Background: The purpose of this project is to rehabilitate the existing sewers on Mission Street, between 16th and Cesar Chavez Streets, in San Francisco.

These 100-year-old sewers are mostly 3-foot by 5- foot brick sewers . A condition assessment performed by the project team concluded that these sewers are at the end of their service life.

As part of the project , the San Francisco Public Uti lities Commission (SFPUC) included non-sewer work in the contract: (1) to address utility conflicts; and (2) to reduce public impacts by including approved work scopes from the San Francisco Municipal Trans portation Authority (SFMTA). The non-sewer scopes of work included in the contract are:
• Relocation of existing Emergency Firefighting Water System (EFWS) pipelines from inside the existing sewers; this portion of the work is funded by Water Enterprise Earthquake Safety and Emergency Response (ESER) Bond Program; and
• Transit improvements on Mission Street from the approved “MUNI Forward Service-Related Capital Improvements and
Travel Time Reduction” project, funded by SFMTA.

On August 25, 2020, by Resolution No. 20- 0181, this Commission awarded Contract No. WW -703, Mission Street, 16 th to Cesar Chavez Contract: WW-703 Mission Street, 16th to Cesar Chavez, Brick Sewer Rehabilitation Commission Meeting Date: May 10, 2022

• Relocation of EFWS pipelines and associated appurtenances to allow for sewer rehabilitation;
• Restoration of roadway and other restoration-in-kind work associated with the sewer and EFWS work; and
• Various transit improvement work, including new bus pads, traffic signals and associated sidewalks and curb ramps restoration as part of the MUNI Forward Service-Related Capital Improvements and Travel Time Reduction Project (funded by SFMTA).

Changes and Modifications to the Contract:

Section 6.22(h) of the Administrative Code provides that any cumulative increase of the contract amount or duration in excess of 10% of the original contract amount or duration requires this Commission’s approval.

Modification Nos. 1 to 5 de creased the contract amount by $182,841 (within 10% budget contingency) to remove the transit improvements scope and to perform television inspection of sewers, additional sewer cleaning, removal of protruding bricks from existing sewers and spray - mortaring existing brick sewer, and increased the contract duration by 35 consecutive day s (within 10% duration contingency) for non- compensable delay based on EFWS material delivery delay, for a total contract amount of $
6,154,509 and a total contract duration of 395

CONTRACT MONITORING DIVISION

OFFICE OF THE CITY ADMINISTRATOR

MEMORANDUM

Date: March 25, 2022

To: Suzanne Huang, Project Manager, SFPUC

From: Vivian Liu, Contract Compliance Officer, CMD

Subject: CMD’s Closeout Review for WW-703 Mission Street, 16 th to Cesar Chavez, Brick Sewer
Rehabilitation

The Contract Monitoring Division (“CMD”) has determined that Cratus Inc. (“Cratus”), the prime contractor for this project, has substantially complied with the Chapter 14B LBE subcontracting requirements associated with this project.

At the time the project was advertised, an LBE subcontractor participation requirement of 6% was established. Cratus’s Subcontractor List (Document 00 43 36) reflected an LBE subcontractor participation commitment of 11.60%. Cratus was awarded the contract in the amount of $6,337,350.

After six (6) change orders, the final contract amount is $6,061,536.10. At closeout, the LBE subcontractor participation is as follows:

TOTAL $735,840.00 11.60% $422,953.31 6.97%

Pursuant to communication with Cratus and confirmed by the SFPUC, Change Order #4 was a deductive change order that deleted scopes of work related to the sidewalk bulb-out at 20 th/Mission, including:
bulb-out work, traffic signal/pole work, curb ramp work, transit shelter mat work, and drainage work.

These deletions resulted in a $120,847.09 reduction in Bay Area Lightworks’ scope of work and a $393,436.00 reduction in R&S Construction Management’s (“R&S”) scope of work. In good faith, Cratus

offered R&S streetbase and sidewalk concrete work remaining on Mission Street. R&S declined the work due to scheduling conflicts. Furthermore, in good faith, Cratus gave Total Traffic Control additional traffic control work and added Ronan Construction onto the project to perform paving and sawcutting work on Mission Street.

Based on the foregoing, CMD concurs with the closeout of this contract.
