App rove Submission of an A ttestation of V eracity for CleanPowerSF’s 2021 Power Source Disclosure Reports and Power Content Label

Summary of
Proposed
Commission Action:

Approve execution of an attestation of veracity for CleanPowerSF’s 2021 Power Source Disclosure Reports and Power Content Label ; approve submission of the 2021 Power Source Disclosure Reports to the California Energy Commission ; and approve provision of the Power Content Label to all customers by October 1, 2022.

The Power Content L abel provides power mix information to CleanPowerSF’s customers, showing the sources and em issions intensity of CleanPowerSF’s electric generation and comparin g it to the s tatewide resource mix. Un der California Energy C ommission regulations, the SFPUC can attest to the veracity of the Power Source Disclosure Report and P ower Content L abel for a ll retail p roducts offered by CleanPowerSF.

The 2021 Power Source Disclosure Report and Power Content Label demonstrate that in 2021, CleanPowerSF’s Green product supply was

55.4% Renewable Portfolio Standard
1 (RPS) eligible renewable and
its SuperG reen p roduct supply was 100% Renewable Portfolio Standard-eligible rene wable. CleanPowerSF’s Green product had a greenhouse gas emissions intensity of 82 pounds of carbon dioxide equivalent (CO2e) per megawatt-hour (MWh) of generation, and the SuperGreen product had a greenhouse gas emissions intensity of 0 pounds of CO2e/MWh.

1 These resources include wind, solar, small hydroelectric, geothermal, biomass, and biogas facilities.

Approve CleanPowerSF’s 2021 Power Source Disclosure Reports/Power Content Label to the California Energy Commission Commission Meeting Date: September 13, 2022

Background: Under Public Utilities Code Sections 398.4 and 398.5, retail suppliers of el ectricity must annually ( 1) r eport to the C alifornia Energy Commission the type of generat ion re sources (e.g., hydroelectric, solar, etc.) used to serve their en d use customers in the form of the Power Source Disclosure Report ; and (2) provide this same information, in the form of a Power Content Label to their customers.

CleanPowerSF submitted its Power Source Disclosure Reports to the California Energy Commission on June 1, 2022. A summary of the Power Source Disclosu re Reports w as provided to this Commission as an informational communications item at its May 24, 2022 meeting.

As shown in the at tached Power Source Disclosure Reports for calendar year 2021, Cl eanPowerSF provided electricity to its Green product customers from the following sources:
• 55.4% renewable energy resources ( e.g., solar, wind, geothermal, etc.) that qualify as eligible renewable resources under California’s Renewable Portfolio Standard.
• 37.6% additional greenhouse gas free hy droelectric
generation.
• 0.1% nuclear resources.
• 6.9% California Independent System Operat or uns pecified sources of power2.

In total, approximately 93% of CleanPowerSF’s Green product power supply came from clean and r enewable energy sources like solar, wind, geothermal and hydroelectric generation. Approximatel y 6.9% of CleanPowerSF’s Green pr oduct supply came f rom unspe cified sources in the California Indepen dent System Operator to balance CleanPowerSF’s supply and demand.

As noted above, 0.1% of Cl eanPowerSF’s Green product electricity supply was generated by nuclear energy imported from t he Pa cific Northwest. This nuclear energy was delivered under a contract CleanPowerSF executed with a supplier to purchase hydroelectric and low carbon power from the Pacific Northwest. The contract allowed the seller to supplement specified deliveries of hydroelectric power with low carbon electricity from the pool of an “ Asset Controlling Supplier
3” in the event of reduced availa bility from hydroe lectric generation. In 2021, CleanPowerS F received 20,167 megawatt-hours from an Asset Controlling Supplier under this contract. Hydroelectric generation represented 86% of t hese de liveries. Nuclear deliveries under this contract represented 0.067% (rounded up to 0.1%) of CleanPowerSF’s Green power supply. CleanPowerSF is no longer

2 The Power Content Label will be finalized after Commission action on this item and will be distributed to customers by September 30, 2022.
3 Asset Controlling Suppliers are electric power entities that have registered with the California Air Resources Board and import wholesale electricity, primarily hydroelectric power, into California.

