reimbursable costs over $22,106.74, for the total potential not- to-exceed sum of $100,000.

Background: Recent San Francisco Public Utilities Commission ( SFPUC) surveys disclosed that the surveyed as-built location of the Canyon Tunnel and appurtenant facilities deviates from the approved right -of-way boundary location shown on Map R -527 (E xhibit A of the proposed Agreement) regarding the right-of-way grant to the City and County of San Francisco ( City) by the U.S. Department of the Interior under the 1913 Raker Act (38 Stat. 232, BLM right-of wa y no. CAS 0010130).

Under 43 Code of Federal Regulations 2807.11(e), a grant holder must contact the BLM to identify and correct discrepancies or inconsistencies in a grant.

On October 13, 2020, by Resolution No. 20-0211, this Commission authorized SFPUC staff to apply to the BLM to correct the Canyon Tunnel right-of-way boundary grant issued under the Rake r Act and delegated to the General Manager or his designee the authority to accept the revised Raker Act right-of-way boundary and seek Board of Agreement: Cost Recovery Agreement with Bureau of Land Management Commission Meeting Date: January 25, 2022

Supervisors (BOS) approval under San Francisco Charter Sec tion

9.118 without further Commission action.

The Hetch Hetchy Water and Power ( HHWP) D ivision prepared Application Map CT -17027-00 (Application) to correct the approved right-of-way boundary location shown on Map R- 527 to accurately portray the as -built lo cations of the Canyon Tunnel and related appurtenant facilities (SFPUC Facilities) in Yosemite National Park used by the City to construct, operate, and maintain this infrastructure.

On October 16, 2020, SFPUC staff submitted the Application to the BLM to correct Raker Act grant no. CAS 0010130 to conform the mapped boundary to the existing as-built loca tions of the SFPUC Facilities. T he BLM consulted with Yosemite National Park and SFPUC staff during review of the Application.

Upon initial review of the SFPUC’s Application, the BLM determined that BLM staff would spend over 50 hours to process the Application.

The BLM is required to recover its full reasonable costs for project - related work under 43 CFR 2804.19. The method and procedures for the SFPUC ’s payment of costs are included in the proposed Cost Reimbursement Agr eement, including th e costs for the following work:
(1) The BLM will revise the BLM Master T itle Plat to reflect the correct surveyed as -built locations of the Canyon Tunnel, Hetch Hetchy Adit and the access ro ads to the SF PUC
Facilities located within the boundaries of the Yosem ite National Park; and
(2) The BLM will adjust the Spoils Area boundary the SFPUC needs for the continued operation and maintenance of SFPUC Facilities.

Due to the complexity of the proposed bounda ry correction and the need to reach agreement with Yosemite Na tional Park staff on adjusting the Canyon Tunnel Spoils Area boundary, the BLM may ask the SFPUC to provide additional funding for reimbursem ent of BLM staff costs in a future amendment to the Cost Recovery Agreement or a new Cost Recovery Agreement.

SFPUC staff recommends that this Commission approve the Cost Recovery Agreement. In addition, SFPUC staff requests that this Commission delegate authority to execute an amendment to the Cost Recovery Agreement, or to execute a new Cost Recovery Agreement , if the BLM incu rs costs over $22,106.74 in connection with the boundary correction to reimburse the BLM for addi tional incurred reimbursable expenses of up to $77,893.26 for a total potential not-to- exceed sum of $100,000.

BLM’s tasks in processing the requested corrections to the existing grant include, but are not limited to, the following:

 Correct Map exhibit and geospatial data for the ROW grant to match the existing as-built location of existing facilities, including access roads.  Revise geospatial data and BLM Master Title Plat to amend the Spoils Area portion of the ROW to show areas relinquished and areas retained for required ongoing operation and maintenance of Project facilities.
 Final BLM Authorized Officer decision to correct the Right of Way Grant  Any other necessary and reasonable administrative actions to be incurred consistent with the Project.

If payments made by the Holder exceed costs incurred, BLM will promptly refund the excess.

If the Holder still objects to the entry or cost item, Holder may submit an appeal to the State Director within 30 days of receipt of BLM’s justification.

The State Director’s decision is the final administrative decision related to such entry or cost item.
