Approve Execution and Submission of an A ttestation of V eracity for Hetch Hetchy Power’s 2022 Power Source Disclosure Reports and Power Content Label
Summary of
Proposed
Commission Action:
Approve execution and submission of an attestation of veracity for Hetch Hetchy Power ’s 2022 Power Source Disclosure Reports and Power Content Label; and approve final submission of the 2022 Power Sourc e Disclosure Reports to th e California Energy Commission; and approve provision of the Power Cont ent Label to all customers by January 2, 2024.
The Power Content Label provides power mix information to Hetch Hetchy Power’s customers, showing the sources and greenhouse gas (GHG) emissions intensity of Hetch Hetchy Power’s electric generation and compa ring it to the s tatewide resource mix. Un der California Energy Commission regulations, this Commission can attest to the ve racity of the P ower Source Disclosure Reports and Power Content Label for all retail products offered by Hetch Hetchy Power.
The 2022 Power Source Disclosure Reports and Power Content Label demonstrate that in 2022 Hetch Hetchy provided its customers served on its general rate schedules with an energy product that was 100% GHG-free, sourced almost entirely from the Hetch Hetchy hydroelectric system . Hetch Hetchy ’s Premium Service (Schedu le G) provided its customers with an energy product that was also 100 % GHG-free, with 5 2% o f this energy als o meeting California ’s Renewable Portfo lio Standard1 requirements during the reporting year. Hetch Het chy’s General and Premi um servic e offerings both have a greenhouse gas (GHG) emissions intensity of 0 pounds of carbon dioxide equi valent (CO2e) pe r me gawatt-hour (MWh) of generation.
Background: Under Public Utilities Code Sections 398.4 and 398.5, retail suppliers
1 These resources include wind, solar, geothermal, biomass/biogas facilities, and certain hydroelectric resources.
Agenda Item: Approve submission of Hetch Hetchy Power’s Power Source Disclosure Reports/Power Content Label Commission Meeting Date: September 20, 2023
of electricity must annually (1) report to the California Energy Commission on the type of generat ion resources (e.g., hydroelectric, solar, etc.) used to serve t heir end use customers in the form of the Power Source Disclo sure Report; and (2) pro vide this same information in the form of a Power Content Label to their customers.
Hetch Hetchy Power submitted its Power Source Disclosure Reports to the California Energy Com mission on May 25, 2023 wi th minor revisions resubmitted on July 20, 2023. A summary of the Power Source D isclosure Reports was provided to th is Commission as an informational communications item (Item #10(d), Communications) at its May 23, 2023 meeting.
As shown in th e attached Power Source Disclosure Reports for calendar year 2022, Hetch Hetchy Power prov ided electricity to its General Service customers that was 100% GHG -free hydroelectric energy. Ninety-nine percent of this ener gy was generated by the Hetch Het chy sys tem and t he remaining 1% from hydroelectric facilities of the W estern Area Power Admi nistration (WAPA) which is the source of the electric energy Hetch Hetchy Power provides to Treasure Island.2 Hetch Hetchy Power also had surplus energy above its r etail needs from its Kir kwood generating unit s, solar f acilities, and the Southe ast Cogen power plant. This energy, all of which meets California’s Renewable Portfolio Standard eligibility standards, was re- sold with Hetch Hetchy Power keeping t he associated renewable energy credits (RECs). These RECs can be used for Hetch Hetchy Po wer to meet its future Renewable Portfolio Standard compliance obligations.
