Project Manager: Kimberly Stern Liddell
Summary of
Proposed
Commission Action:
Approve the terms and conditions of and authorize the San Francisco Public Utilities Commission General Manager to execute license agreements granting Far Western Anthropological Research Group, Inc., Cinnabar Video Productions, and the Muwekma Ohlone Tribe rights to distribute and publicly screen the documentary film entitled Time Has Many Voices for a term of five years for non-profit use only at no cost.
Background: The San Francisco Public Utilities Commission (SFPUC) is implementing the Sunol Long- Term Improvements Project (project), inclusive of a new Watershed Center and upgrades at the existing Sunol Yard. On December 8, 2015, by Resolution N o. 15- 0264, this Commission adopted the Final Mitigated Negative Declaration (MND) for the project prepared by the Planning Department pursuant to the California Environmental Quality Act (CEQA) ( Case No. 2012.0054E) and the Mitigation and Monitoring Reporting Program (MMRP) and approved the project.
The MND and the MMRP require the SFPUC to implement measures to mitigate the project’s impacts to little known cultural site CA -ALA-565.
Through project implementation, CA-ALA-565 was found to be an ancestral Ohlone village, now named Síi Túupentak. As part of this mitigation , the SFPUC together with the Planning Department, archeological consultant and filmmaker Far Western Anthropological Research Group, Inc ., filmmaker Cinnabar Video Productions, and the Muwe kma Ohlone Tribe (whose Vice Chairwoman was assigned by the Native American Heritage Commission to the project as the Most Likely Descendant) , made the film Time Has Many Voices (“Documentary”) to share about Síi Túupentak and its inhabitants with the public.
The SFPUC , with support from the Planning Department, desires to enter Agreement: Approve Far Western Anthropological Research Group, Inc., Cinnabar Video Productions, and the Muwekma Ohlone Tribe License Agreements
Commission Meeting Date: August 23, 2022
into license agreements (“Agreements”) with the filmmakers and the Tribe (“Licensees”) to facilitate broad distribution and screening of the Documentary to audiences throughout the Sa n Francisco Bay Area and beyond, in addition to screenings at the Watershed Center . The Agreements would provide the Licensees a nonexclusive, royalty- free, five-year, revocable, worldwide right to distribute and screen the Documentary for broadcasts, cablecasts, and webcasts, websites, schools and libraries, educational DVDs, educational/informational presentations or courses, conference presentations, and film/video festivals and competitions, or other similar not-for-profit type uses. The Licensees are required to comply with the terms of the Agreements, which include making a reasonable effort to notify the SFPUC prior to any distribution or public screening and maintaining a list of the Documentary distributions and screenings available to the SFPUC upon request.
As a result of preliminary outreach effort to identify interest in the Documentary, the filmmakers received an offer from Vision Maker Media to market and distribute Time Has Many Voices to PBS nationwide for four years, with a debut this fall.
Environmental
Review:
This action to approve and authorize these Agreements does not constitute a “project” under CEQA Guidelines Section 15378(a) because there would be no physical change in the environment.
Result of Inaction: The Documentary would likely reach a narrower audience.
Budget & Costs: There is no cost associated with these Agreements.
Description of
Agreement:
Parties to
License
Agreements:
City and County of San Fr ancisco, acting through the
SFPUC, with F ar Western An thropological Research
Group, Inc. , Cinnabar Video Productions, and the
Muwekma Ohlone Tribe (three Agreements total).
Fees: None.
Purpose: Distribution and screening of the documentary film Time Has Many Voices for cultural education purposes.
