Approve Execution and Submission of an Attestation of V eracity for CleanPowerSF’s 2022 Power Source Disclosure Reports and Power Content Label

Summary of
Proposed
Commission Action:

Approve execution and submission of an attestation of veracity for CleanPowerSF’s 2022 Power Source Disclosure Report s and Power Content Label; approve final submission of the 2022 Power Source Disclosure Reports to the California Energy Commission ; and approve provision o f the Power Content Label to all customers before January 2, 2024.

The P ower Content L abel provides power mix information to CleanPowerSF’s customers, showing the sources and emissions intensity of CleanPowerSF’s electric generation and compar ing it to the s tatewide resource mix. Under California Energy C ommission regulations, the SFPUC can attest to the veracity of the P ower Source Disclosure Report and P ower Content L abel for all retail products offered by CleanPowerSF.

The 2022 Power Source Disclosure Report and Power Content Label demonstrate that in 2022, CleanPowerSF’s Green product supply was

59.9% Renewable Portfolio Standard
1 (RPS) eligible renewable, and
supply for both its SuperGreen and SuperGreen Saver products was 100% Renewable Po rtfolio Standar d-eligible renewable.

CleanPowerSF’s Green product ha d a greenhouse gas emissions intensity of 47 pounds of carbon dioxide equivalent (CO 2e) per megawatt-hour (MWh) of generation, and both its SuperGreen and SuperGreen Saver products had a greenhouse gas emissions intensity of 0 pounds of CO2e/MWh.

Background: Under Public Utilities Code Sections 398.4 and 398.5, retail suppliers of el ectricity must annually (1) report to the C alifornia Energy Commission the type of generat ion resources (e.g., hydroel ectric, solar, etc.) used to serve their end use customers in the form of the Power Source Disclosure Report; and (2) provide this same

1 RPS-eligible renewable resources include wind, solar, and geothermal facilities.

information, in the form of a Power Content Label to their customers.

CleanPowerSF submitted its initial Power Source Disclosure Reports to the California Energy Commission on June 2, 2023. A summary of the Power Source Disclosure Report s was provided to th is Commission as an informational communications item (Item #10(d), Communications) at its May 23, 2023 meeting.

As shown i n the attached Power Source Disclosure Reports for calendar year 202 2, CleanPowerSF provided electricity to its Green product customers from the following sources:
• 59.9% renewable energy resources ( e.g., solar, wind, geothermal, etc.) that qualify as eligible renewable resources under California’s Renewable Portfolio Standard.
• 37.2% additional greenhouse gas free hydroelectric
generation.
• 2.9% California Independent System Operator unspecified sources of power2.

In total , approximatel y 97.1% of CleanPowerSF’s Green product power supply came from clean and renewable energy sources like solar, wind, geothermal and hydroelectric generation. Approximately

2.9% of CleanPowerSF’s Green product supply came from
unspecified sources in the California Independent System Operator to balance CleanPowerSF’s supply and demand.

CleanPowerSF provided electricity to its SuperGreen customers from:
• 100% renewable energy resources (solar and wind) that qualify as elig ible renewable sources under Califor nia’s Renewable Portfolio Standard program.

CleanPowerSF provided electricity to its SuperGreen Saver customers from:
100% renewable energy resources (solar) that qualify as eligible renewable sources under California’s Renewable Portfolio Standard program.

After retail sellers submit their Power Source Disclosure Reports to the California Energy Commission, the agency then compiles them to determine the statewide mix of electricity resources used to meet California’s electricity demand and provides this information back to retail sellers for inclusion in their P ower Content Labels in the form of a Power Content Label template.

CleanPowerSF intends to disclose the electricity sources of its sales

2 The CEC will consider PCLs provided to customers in written promotional materials by January 2, 2024, as timely.

CleanPowerSF intends to distribute the 2022 PCL to customers by October 2, 2023.

Agenda Title: Approve submission of CleanPowerSF’s 2022 Power Source Disclosure Reports/Power Content Label Commission Meeting Date: September 20, 2023

to customers for 202 2 using the P ower Content Label, a dra ft of which is attached to this agenda item.3 The Power Content Label is in the format prescribed by the C alifornia Energy Commission on August 16, 2023 for all retail sellers . The P ower Content Label shows, in tabular f orm, the electricity s ources f or Cle anPowerSF’s sales and provides additional descriptive information to improve readability and understanding for customers.

As a result of A ssembly Bill 1110 (Ting , 2015 ),4 starting in 2020 the Power Source Disclosure Reports also calculate greenhouse gas emissions i ntensity (pounds CO 2e/MWh) for each of the electricity products included on the P ower Content Label.

The CleanPowerSF Green product’s 202 2 greenhouse gas
emissions intensity was 47 pounds CO2e/MWh. To put this in context, in 202 2, California’s statewide emissions intensity was 422 pounds CO 2e/MWh, while in 2021, the latest year for which this data is available, PG&E’s default product was 98 pounds CO2e/MWh.

The SuperGreen and Super Green Saver product 20 22 emissions intensity was 0 pounds CO2e/MWh.

Under the C alifornia Energy Commission’s regulations,
CleanPowerSF must provide all customers with a copy of the P ower Content Label either as a physical mailer or an electronic message (only for those custome rs bille d electronically). T he Power Content Label will also be posted on CleanPowerSF’s website.

Under the California Energy Commission’s regulations, this Commission (CleanPowerSF’s governing body) must attest to the veracity of its P ower Source Disclosure Reports and Power Content Label or contract w ith a qualified third party to verify the reports.

The Commission has attested to the veracity of CleanPowerSF’s Power Source Disclosure Report since CleanPowerSF began serving customers in 2016 and filed its fi rst re port in 2017 ba sed on 2016 actual electricity sales.

The attached resolution attests to the veracity of the P ower Source Disclosure Reports and P ower Content Label. The attestation of veracity is to be executed by the Assistant General Manager for Power or a designee who supervised the preparation of the P ower Source Disclosure Reports and P ower Content Label.

3 California Independent System Operator unspecified sources of power means electricity from transactions that are not traceable to specific generation sources.
4 This bill amended Section 398.1 and 398.4 of the Public Utilities Code, and tasked the California Energy Commission to adopt guidelines for the reporting and disclosure of greenhouse gas emissions intensity associated with retail electricity sales.

Agenda Title: Approve submission of CleanPowerSF’s 2022 Power Source Disclosure Reports/Power Content Label Commission Meeting Date: September 20, 2023

Page 4 ends

Result of Inaction: If the Co mmission does not approve submission of an attestation of veracity, the SFPUC will be required to incur the time and cost of having the Power Source Disclos ure Reports and Power Content Label independently verified and may incur fines if the verification is not completed by the CEC’s October 2nd deadline.

Recommendation: SFPUC staff recommends th at the Commi ssion adop t the attached resolution.
