Public Utilities Commission
City and County of San Francisco
Agreement: Consent Calendar
Project Manager: Tim Ramirez
Approve Project S pecific Maintenance Agree ment with Caltrans for Southern Skyline Boulevard Ridge Trail Extension Project Improvements
Summary of
Proposed
Commission Action:
Approve the terms and cond itions and authorize the General Manager to execute, subject to Board of Supervisor approval, a no- cost Project Specific Maintenance Agreement with the State of California, Department of Transportation (Caltrans), for ongoing maintenance supporting proposed improvements by the San Francisco Public Utilities Commission at 18 locations within Caltrans right -of-way along a six -mile section of S tate Route 35, south of State Route 92, in San Mateo County, Califor nia. The proposed improvements are associat ed with the Southern Skyline Boulevard Ridge Trail Extension Project.
Background: The San Fran cisco Public Utilities Commission (SFPUC) has fund ed the Southern Skyline Boulevard Ridge Trail Extension Project (Project) to improve and develop recre ational trails and associated facilities within the Peninsula Watershed in San Mateo County on land owned by the City, under the jurisdiction of the SFPUC.
Project components proposed for areas south of S tate Route 92 include a new six-mile southern skyline ridge trail (Trail), aligned generally parallel to Skyline Boulevard, and appurtenances related to the operation, use, and management of the Trail. Along the Trail, the SFPUC propose s to construct or improve mul tiple driveway entries , construct or improve f encing, construct retaining walls, and inst all a prefabricated bridge to span a gulc h that intersects the Trail alignment.
Skyline Boulevard, officially known as California State Route 35 (SR-35), is a two-lane state highway under Caltrans’ jurisdiction. SFPUC staff identified 18 locations where Project improvements would fall within the SR-35 right- of-way (ROW). Six of the 18 locations are on Caltrans fee-owned property (Caltrans Property). The remaini ng 12 locations are within areas of the SR - 35 R OW wh ere the City owns the land in fee simple, and Caltrans holds easements pursuant to: (i) that certain Deed of Right of Way for State Highway between Spring Valley Water Company and the State of California, recorded December 22, 1924 in Book 139 at page 368 (1924 Easement Deed); and (ii) that certain Deed between City and the State of California , recorded December 13, 1934 in Book 642 at page 15 (1934 Easement Deed).
Due to the potential impact of the Project on the SR-35 ROW, SFPUC staff Agreement: Authorize Maintenance Agreement with Caltrans for Southern Skyline Blvd. Ridge Trail Extension Project Improvements
Commission Meeting Date: June 13, 2023
invited Caltrans to review all 18 of the locations through a Standard Caltrans Encroachment Permit Application.
As a co ndition of the Caltrans encroachm ent permit to construct the Project improvements at eight locations, Caltrans required that the SFPUC enter into a Project S pecific Mai ntenance Agreement (Agreement) with Caltra ns to apportion responsibility for the Project improvements to the SFPUC. The eight locations s ubject to a Caltrans encro achment permit include the six locations on Caltrans Property, and the two locations subject to the 1934 Easement Deed, which conditions new SFPUC improvements upon issuance of “a permit or permits which will be issued by the State upon request of the City.” The 1924 Easement Deed does not condition work by the SFPUC on issuance of an y permits, thus the SF PUC retains all the rights it requires to construct the Project at the locations within the Caltran s easement area acquired pursuant to the 1924 Easement Deed.
Under the Agreement, the SFPUC will also be solely responsible, at its sole expense, for the maintenance of all 18 Project improvements within the SR- 35 ROW, including, but not limited to, structural adequacy, graffiti removal, sweeping, debris removal, and signage requi red for the direction and operation of the improvements. There is no c ost to the SFPUC for the Agreement, and the A greement would remain in effect until amended or terminated at any time upon mutual consent of t he parties to the Agreement or until terminated by Caltrans for cause if permitted under the relevant deed.
Environmental
Review:
On April 29, 2021 , the Planning Commission certified the Final Environmental Impact Repor t for the Southern Skyline Boulevard Ridge Trail Extension Project (Project) (Planning Department Case No. 2016- 016100ENV).
On May 11, 2021, by Resolution No. 21-0077, this Commission approved the Project and, as required by the California Environmental Qua lity Act (CEQA), adopted findings including a statement of overriding considerations (CEQA findings) and a Mitigation Monitoring and Reporting Program.
The work to be conducted under the Agreement is within the scope of the Project as authorized under the Final Environmental Impact Report.
