Authorize Designation of Sole Source Supplier in Contract Documents: Regular Calendar Project Manager: Jignesh Desai

Authorize Designation of Sole Source of Distributed Process Control Supplier for Contract DB-132 New Treasure Island Wastewater Treatment Plant

Summary of
Proposed
Commission
Action:

Authorize the General Manager of the San Francisco Public Utilities Commission (SFPUC) to designate a specific brand of distributed- process control system by Emerson Process Management in the contract documents to match other products in use and ensure system -wide consistency , for Wastewater Enterprises, Design -Build Contract No. DB-132 New Treasure Island Wastewater Treatment Plant , in conformance with San Francisco Administrative Code Section 6.73( e) and Public Contract Code Section 3400(c)(2).

Background: The Naval Station Treasure Island is a former United States Navy base located in the City that consists of two islands, Treasure Island (TI) and Yerba Buena Island (YBI), connected by a causeway. Based on the Memorandum of Understanding (MOU) between Treas ure Island Development Authority and the SFPUC, the SFPUC has been operating and maintaining TI and YBI existing utility systems. This includes an ongoing development project at TI.

The scope of this complex, phased 15- to 20 -year, development project includes: demolition of existing buildings and utilities, geotechnical improvements, construction of 8,000 new homes, and construction of new wastewater and stormwater infrastructure. SFPUC is responsible for the planning, design, and construction of the new Treasure Island Treatment Plant.

On April 23, 2019, by Resolution 19- 0082, the Commission approved the project delivery method of Design-Build- Operate for Project No. CWP11001, New Treasure Island Wastewater Treatment Plant . Subsequently, after collaboration with Operating Engineers and various stakeholders, the General Manager and Assistant General Manager of Wastewater requested removal of the Operation component and requested to solicit proposals as Design- Build delivery method.

On August 5, 2020, SFPUC advertised the Request for Qualifications for DB- 132 New Treasure Island Wastewater Treatment Plant. On September 22, 2020, SFPUC received responses from two proposers. SFPUC evaluated and pre - qualified the two firms for the Request for Proposals for DB-132 New Treasure Island Wastewater Treatment Plant.

On December 27, 2021, SFPUC advertised Request for Proposal s for DB-132 and invited the two pre-qualified proposers to submit fixed budget Design-Build proposals by April 22, 2022.

On February 8, 2022, SFPUC held pre-submittal conference and on February 9, 2022, SFPUC held site walk with two pre-qualified proposers.

One of the key components of the New Treasure Island Treatment Plant is the Distributed Control System (DCS). The DCS is an integrated platform for automated control, supervision, and operation of a plant and its various processes. It is a complex network of microprocessor controllers and communication devices which combines human machine interface, logic solvers, alarm management, and other databases into a unified system. DCS enables Wastewater Enterprise to maintain compliance with regulatory agency requirements, protect the health and safety of the citizens of San Francisco, and protect the waters of the San Francisco Bay and Pacific Ocean.

On February 24, 2015, by Resolution No. 15-0051, the Commission authorized the General Manager to issue a Request for Qualifications, issue a subs equent Request for Proposals (RFP) using a design build delivery method, receive proposals, conduct a selection process, and negotiate a Design Build Agreement for Wastewater Enterprise (WWE) Distributed Control System Upgrades.

On December 13, 2016, by Resolution No. 16-0099, this Commission awarded Contract No. DB -126, WWE Distributed Control System Upgrades, a Progressive Design-Build Agreement to Emerson Process Management Power & Water Solutions, Inc.

DCS upgrades have been completed at the Bruce Flynn Pump Station. DCS upgrades for the Southeast Plant New Biosolids Digester Facility Project and New Headworks Facility Project will also be implemented with the Emerson Process Management Power & Water Solutions, Inc.

DCS upgrades using
Emerson Process Management is also planned at Oceanside Treatment Plant, North Point Facility, and various major pump stations throughout the City.

Chapter 6.73(e) of the SF Administrative code states that designation of a name- brand product or service in an RFP must comply with Public Contract Code (PCC) 3400. PCC 3400(c)(2) states:

The restriction on specifying products or services “is not applicable if the awarding authority, or its designee, makes a finding that is described in the invitation for bi ds
or request for proposals that a particular material,
product, thing, or service is designated by specific brand or trade name … [i]n order to match other products in use on a particular public improvement either completed or in the course of completion.”

Environmental
Review:

This action does not constitute a "Project" under California Environmental Quality Act (CEQA) Guidelines Section 15378 because authorization to designate a specific brand of distributed- process control system is not an approval of the proposed New Treasure Island Wastewater Treatment Plant and SFPUC retains discretion to, among other things, modify the proposed New Treasure Island Wastewater Treatment Plant project to mitigate significant environmental impacts, require the implementation of specific measure s to mitigate any significant environmental impacts of the project, or reject the project, following completion of environmental review.

To ensure system-wide consistency of the WWE DCS and to match Emerson DCS process control systems that are in use and are planned for major upgrades through Wastewater Capital Program, SFPUC staff is requesting to designate Emerson Process Man agement as the DCS provider for the DB -132 New Treasure Island Treatment Plant contract documents.

Summary of
Specified
Equipment:

Emerson Process Management - Distributed Control System and ancillary equipment

Result of Inaction: A delay or denial will lead to reduced WWE operational efficiency across various facilities, increased risk of human errors and potential non-compli ance with regulatory agencies.

Evaluation and
Selection Criteria:

The business case study, evaluation and selection of Emerson Process Management had been completed under CWWSIPSE07 SEP Facility- Wide DCS Control Upgrades Project.

Recommendation: SFPUC staff recommends that the Commission approve the sole source request.