Approve CleanPowerSF’s 2021 Power Source Disclosure Reports/Power Content Label to the California Energy Commission Commission Meeting Date: September 13, 2022

entering into contracts that allow electricity to be supplemented from the resource mix of Asset Controlling Suppliers.

CleanPowerSF provided electricity to i ts SuperGreen customers from:
• 100% ren ewable energy resources (solar and wind) that qualify as eli gible renewable sources under C alifornia’s Renewable Portfolio Standard program.

After retail sellers submit their Power Source Disclosure Reports to the California Energy Commission, the agency then compiles them to determine the statewid e mix of electricity resources used to mee t California’s electricity demand and provides t his information back to retail sellers for inclusion in their Power Content Labels in the form of a Power Content Label template.

CleanPowerSF intends to discl ose the electricity sources of its sales to customers for 2021 using the P ower Content L abel, a draf t of which is attached to this agenda item.
4 The Power Content Label is in
the for mat prescrib ed by the C alifornia Energy Comm ission for al l retail sellers released on July 29, 2022. The P ower Content L abel shows, in t abular form, the electrici ty sources for C leanPowerSF’s sales and provides additional descriptive i nformation to imp rove readability and understanding for customers.

As a result o f A ssembly Bi ll 1110 (Ting , 2015 ),
5 starting in 2020
the P ower Source Disclosure Reports also calculate s greenhouse gas emissions in tensity ( pounds CO2e/MWh) for each retail seller to be included on th e Power Content Label.

The C leanPowerSF Green product’s 2021 greenhouse gas
emissions intensity was 82 pounds CO
2e/MWh. T o put this i n
context, in 2021 , California ’s statewide e missions intensity was 456 p ounds CO2e/MWh, while in 2020, the latest year for which this data is available , PG&E’s def ault product w as 160 pounds CO2e/MWh.

The SuperGreen pr oduct’s 202 1 emissions intensity was 0 pounds CO
2e/MWh.

Under the C alifornia Ener gy Com mission’s regul ations, CleanPowerSF must provi de all of its customers w ith a copy of the Power Content L abel either as a physical mailer or an elect ronic message (only for those custome rs billed electronically). The P ower Content Label will also be p osted on CleanPowerSF’s website.

4 California Independent System Operator unspecified sources of power means electricity from transactions that are not traceable to specific generation sources.
5 This bill amended Section 398.1 and 398.4 of the Public Utilities Code, and tasked the California Energy Commission to adopt guidelines for the reporting and disclosure of greenhouse gas emissions intensity associated with retail electricity sales.

Approve CleanPowerSF’s 2021 Power Source Disclosure Reports/Power Content Label to the California Energy Commission Commission Meeting Date: September 13, 2022

Under t he regulations, CleanPow erSF must also either have i ts governing body (this Commis sion) attest to the veracity of its Power Source Disclosure Reports and Power Content Label or have it verified by a qua lified third party. The Commission has attested to the veracity of CleanPowerS F’s Power Source Disclosure R eport since CleanPowerSF bega n serving customers in 2016 and filed its first report in 2017 based on 2016 actual electricity sales.

The attached resolution attest s to the veracity of the P ower Source Disclosure Reports and P ower Content Label. The attestation of veracity is to be exe cuted by the As sistant Ge neral Manager for Power’s desig nee, Michael Hy ams, the Deputy Man ager for Power responsible for the CleanPowerSF program. Mr. Hyams supervised the preparation of the Power Source Disclosure Reports and P ower Content Label.

Result of Inaction: If the Commission does not approve submission of an at testation of veracity, th e SFPUC will be re quired to inc ur the t ime and cost of having the Power Source D isclosure Reports a nd P ower Conte nt Label independently verified, and may incur fines if the verification is not completed by the CEC’s September 30th deadline.

Recommendation: SFPUC staff r ecommends that the Commission adopt the a ttached resolution.
