Summary of
Proposed
Commission Action:

Approve execution of an attestation of veracity for Hetch Hetchy Power’s 2021 Power Source Disclosure Reports and Power Content Label; and approve submission of the Power Source Disclosure Reports to the California Energy Commission; and approve provision of the Power Content Label to all customers before October 1 , 2022.

Under California Energy Commission regulations, the San Francisco Public Utilities Commission (SFPUC) can attest to the veracity of the Power Source Disclosure Report and Power Content Label for all retail products offered by Hetch Hetchy Power.

The 2021 Power Source Disclosure Report and Power Content Label demonstrate that in 2021, Hetch Hetchy Power provided 100% greenhouse-gas free energy from its large hydroelectric power plants to its general service customers. Hetch Hetchy Power ’s Premium Service provided 100% Renewable Portfo lio Standard 1 eligible energy to its customers from the Kirkwood power plant. Hetch Hetchy Power had a greenhouse-gas emissions intensity of 0 pounds of carbon dioxide equivalent (CO2e) per me gawatt-hour (MWh) of generation compared to a state -wide average of 456 pounds CO2e/MWh.

The Power Content Label provides power mix information to Hetch Hetchy Power’s customers, showing t he sources and em issions

intensity of Hetch Hetchy Power’s electric generation and comparing it to the statewide resource mix.

Hetch Hetchy Power also had s urplus renewable generation from its solar, biomass, and Renewable Portfolio Standard- eligible hydroelectric generation.

Background: Under Public Utilities Code Sections 398.4 and 398.5, retail suppliers of el ectricity must annually ( 1) report to the California Energy Commission t he type of generation resources (e.g., hydroelectric, solar, etc.) used to serve their end use cus tomers in the form of the Power Source Disclosure Report ; and (2) provide this same information to their customers in the form of a Power Content Label.

Hetch Hetchy Po wer submitted its Power Source Disclosure Reports to the California Energy Commission on June 1, 2022 and then revised them in response t o California Energy Commission comments on July 12, 2022. 2 A summary o f the P ower So urce Disclosure Reports was provided to the San Francisco Public Utilities Commission as an in formational item (Item #6(d), Communications) at its May 24, 2022 meeting.

As shown in the attached Power Source Disclosure Reports, for calendar year 2021, Hetch Hetchy Power provided:

• 100% large hydroelectric e nergy to its general service customers; and
• 100% hydroelectric energy from its Kirkwood power plant that qualifies as an eligible renewable energy resource under California’s Renew able Portfolio S tandard to its Hetch Hetchy Premium customers.

Hetch Hetchy Power ’s greenhouse-gas emissions for both its general and Premium electric service was 0 pounds of carbon dioxide equivalent (CO2e) per me gawatt-hour (MWh) of generation compared to a state-wide average of 456 pounds CO
2e/MWh.

Hetch Hetchy Power also had s urplus renewable generation from its solar, biomass, and Renewable Po rtfolio S tandard-eligible hydroelectric generation . The associated renewable energy credits (RECs) from this generation can be c arried over an d used to meet Hetch He tchy Power’s future Renewable Portfolio Standard obligations.

Hetch Hetchy P ower intends to d isclose the electricity sources of its

sales to customers for 2021 using the Power Content Label, a copy of which is attached to this agenda item.3 The Power Content Label is in the for mat prescribed by th e California Energy Commission for al l retail sellers . It shows, in t abular form, the electricity sources for Hetch H etchy Power’s sales and provides additional descriptive information to improve readability and understanding for customers.

Under the California Energy Commission ’s regul ations, Hetch Hetchy Power m ust provide all of its c ustomers with a copy of the Power Content Label either as a physical mailer or as an elect ronic message ( for those custome rs billed electro nically). The Power Content Label will also be posted on Hetch Hetchy Power ’s website.

Under the California Energy Commission’s regulati ons, Hetch Hetchy Power must either have its governing body ( this Commission) att est to th e veracity of its Power Source Disclosure Reports and Power Content Label or have it verified by a qualified third p arty. Since Hetch Hetchy Pow er began its Power Sou rce Disclosure reporting in 2011 the Commission has attested to the veracity of the r eport. The attached resolution attests to the veracity of the Power Source Disclosure Reports and Power Content Label . The attestation of veracity i s to be execu ted by th e Assistant General Manager for Power ’s desig nee, James Hendry, Utility Specialist. Mr. H endry supervised the preparation of the Power Source Disclosure Reports and Power Content Label .

The reports were p repared using the same data sources used by Hetch Hetchy Pow er to prepare its other regulatory and compliance filings.

Result of Inaction: If the Commission does not approve submission of an attestation of veracity, th e SFPUC will be re quired to inc ur the t ime and cost of having the Power Source Dis closure Reports and Power Content Label independently verified and may incur fines if the verification is not completed by the California Energy Commission’s September 30th deadline.

Recommendation: SFPUC staff rec ommends that the Commission adopt the a ttached resolution.
