Summary of
Proposed
Commission Action:
Authorize the General Manager to execute a Memorandum of Understanding with the San Francisco Municipal Transportation Agency (SFMTA) to set forth the agencies’ respective responsibilities , including cost sharing allocations, to jointly replace the San Francisco Public Utilities Commission’s (SFPUC) water and sewer facilities and/or relocate them away from the new railway tracks along Taraval Street, from Sunset Boulevard to West Portal, as part of the SFMTA’s construction of Segment B of the L -Taraval Transit Improvement Project – Sunset Boulevard to West Portal, for a total estimated cost to the SFPUC of $33,760,678.
Background: With assistance from the Federal Transit Administration (FTA) of the U.S.
Department of Transportation and other granting agencies, SFMTA is constructing the L- Taraval Transit Improvement Project, which includes the replacement and upgrade of aging infrastructure on Taraval Street from SF Zoo to West Portal, including the comple te replacement of MUNI rails and track support structure and the rehabilitation of the overhead contact system (Project). The SFMTA is completing the Project in two segments : Segment A is the portion of the Project from SF Zoo to Sunset Boulevard (Segment A); and Segment B is the portion of the Project from Sunset Boulevard to West Portal (Segment B).
The SFMTA and the SFPUC desire to minimize community impacts from disrupting the public right -of-way multiple times and avoid the expense and inefficiency of destroying and replacing new SFMTA surface features in the future to access underlying utilities.
In October 2019, by Resolution No. 19-0196, SFPUC Commission authorized the General Manager to execute a MOU with SFMTA to share costs in the modification of SFPUC’s water and sewer facilities for Segment A , which included an Approval Action for SFPUC’s water and sewer facilities for the Agreement: Authorize Memorandum of Understanding between the San Francisco Public Utilities Commission and the San Francisco Municipal Transportation Agency
Commission Meeting Date: February 8, 2022
purposes of California Environmental Quality Act.
For Segment B, the SFMTA and the SFPUC propose to e nter into a Memorandum of Understanding (MOU) for the purpose of defining the terms and conditions by which the SFMTA and the SFPUC will jointly relocate and/or replace existing water lines (“Water Work”) and relocate and/or replace existing sewer lines (“Sewer Work”) (collectively, “SFPUC Work”) on Taraval Street, from Sunset Boulevard to West Portal.
The SFPUC Work is as follows:
• The Sewer Work generally consists of work related to relocating main sewers to each side of Taraval Street to create a twin sewer system; replacing sewer facilities; constructing necessary drainage facilities due to Project changes of street width configurations and grades; and replacing existing side sewers and culverts, all as detailed in Exhibit A of the MOU . The Sewer Work is considered part of the SFPUC’s Sewer System Improvement Program (SSIP).
• The Water Work generally consists of work related to replacing existing water facilities, including water mains, service laterals, and hydrants, along with installing new facilities necessary to create a parallel water main system on both sides of the Muni tracks to eliminate water mains and service laterals crossing under the tracks (except at roadway intersections), as further described in Exhibit B of the MOU. This work is part of the SFPUC’s Linear Asset Management Program (LAMP).
All construction work for the Segment B of the Project, including the SFPUC Work, will be performed as part of SFMTA Contract No. 1308R . The cost sharing allocations between the SFMTA and the SFPUC that are set forth in the MOU, and further detailed in Exhibit C of the MOU, represent the construction contract costs, including assigned contract allow ances plus a 10 percent contingency. In addition, the cost sharing allocations include non- const
ruction contract costs including, but not limited to, construction management, traffic engineering construction support, outreach, and bus substitution.
Description of
Agreement:
This MOU sets forth the terms and conditions by which the SFMTA and the SFPUC will jointly relocate and/or replace the SFPUC’s water and sewer facilities along Taraval Street, from Sunset Boulevard to West Portal , in conjunction with the SFMTA’s construction of Segment B of t he Project, while minimiz ing community impacts in disrupting the public right -of-way multiple times, and avoid ing the expense and inefficiency of destroying and replacing new SFMTA surface features in the future to access underlying utilities. Further, the MOU establishes a cost sharing arrangement between the SFPUC and the SFMTA for Segment B of the Project, with a total estimated cost to the SFMTA of $59,749,004, and a total estimated cost to the SFPUC of $33,760,678.
Agreement: Authorize Memorandum of Understanding between the San Francisco Public Utilities Commission and the San Francisco Municipal Transportation Agency
Commission Meeting Date: February 8, 2022
Result of Inaction: A delay in authorizing the General Manager to execute this MOU would result in a delay to the SFMTA’s L-Taraval Transit Improvement Project and associated SFPUC Work for Segment B of the Project, including the relocation and/or replacement of existing water and sewer facilities along Taraval Street, from Sunset Boulevard to West Portal.
