Award Agreement No. PRO.0232, New CDD Campus at 2000 Marin Design Services
Summary of
Proposed
Commission Action:
Approve the selection of Mark Cavagnero Ass ociates (MCA); award Agreement No. PRO.0232, New CDD Campus at 2000 Marin Design Services, to provide architectural, engineering, and consulting services to design new facilities for the San Francisco Pu blic Uti lities Commission (SFPUC) Water Enterprise City Distribution Division (CDD) at 2000 Mar in Street, San Francisco , to MCA; authorize the General Manager to execute a professional services agreement with MCA for an amount not -to-exceed $27,800,000 and with a duration of five years , subject to Board of Supervisors’ approval under San Francisco Charter Section 9.118; and request that the Board of Supervisors grant an exception from the Cam paign and Governmental Conduct Code for the Social Impact Partnership provisions of the Agreement.
Background: The CDD oversees w ater distribution within City limits. The CDD is responsible for the infrastructure of the City’s water system, oper ating and maintaining its reservoirs, pump stations and approximately 1,250 miles of water pipes ; managing the City’s meter program ; and mai ntaining CDD facilities, equipment, and fleet vehicles. The current CDD campus, located at 1990 Newcomb Avenue, has served as CDD’s main facility for almo st six decades.
Due to the exponential growth of service demands over the decades and challenges wi th maintaining operations at a facility that has exceeded its useful life, SFPUC has an acute need for the design and construction of a new headquarters facility to alleviate overcrowding, address building code and safety issues, eliminate inefficiencies, and accommodate CDD’s current and future operational needs.
Description of Scope
of Services:
The Consultant will be responsible for:
• Design of a new campus consisting of five buildings , including an office building, two industrial shop buildings, a warehouse, and a parking structure for a total of approximately 371,000 gross square Agreement: PRO.0232, New CDD Headquarters at 2000 Marin Commission Meeting Date: February 22, 2022
feet;
• Managing all engineering and specialty subconsultants; • Coordinating all design efforts toward a complete, efficient, functional and operational facility;
• Overseeing construction administration tasks during construction; and • Delivering Social Impact Program (SIP) benefits to the community, to which MCA voluntarily committed in its Proposal, conditioned on Board of Supervisors (BOS) adoption of an ordinance exempting Agreement No. PRO.0232 from the recently enacted legislation prohibiting behested payments ( Board of Supervisors Ordinance No. 232-21 (Board File No. 201132), which amended the Campaign and Government Conduct Code effective January 23, 2022 ). Subject to award and approval of this Commission, SFPUC will submit the proposed ordinance as a companion mea sure to its request for BOS approval of the agreement under Charter Section 9.118. I f the BOS does not pass the ordinance exempting Agreement No. PRO.0232 from the behested payments prohibition, staff will remove MCA’s SIP obligations from Agreement No. PRO.0232 prior to execution of the agreement.
Environmental
Review:
Authorization to execute this professional services agreement does not fall within the definitio n of a “project” under the California Environmental Quality Act ( CEQA) Guidelines Section 15378 because work under the agreement will consist of design and support services only, and no support during Start -up, Construction and Closeout services wi ll be in itiated under this contract until CEQA review is complete and until this Commission has reviewed and considered the CEQA determination and has approved the project. Approval of individual task orders under this c ontract for activities such as geo technical investigations would require compliance with CEQA prior to initiation of ground-disturbing activities.
Authorization to execute this professional services agreement is not an approval of any proposed project and SFPUC retains discretion to, among other th ings, modify the proposed project(s) to mitigate significant environmental impacts, require the implementation of specific measures to mitigate any significant environmental impacts of the project(s), or cancel the project, following completion of environmental review.
Result of Inaction: A delay in award ing this agreement will delay correction of the inadequacies of existing facilities, increase escalation costs , and negatively impact funding and schedules for other critical Water Enterprise infrastructure programs.
Agreement: PRO.0232, New CDD Headquarters at 2000 Marin Commission Meeting Date: February 22, 2022

Evaluation and
Selection Criteria:
Minimum Qualifications
The minimum qualifications set forth below were required for a Proposer to be eligible to submit a proposal in response to the RFP.
