Approve Increases to Construction Amount for Contract No. WD-2888(E), Stern Grove Emergency Site Restoration
Summary of Proposed
Commission Action:
Approve an increase of $3,500,000 to the contract cost contingency for Contract No. WD-2888(E), Stern Grove Emergency Site Restoration, with Anvil Builders, Inc., to perform slope repair and erosion mitigation work as a result of atmospheric rain events in December 2022; and authorize the General Manager to approve future modifications to the contract for a total contract amount of up to $22,010,994.
Background: On August 23, 2021, San Francis co Public Utilities Commission (SFPUC) crews were working on a leaking air valve on a 54-inch diameter water transmission pipeline, the San Andreas Pipeline No.2 at 22nd Avenue and Sloat Boulevard. While they were tightening down a bolt, the air valve fail
ed, sending water into the air and flooding
adjacent areas, particularly Stern Grove. The steep slope on the south side of Stern Grove was heavily eroded and gullied by the flow, which undermined up to 63 tall eucalyptus trees that exist on the slope, making the slope unstable. The water and debris from the slope flowed down into and around the Concert Meadow covering the meadow, surrounding three backstage buildings, and filling in the creeks and culverts that usually transport stormwater runoff away from the site.
On
August 26, 2021, SFPUC issued a Declaration of Emergency to allow for an emergency contract to perform tree removal, slope repair, and debris removal in Stern Grove.
On November 16, 2021, by Resolution No. 531- 21, the Board of Supervisors approved the emergency declaration to authorize a contract(s) for repairs with a total estimated cost not- to-exceed $4,000,000. This amount was based on an initial visual inspection of the site immediately after the valve failure without a formal engineering assessment.
Contract: WD-2888(E), Stern Grove Emergency Site Restoration Commission Meeting Date: April 11, 2023
On December 23, 2021, SFPUC entered into Contract WD -2888(E), Stern Grove Emergency Restoration Contract, with Anvil Builders, Inc. with a not to exceed amount of $3,294,000 and a total contract term not to exceed five years.
On February 15, 2022, following an engineering assessment of the damages to the site, SFPUC issued an updated Declaration of Emergency to increase the allowed estimated cost of repairs from $4,000,000 to $20,000,000 to restore the historic Stern Grove site.
On April 26, 2022, by Resolution No. 170-22, the Board of Supervisors approved the updated emergency declaration to increase the allowable estimated cost of repairs not to exceed $20,000,000.
Atmospheric storm events in December of 2022 caused additional erosion damage to the slope under repair.
In May and October of 2022, SFPUC issued modifications to Anvil’s contract increasing the contract amount to $18, 510, 994.
Description of Scope of
Work:
The emergency contract work location is in San Francisco's Parkside District and the contract work consists of:
• tree removal;
• debris removal;
• slope repair;
• historical building restoration;
• parking lot restoration;
• parking lot repaving; and
• and other work needed to fully restore the Stern Grove site to pre-existing condition.
Changes and
Modifications to the
Contract:
The initial contract in the amount of $3,294,000 authorized mobilization, tree removal, site clearing and grubbing, and site preparation for slope repair.
Modification No. 1: O n May 19, 2022, SFPUC issued a contract modification to Anvil increasing the contract amount from $3,294,000 to $15,033,568, increasing scope to restore rock walls, pathways, storm drains, brace and protect the existing sewer pipeline, perform initial slope improvements, building restoration, and lower landscaping restoration.
Modification No. 2: O n October 3, 2022, SFPUC issued a contract modification to Anvil increasing the contract amount from $15,033,568 to $18,510,994 to include site paving, slope irrigation, tree an d shrub plating, tennis court retaining wall restoration, hydroseeding, building “A” paver restoration, slope stair restorations, horseshoe pit restoration, and off-site soil staging area restoration.
Contract: WD-2888(E), Stern Grove Emergency Site Restoration Commission Meeting Date: April 11, 2023
Recommendation to Increase to Contract
As a result of atmospheric rain events in December 2022, the nearly completed slope restoration at Stern Grove experienced significant erosion and soil slippage, requiring the need to perform additional slope repairs and erosion mitigation work in order to fully restore the site to pre-existing conditions. Staff recommends an increase of $3,500,000 to t he existing cost contingency to repair the nearly completed slope restoration
The increased contract contingency will provide funds necessary to pay for repairs of additional damages caused by heavy rains during winter of 2022- 2023, including: removal of the existing top soil layer; installation of a 6- inch thick, diamond shaped, polyethylene plastic webbing along the entire slope with openings for the tree plantings to provide a stabilized system to retain the top soil layer to mitigate against future soil erosion and significant rain events; reinstallation of the top soil layer; hauling and disposal of excess top soil; adjustments in tree plantings, repair of slope irrigation system, and final site restoration.
Budget & Costs: Funding: Project No. 10038008, Stern Grove Emergency Site Restoration and Water Enterprise Local Conveyance/Distribution Program
Original Contract Amount: $3,294,000
Previous Contract Modifications: $15,216,994
Requested Additional Cost Contingency: $3,500,000
Total Revised Contract Cost Limit: $22,010,994
Schedule: Notice-to-Proceed Date: September 1, 2021
Contractual Service Order Duration: 300 consecutive calendar days Maximum Contract Duration: 5 years
Environmental Review: On August 31, 2021 the San Francisco Planning Department determined the Project to be statutorily exempt from environmental review under California Environmental Quality Act (“CEQA”) Section 21080(b)(2) and 21080(b)(4) and CEQA Guidelines sec tion 15269(b) (Case No. 2021-008765ENV), because the tree removal, slope repair, and debris removal are part of emergency repairs to public service facilities necessary to maintain service and are actions necessary to mitigate an emergency. The modified work is within the scope of the project authorized under the Statutory Exemption. The exemption can be found here:
