Application of bid preferences does not apply because the re was only one bidder.
Outreach: SFPUC conducted extensive outreach to all A -License construction firms in the CMD Directory. Based on the results of the outreach efforts, SFPUC determined that neither further outreach efforts, nor modification of requirements in the Contract, would likely result in more than one bid at bid pri ces substantially lower than the bid price received if SFPUC was to re-advertise this contract.
Negotiations with the
Sole Bidder:
Post-Bid Survey and Reasons for Negotiations:
Under San Francisco Administrative Code section 6.23(c)(2), when the SFPUC advertises a public work project in accorda nce with the required procedures a nd receives only one responsive bid, and t he bi d exceeds the Engineer’s Estimate, the Department shall determine:
1. Whether outreach efforts would result in more than one bid; and
2. Whether removal or modificatio n of certain requirements in the Contract: WW-733, As-Needed Sewer Cleaning (FY23)
Commission Meeting Date: February 14, 2023
contract would result in more than one bid.
If the SFPUC concludes that neither st ep is likely to r esult in more than one bid at prices substantially low er than the bid pr ice received, th en the Commission may authorize th e General Manager to negotiate wit h the sole bidder or any qualified contractor.
SFPUC staff conducted the following reviews to determine whether more than one bid would likely result in more than one bid at p rices substantially lower than the bid price received:
1. Whether outreach efforts would result in more than one bid SFPUC’s Contractors Assistance Center sent outreach emails at four different times during the contract advertisement period to over 260 contactors.
Additionally, staff contacted two contr actors ( APS Environmental and National Plant Services, Inc.) that attended the Pre -Bid and C ontractor Networking Conference. Both contractors stated to staff that they did not bid due to their current number of ac tive projects and the limited capacity of their teams.
2. Whether removal or modification of certain requirements in the con tract would result in more than one bid
The contract r equirements are needed in ord er to perform and compl ete the sewer inspection work in compliance with the Wastewater En terprise’s requirements.
Under these circu mstances, SFPUC st aff concluded that re-advertising the contract would not result in more than one bid at a substantially lower price than the present bid.
Recommendation: SFPUC staff recommends that the Commission adopt the attached resolution.