Funding, Budget and
Costs:
The SFMTA’s and SFPUC’s respective shares of the total costs for Segment B of the Project are shown in the table below and further detail ed in Exhibit C of the MOU. The SFMTA’s total estimate d cost is $59,749,004. The SFPUC’s total estimated cost is $33,760,678, consisting of $13,195,872 and $20,564,806 for the Water and Sewer Work , respectively . These estimates include the construction contract costs ( including assigned contract allowances ); a 10 percent construction contingency; and SFMTA’s labor estimates (including project management, construction management, and bus substitution) . The construction cost allocations between SFMTA and the SFPUC are based on the bid items for the various work components of Segment B of the Project. The cost share allocations for project management, construction management, and other non-construction costs between SFMTA and the SFPUC are generally in direct proportion to the construction cost allocations of the various work components of Segment B of the Project.

MEMORANDUM OF UNDERSTANDING
BETWEEN THE PUBLIC UTILITIES COMMISSION AND
THE MUNICIPAL TRANSPORTATION AGENCY
This Memorandum of Understanding (MOU) is entered into on MM DD, 2022, between the San Francisco Public Utilities Commission (SFPUC) and the San Francisco Municipal Transportation Agency (SFMTA) for the purpose of defining the terms and conditions by which the SFPUC will modify the water and sewer facilities in conjunction with the SFMTA’s construction of Segment B of the L-Taraval Improvement Project – Sunset Boulevard to West Portal.
RECITALS
A. With assistance from the Federal Transit Administration (FTA) of the U.S.
Department of Transportation and other granting agencies, the SFMTA is constructing the L- Taraval Improvement Project, which includes the replacement and upgrade of aging transit infrastructure on Taraval Street from SF Zoo to West Portal, including the complete replacement of Muni rails and track support structure and the rehabilitation of the overhead contact system (Project). The SFMTA will complete the Project in two segments. Segment A, which has been completed, is the portion of the Project from SF Zoo to Sunset Boulevard; Segment B, which is the subject of this MOU, is the portion of the Project from Sunset Boulevard to West Portal.
B. The Project is part of the SFMTA’s Citywide Transit Effectiveness Project (TEP) (now known as “Muni Forward”). On March 27, 2014, the San Francisco Planning Commission in Motion No. 19105 certified the Final Environmental Impact Report (FEIR) for the TEP. On March 28, 2014, in Resolution No. 14-041, the SFMTA Board of Directors approved all of the TEP proposals, including Service-Related Capital Improvements and Travel Time Reduction Proposals (TTRP) to improve transit performance along various Municipal Railway (Muni) routes. As part of Resolution No. 14-041, the SFMTA Board of Directors adopted California Environmental Quality Act (CEQA) Findings and a Mitigation Monitoring and Reporting Program (MMRP) for the TEP. Many of the Project elements are within the scope of the “TTRP.L: L Taraval Expanded Alternative,” as defined in the FEIR. For those elements not included in the TEP FEIR, on August 10, 2016, the San Francisco Planning Department (Planning) issued a Note to File (Case Number 2011.0558E, “Modification to Travel Time Reduction Proposal L for the L Taraval [TTRP.L] along Taraval Street between the intersections of 15th Avenue and 46th Avenue, on 15th Avenue from Taraval Street to Ulloa Street, and on 46th Avenue from Taraval Street to Ulloa Street”) to the TEP FEIR, concluding the proposed changes (“Muni Forward Modified Expanded TTRP.L”) would not cause new significant impacts not identified in the FEIR or result in a substantial increase in the severity of previously identified significant impacts, and no new mitigation measures would be necessary to reduce significant impacts.
C. On December 15, 2017, Planning determined that the Project’s proposed transit infrastructure improvements (Rail Replacement and Overhead Rehabilitation) are categorically exempt from CEQA.
D. To minimize the community impacts associated with disrupting the public right-of- way multiple times, and to avoid the expense and inefficiency of destroying and replacing new SFMTA surface features in the future to access underlying utilities, the SFMTA and the SFPUC will be jointly replacing and installing SFPUC sewer and water lines and/or relocating them away from the new SFMTA surface features at the same time that the SFMTA is constructing the Project.
01/04/2022 n:\ptc\as2019\1000392\01377304.docx E. On April 14, 2018, Planning determined that the Project’s proposed sewer work is categorically exempt from CEQA. On May 24, 2018, Planning determined that the proposed water main replacement is categorically exempt from CEQA.
F. On October 5, 2021, through Resolution No. 211005-114, the SFMTA Board of Director authorized the award of Contract No. 1308R (Contract) to NTK Construction Inc. (Contractor) for construction of Segment B of the Project. The SFMTA Plans to issue a notice to proceed on December 1, 2021.
G. The purpose of this MOU is to set forth the terms and conditions by which the SFMTA and the SFPUC will share the costs of modifying the SFPUC’s water and sewer facilities in conjunction with SFMTA’s construction of Segment B of the Project.
