Ranger’s individual LBE subcontracting commitment to use Municon Consultants was in anticipation of extensive noise and vibration monitoring. However, per the SFPUC, during the course of the contract, noise and vibration was not an issue and minimal services were required of Municon Consultants. Pursuant to CMD communications with Ranger, Sullivan’s Concrete Sawing withdrew its services from the contract and provided SFPUC with documentation showing this. Ranger was short of its LBE commitments to Costello Trucking and Apex Testing because the contract modifications substantially increased the final contract amount and, per the SFPUC, these changes had little relevant scope to these subcontractors. While Ranger was also short of its LBE commitments to R&W Concrete Contractors and the contract modifications had some concrete work, per documentation from R&W Concrete to Ranger, R&W Concrete declined to perform this work. In good faith, Ranger added Exaro Technologies and R & S Construction Management as LBE subcontractors on this contract.

Based on the foregoing, CMD concurs with the closeout of this contract. Should you have any questions, please do not hesitate to contact me at [email protected].

5 Pioneer Contractors is only LBE certified under the General Contracting B License. It is not LBE certified under the Roofing Contractor (C-39) category. Under California Business & Professional Code, Division 3, Chapter 9, Article 4, 7057(b), it states that “….A general building contractor shall not take a subcontract involving trades other than framing or carpentry, unless the subcontract requires at least two unrelated trades or crafts other than framing or carpentry, or unless the general building contractor holds the appropriate license classification…” As such, CMD cannot apply LBE participation credit for Pioneer Contractors listed amount of $551,140. 6 Pioneer Contractors is only LBE certified under the General Contracting B License.
