Per AECOM, Land and Structure has declined work on Task Order 5, resulting in a shortfall in the present LBE Participation. Moreover, pursuant to communications with AECOM and confirmed by the SFPUC, AECOM’s LBE Participation To-Date for Freyer & Laureta, Inc., McGovern McDonald Engineers, Pacific Engineering & Construction, Inc. and Matthew Gass Consulting are presently behind in meeting their LBE Requirements as the SFPUC has not yet requested the scopes of work that these subcontractors are listed for.

AECOM is required to make good faith efforts to utilize LBEs for any scope of work, or portions thereof, which can reasonably be subcontracted out throughout the life of the contract.

Based on the foregoing AECOM confirmed that it will remain committed to assigning work that may arise from future task orders to its original listed LBE subconsultants. AECOM informed CMD that it anticipates meeting its 16.20% Micro/Small - LBE commitment, as follows:

Per correspondence with the SFPUC, “KKL is currently anticipated to perform the Project Coordinator and Project Management services for a number of dam projects in the Hetch Hetchy Region.” As a result, the shortfall in some individual LBE commitment is because the “Project Coordinator that has experience in Dams and hydropower to be able to coordinate with internal and external stakeholders to identify Levels of Service/performance objectives of each project and thereby be able to define scope, budget and schedule of the all the dam projects; and provide peer review of deliverables as required,” and “only AECOM and KKL” have “the experience to provide those highly specialized services.” Moreover, AECOM has acknowledged that they are required to make good faith efforts to utilize LBEs for any scope of work, or portions thereof, which can reasonably be subcontracted out throughout the life of the contract.

Going forward, SFPUC Project Manager and AECOM will notify CMD of any newly proposed task orders and the composition of the respective consultant team(s) for each task order. CMD will review this information to determine/facilitate progress toward the project’s overall LBE subconsulting requirement. In addition, the SFPUC Project Manager and AECOM will notify CMD of any proposed subconsultant additions and/or substitution throughout the term of this amendment. Contingent on the conditions set forth above, CMD concurs with the subject modification.

Based on the foregoing, CMD concurs with the closeout of this contract. Should you have any questions, please contact Michelle Kassatly at [email protected] .
