From: Jovi Cuntapay-Vitin, Contract Compliance Officer, CMD
Subject: Closeout for WW-687 Force Main Rehabilitation at Embarcadero & Jackson
The Contract Monitoring Division (“CMD”) has determined that Anvil Builders, Inc. (“ABI”), the LBE prime contractor, has made a good faith effort to substantially comply with the LBE subcontracting requirements associated with this project.
At the time the project was advertised, a Micro/Small LBE subcontracting participation requirement of 20% was established. ABI’s Section 00 43 36 reflected a Micro/Small LBE subcontracting participation of 20.35%. ABI was awarded the contract in the amount of $5,986,222. After one (1) modification, the final contract amount is $7,835,216.50. ABI’s Micro/Small LBE subcontracting participation is as follows:

Per ABI, GECMS Inc.’s LBE participation was cut short due to changes and conditions presented in the field. During potholing many unknown issues emerged, and work had to continue on force account with vacuum excavation. It consumed hardscape demolition and some of the needed excavation which GECMS are listed to perform . Hence, decreasing their LBE Participation.
Overall, ABI was able to meet and exceed its LBE Participation at a final closeout percentage of
21.54%.
Based on the foregoing, CMD concurs with the closeout of this contract.
