MEMORANDUM

Date: June 2, 2022

To: Brian Carlomagno, SFPUC
Daniel Alvarado, SFPUC

From: Jason Chow, CMD

Subject: CMD’s Closeout Review for WW-706 Oceanside Water Pollution Control Plant Egg- Shaped Digester Interior Liner Rehabilitation

The Contract Monitoring Division (“CMD”) has determined that Trinet Construction (“Trinet”), the prime contractor for this project, has complied with the Chapter 14B LBE subcontracting requirements associated with this project.

At the time the project was advertised, a n LBE subcontracting requirement of 13% was established.

Trinet’s Subcontractor List (Document 00 43 36) reflected an LBE subcontractor participation commitment of 13.16%. Trinet was awarded the contract in the amount of $ 2,461,000. After two (2) change orders, the final contract amount is $2,689,317.68. At closeout, the LBE subcontracting participation is as follows:

Firm Status Scope of Work
Original Credited
Contract
Participation
Final Credited
Contract Participation
Kearney
Plumbing

SF LBE- OBE
(Micro) Bid Item #6 Partial $320,000 13.00% $339,450 12.62% Baytech

SF LBE- MBE
(Micro) Electrical $4,000 0.16% $4,000 0.15%
TOTAL $324,000 13.16% $343,450 12.77%

The SFPUC informed CMD that the change order work that were executed on this contract was unproportional to (not part of) the anticipated original scope of work. Therefore, the extra work did not fit the listed LBE firms’ expertise—Trinet did utilize its listed LBE firms to the full extent possible. As such, Trinet is short of its original overall LBE subcontracting participation commitment on this contract at contract closeout (referenced in the above table).

Based on the foregoing, CMD concurs with the closeout of this contract.
