MEMORANDUM
Date: June 10, 2022

To: Saed Touli, SFPUC
Jeff Young, SFPUC

From: Linda Rainaldi, CMD
Subject: Closeout for WW-702R Jackson, Griffith, and Pierce Streets Combined Sewer Discharge Rehabilitation and Backflow Prevention

The Contract Monitoring Division (“CMD”) has determined that Trinet Construction Inc. (“Trinet”) has substantially complied with the LBE subcontracting requirements associated with this project.

At the time the project was advertised, an LBE subcontracting requirement of 14% was established.

Trinet’s Subcontractor List (Section 00 43 36) reflected an LBE subcontractor participation commitment of 14.15%. Trinet was awarded the contract in the amount of $ 3,886,300.00. After two (2) change orders, the final contract amount is $ 3,967,816.10. At closeout, the LBE subcontracting participation is as follows:

TOTAL $550,000.00 14.15% $550,000.00 13.86%

Pursuant to the correspondence provided by the Prime and the SFPUC, the contract change orders impacted included a large portion of work which required a specialty marine/diving subcontractor to perform, of which R&S Construction Management, Inc. is not licensed nor experienced to perform. Per the Prime and the SFPUC, the contract increase which did include additional concrete work required that the work be performed by a crew who had 40-hour Hazwoper training. Per the Prime, and as confirmed by R&S, R&S was unable to provide a crew which met this requirement. R&S was provided their full scope of work.

Based on the foregoing, CMD concurs with the closeout of this contract.