Prime Proposer or Joint Venture (JV) Partners Minimum Qualifications • 15 years demonstrated experience as the Lead Architect during design and construction on at least one (1) civic or industrial completed project with a minimum project construction value of $80,000,000 that included two or more buildings within the last 15 years.
• Experience managing five or more subconsultants as Lead Architect during design and construction on a minimum of three completed projects, each with a minimum of $50,000,000 construction value, within the last 10 years.
• Experience as Lead Architect during design and construction on a minimum of two completed projects utilizing an integrated project delivery method, which involved preparation of early trade packages between 65% and 95% completion of design, each with a minimum of $50,000,000 construction value within the last 10 years.
• Experience as a Lead Architect coordinating with design-build or construction manager/general contractor (CMGC) subcontractors during design and construction on a minimum of two completed projects with a minimum of $50,000,000 construction value within the last 10 years.
Non-Leading JV Partner Minimum Qualifications
Experience as Lead Architect on a minimum of two projects with a minimum construction value of $25,000,000 that included one or more of the following occupancy types: office, warehouse, or industrial shops, completed within the last 15 years.
Subconsultant Qualifications
A proposed Subconsultant providing technical services described in the RFP was Agreement: PRO.0232, New CDD Headquarters at 2000 Marin Commission Meeting Date: February 22, 2022
required to possess at a minimum the following qualifications. The SFPUC strongly encouraged Proposers to engage in positive efforts to utilize diverse, local firms as subconsultants for this project.
• A minimum of five years performing one of the technical fields required under the scope of services AND have a principal or partner with at least 10 years professional design experience in that field. The five -year "in business" and the 10- year principal/partner experience requirements, set forth above, are separate and distinct; one cannot be substituted for the other.
Evaluation and Selection
The evaluation and select ion process consisted of four phases : (1) Written Proposal, (2) Oral Interview , (3) Overhead and Profit Schedu le (OPS) , and (4) Social Impact Partnership Submittal evaluation . The consultant teams could be awarded up to a maximum of 1,000 points: 500 point s for the written proposal phase, 350 points for the oral interview phase , 100 points for the OPS, and 50 points for the Social Impact Partnership Submittal.
The technical evaluation panel consisted of individuals knowledgeable on the subject matter and i ncluded staff from Public Works, the Airport, and CDD. The panel reviewed and ranked the consultant te ams during the written proposal and oral interview phases. A separate panel of community benefits experts evaluated the Social Impact Partnership Submittal.
SFPUC received three proposals in response to the RFP: (1) Mark Cavagnero Associates, (2) KMD Architects, and (3) Dreyfuss and Blackford Architecture.
The SFPUC determined that the proposals from KMD Architects and Dreyfuss and Blackford Architectur e were not responsive to the RFP due to errors in their respective Overhead and Profit Schedules. Contrary to the clear instructions of the RFP, both proposers listed more than one multip lier for a single firm. This was a material defect because the Over head and Profit multiplier, as a component of the Evaluation Criteria, could not be calculated as provided in the RFP. As a result, Staff rejected these proposals as non-responsive.
SFPUC Staff therefore recommends award to the sole, qualifed proposer submitting a responsive proposal, Mark Cavagnero Associates.

Revised CMD Award Review
The Contract Monitoring Division (“CMD”) reviewed the consultant proposals and supporting documentation and applied the appropriate rating bonuses submitted for the above referenced project. Based on this review, CMD determined that out of the three (3) proposals submitted all were materially compliant with the pre-award Chapter 14B requirements:
Dreyfuss + Blackford Architecture
KMD Architects
Mark Cavagnero Associates
Rating Bonus
The rating bonus does not apply for contracts estimated by the awarding department which exceed $20 million dollars.
Score Sheets and Score Tabulations
CMD reviewed the SFPUC tabulations for the written proposal, Social Impact Partnership submittal, oral interview, and OPS scores.
Based on the SFPUC’s determination issued on February 13, 2022 and February 14, 2022 respectively, both KMD Architects and Dreyfuss + Blackford Architecture were deemed non- responsive and ineligible for further consideration by the SFPUC. As a result, Mark Cavagnero Associates (“MCA”) became the sole remaining responsive proposer.
The RFP indicates that the contract will be awarded to the highest ranked proposer.
