Subject: Closeout for WW-686 - As-Needed Spot Sewer Replacement No. 38

The Contract Monitoring Division (“CMD”) has determined that J. Flores Construction, Inc. (“J. Flores”) has substantially complied with the LBE subcontracting requirements associated with this project.

At the time the project was advertised, CMD established an LBE subcontracting requirement of 8%. The Prime’s Document 00 43 36 reflected an LBE subcontracting participation of 8.29%. J. Flores was awarded the contract in the amount of $9,205,822.50, which after three change orders was modified by $4,602,910.50 for a total amount of $13,808,733.00. J. Flores’s LBE subcontracting participation at closeout is as follows:

Due to the As-Needed nature of this contract, per documentation provided by J. Flores and the SFPUC, Ronald R. Nelson’s scope of work was not requested by the SFPUC on this project. Per J. Flores/SFPUC, the rest of the originally listed LBE subcontractors were provided the maximum available amount of work in their respective scopes. Per documentation provided by J. Flores, due to the urgent nature of work on this contract, the final participation percentage for LBE subcontractors San Francisco Transport

and Sullivan’s Concrete Sawing was also the result of their availability when the work was requested. To recover and maximize LBE subcontracting participation on this project, J. Flores also added three more LBE subcontractors: J R Monterrosa, Inc., Ronan Construction, Inc., and Semental Company dba K-Rocks Construction.

Based on the foregoing, CMD concurs with the closeout of this contract. Should you have any questions, or if I can be of further assistance, please do not hesitate to contact me at (415) 551-4335.