The Power Source Disclosure Reports also show that Hetch Hetchy’s Premium Service offered energy that was 100% GHG-free with 52% coming from Renewable Portfolio Standard- eligible resources for calendar year 2022. However, it i s important to note that t he 52% eligible renewable percentage does not reflect Renewable Portfolio Standard compliance under Ca lifornia’s Renewable P ortfolio Standard program, which is determined using a d ifferent methodology. Premium Service provi des customers an energy portfolio that is 100% Renewable Portfolio Standard- eligible according to California Energy Commis sion rules and meets the requirements of the California Air Resources Board’s Low Carbon Fuel Standard program. T he Power Content Labe l shows only 52% Renewable Portfolio Standard content due to a mismatch in reporting periods between the Power Con tent L abel and Renewable Portfolio Standard programs. The California Energy Commission permits only energy deliveries that phys ically occurred during the calendar year to be included in the Power Content Label. For Renewable Portfolio
2 A small proportion of this WAPA power (279 MWh) also met the definition of Renewable Portfolio Standard-eligible energy.
Agenda Item: Approve submission of Hetch Hetchy Power’s Power Source Disclosure Reports/Power Content Label Commission Meeting Date: September 20, 2023
Standard compliance, by contrast, the California Energy Commission permits Renewable Portfolio Standard energy generated up to three years before (and in some cases even longer) to meet Renewable Portfolio Standard requirements.
After retail se llers sub mit the ir Power Source Disclosure Reports to the California Energy Commission, the agency then compiles them to determine the statewid e mix o f electricity resources used to meet California’s electricity demand and provides t his information b ack to retail sellers fo r inclusion in their Power Content Labels in the form of a Power Content Label template.
Hetch Hetchy Power intends to discl ose the electricity sources of its sales to customers for 2022 using the Power Content Label, a draft of which is attached to this agenda item. The Power Content Label is in the format prescribed by the C alifornia Energy Commission on August 16, 2023 for all retail sellers . The Power Content Label shows, in t abular form, the el ectricity source s for Het ch Hetchy Power’s sales and provides additional descripti ve i nformation to improve readability and understanding for customers.
As a result o f Assembly Bill 1110 (Ting , 2015 ),
3 starting in 2020
Power Source Disclosure Reports also calculate greenhouse gas emissions intensity (pounds CO2e/MWh) for e ach retail selle r to be included on the Power Content Label.
Both Hetch Hetchy Power ’s General and Pr emium Service had a 2022 greenhouse gas emissions intensity o f 0 pounds CO 2e/MWh.
This com pares to California ’s statewide emissions intensity of 422 pounds CO2e/MWh, while in 202 1, the l atest year for wh ich this data is av ailable, PG&E’s default product was 98 pounds CO2e/MWh.
Under the California Energy Commission’s regulations, Hetch Hetchy Power must provide all cust omers with a copy of the P ower Content Label either as a physical mailer or an electronic message (only for those customers billed electronically). The P ower Content Label will also be p osted on the SFPUC’s website.
Under the California Energy Commission ’s regulations, this Commission must attest to the v eracity of Hetch Hetchy Power ’s Power Source Disclosure Reports and Power Content Label or have them verified by a qualified thi rd party. The Commi ssion has attested to the v eracity of Hetch Hetchy Power’s Power Source Disclosure Reports since Hetch Hetchy started its reporting in 2011.
3 This bill amended Section 398.1 and 398.4 of the Public Utilities Code, and tasked the California Energy Commission to adopt guidelines for the reporting and disclosure of greenhouse gas emissions intensity associated with retail electricity sales.
Agenda Item: Approve submission of Hetch Hetchy Power’s Power Source Disclosure Reports/Power Content Label Commission Meeting Date: September 20, 2023
The attache d resolution attests to the ver acity of the P ower Source Disclosure Reports and P ower Content Label. The attestation of veracity i s to be executed by t he Assistant Ge neral Manager for Power’s designee.
Result of Inaction: If the Commission does not approve submission of an at testation of veracity, the SF PUC will be re quired to inc ur the time and cost of having the P ower Source D isclosure Reports and P ower Content Label independently verified and may incur fines if the verification is not completed by the California Energy Commission’ s October 2, 2023 deadline.
Recommendation: SFPUC staff r ecommends that the Commission adopt the a ttached resolution.
